`egistration of the applied-for mark, CORDLESS TOOLS combined with design elements, was previously refused as deceptive because the
`term CORDLESS was found to be deceptive as applied to applicant’s goods, “Power tools, namely, electric drills, impact tools, percussion
`tools, power saws, electric screwdrivers, kits containing combinations of saws, screwdrivers, drills and flashlights,” in Class 7. (cid:160) Trademark Act
`Section 2(a), 15 U.S.C. §1052(a); see In re Budge Mfg. Co., 857 F.2d 773, 8 USPQ2d 1259 (Fed. Cir. 1988); In re Phillips-Van Heusen Corp., 63
`USPQ2d 1047 (TTAB 2002); In re Organik Techs., Inc., 41 USPQ2d 1690 (TTAB 1997); TMEP §1203.02.(cid:160) The applicant has responded to this
`refusal by amending the identification of goods to indicate that all of the identified power tools are “cordless.” (cid:160) Because the identification of
`goods no longer includes non-cordless tools, the Section 2(a) Refusal is Obviated.

`s discussed above, to overcome the Section 2(a) refusal, applicant was advised to amend the wording to specify the tools are “cordless.” (cid:160) The
`applicant has done so.

`he applicant was also required to amend the wording “impact tools” and “percussion tools” because these terms were found to be indefinite.
`See TMEP §1402.01.(cid:160) The applicant was also advised that kits are classified according to the international class of the majority of the items.(cid:160)
`Therefore, applicant was required to amend the wording “kits containing combinations of saws, screwdrivers, drills, and flashlights,” to specify
`that the tools in the kit are power tools.(cid:160) See TMEP §§1401.05, 1402.01, 1402.03.

`cordless power tools, namely, drill/drivers, hammerdrill/drivers, impact drivers, compact wrenches, circular saws, reciprocating saws, jig
`saws, angle grinders and flashlights, in Class 7.

`he proposed amendment to the identification cannot be accepted because the following wording refers to goods that are not within the scope of
`the identification that was set forth in the application at the time of filing:(cid:160) “angle grinders and flashlights,” identified as individual power tools
`and “drivers, impact drivers, compact wrenches, and angle grinders,” identified as parts of the kits. (cid:160) See 37 C.F.R. §2.71(a).(cid:160) The wording
`“angle grinders and flashlights” is beyond the scope of the original wording because the original list of power tools did not include any items
`broad enough to include these items.(cid:160) Additionally, “flashlights” are classified in Class 11; applicant may only include “flashlights” in the list
`of kit items because the majority of goods in the kit are power tools properly classified in Class 7.(cid:160) The various types of “drivers” “angle
`grinders,” and “compact wrenches” identified as parts of the kits are beyond the scope of the original wording for the kits because the kits did
`not include “impact tools” or “percussion tools” or any other wording broad enough to include “drivers.”
`(cid:160) Similarly, none of the items in the
`original list of goods in the kits was broad enough to include “angle grinders” or “compact wrenches.”

`dentifications can be amended only to clarify or limit the goods and/or services, adding to or broadening the scope of the goods and/or services
`is not permitted.(cid:160) Id.; see TMEP §§1402.06 et seq., 1402.07(a).(cid:160) Therefore, this wording should be deleted from the identification.

`dditionally, the various items identified as “drill/drivers” in the list of power tools are indefinite. (cid:160) See TMEP §1402.01.(cid:160) If each of these items
`is a compound tool that performs as both a drill and a driver, applicant may amend these terms to “drill-driver.” (cid:160) If they are separate items,
`applicant should replace the slash with the term “and.”
