`OFFICE ACTION
`
`(cid:160)T
`
`O AVOID ABANDONMENT, THE OFFICE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 7/2/2008
`
`The referenced application has been reviewed by the assigned trademark-examining attorney.(cid:160) Applicant must respond timely and completely to
`the issue(s) below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.
`
`(cid:160)S
`
`EARCH
`
`(cid:160) T
`
`he Office records have been searched and there are no similar registered or pending marks that would bar registration under Trademark Act
`Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
`
`SECTION 2(e)(1) REFUSAL – MERELY DESCRIPTIVE
`
`(cid:160)
`(cid:160)
`
`
`Registration is refused because the applied-for mark merely describes a feature of applicant’s goods. (cid:160) Trademark Act Section 2(e)(1), 15 U.S.C.
`§1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.
`A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose or use of the specified goods and/or
`services.(cid:160) TMEP §1209.01(b); see In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421 (Fed. Cir. 2005); In re Gyulay, 820
`F.2d 1216, 1217-18, 3 USPQ2d 1009, 1010 (Fed. Cir. 1987).(cid:160) Moreover, a mark that identifies a group of users to whom an applicant directs its
`goods and/or services is also merely descriptive.(cid:160) TMEP §1209.03(i); see In re Planalytics, Inc., 70 USPQ2d 1453, 1454 (TTAB
`2004). Here, the applicant proposes the mark “ AVCCAM” for “Memory card camera-recorders, memory card recorders, memory card portable
`recorders.” The acronym AVC refers to “advanced video coding.” (cid:160) (See attached dictionary definitions.)(cid:160) The language AVC or “advanced
`video coding” describes the applicant’s goods because they function using AVC standards or are used with goods incorporating AVC standards.
`The term “CAM” is short for camera. The obvious and apparent meaning is that applicant’s goods involve a camera that incorporates or uses
`AVC standards. As described by applicant’s own webpage the applicants “ camcorder utilizes AVCHD, the industry’s newest
`(cid:160) long GOP
`compression standard based on MPEG-4 AVC/H.264 high profile encoding.” Therefore, the proposed mark is merely descriptive of a feature of
`applicant’s goods and registration on the Principal Register must be refused under Trademark Act Section 2(e)(1).
`Although the trademark-examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and
`arguments in support of registration.
`
`(cid:160)I
`
`f the applicant chooses to respond to the refusal to register, the applicant must also respond to the following requirements.
`
`(cid:160)S
`
`ignificance Inquiry
`
`Applicant must explain whether “AVCCAM” has any meaning or significance in the industry in which the goods and/or services are
`manufactured/provided, or if such wording is a “term of art” within applicant’s industry.
`(cid:160) Applicant must also explain whether this wording
`identifies a geographic place, or has a meaning in a foreign language.(cid:160) See 37 C.F.R. §2.61(b); TMEP §814.
`
`(cid:160)F
`
`ailure to respond to this request for information can be grounds for refusing registration.(cid:160) See In re DTI P’ship LLP , 67 USPQ2d 1699, 1701
`(TTAB 2003); TMEP §814.
`
`(cid:160)I
`
`f applicant has questions about its application or needs assistance in responding to this Office action, please telephone the assigned trademark-
`examining attorney.

`DEFINITION -1’! cam, homecam, or
`Web-cam is a video camera, usually
`attached directly to a computer, whose
`current or latest image is req uestable
`from a Web she. A live cam is one that
`is contsritialiy providing new images that
`are transmitted in rapid succession or,
`in some cases. in streaming video.
`-Sites with live cams sometimes embed
`them as E applets in Web pages.
`Cams have caught on; there are now
`{we estimate} several thousand sites
`with cams. The first cams were
`positioned mairily on fish tanks and
`coffee machines, Many oftoda'y's live
`cams are on se)(—orierit.ed sites. For
`travel promotion, trafiic i|"lf0|'t'I’1&ti0|'I, and the rerriote visualization of any
`orig oing event that's interesting, web-cams seem like an exciting possibility
`that will become more common as users get access to more bandwidth.
