`A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose or use of the specified goods and/or
`services.(cid:160) TMEP §1209.01(b); see In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421 (Fed. Cir. 2005); In re Gyulay, 820
`F.2d 1216, 1217-18, 3 USPQ2d 1009, 1010 (Fed. Cir. 1987).(cid:160) Moreover, a mark that identifies a group of users to whom an applicant directs its
`goods and/or services is also merely descriptive.(cid:160) TMEP §1209.03(i); see In re Planalytics, Inc., 70 USPQ2d 1453, 1454 (TTAB
`2004). Here, the applicant proposes the mark “ AVCCAM” for “Memory card camera-recorders, memory card recorders, memory card portable
`recorders.” The acronym AVC refers to “advanced video coding.” (cid:160) (See attached dictionary definitions.)(cid:160) The language AVC or “advanced
`video coding” describes the applicant’s goods because they function using AVC standards or are used with goods incorporating AVC standards.
`The term “CAM” is short for camera. The obvious and apparent meaning is that applicant’s goods involve a camera that incorporates or uses
`AVC standards. As described by applicant’s own webpage the applicants “ camcorder utilizes AVCHD, the industry’s newest
`(cid:160) long GOP
`compression standard based on MPEG-4 AVC/H.264 high profile encoding.” Therefore, the proposed mark is merely descriptive of a feature of
`applicant’s goods and registration on the Principal Register must be refused under Trademark Act Section 2(e)(1).
`Although the trademark-examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and
`arguments in support of registration.
