`
`O AVOID ABANDONMENT, THE OFFICE MUST RECEIVE A PROPER RESPONSE TO THIS OFFICE ACTION WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 4/20/2010
`
`The statement of use has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant must respond timely and completely to the
`issue(s) below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`(cid:160)S
`
`PECIMEN UNACCEPTABLE
`
`(cid:160)T
`
`he specimen is not acceptable because, although identified as a point-of-sale display associated with the goods, it appears to be mere
`advertising material; it is not accompanied by evidence of point-of-sale presentation.(cid:160) See In re Ancha Elecs., Inc., 1 USPQ2d 1318, 1319-20
`(TTAB 1986); TMEP §904.03(g).(cid:160) Material that functions merely to tell prospective purchasers about the goods, or to promote the sale of the
`goods, is not acceptable to show trademark use.(cid:160) TMEP §904.04(b).(cid:160) Leaflets, handbills, brochures, advertising circulars and other printed
`advertising material, while normally acceptable for showing use in connection with services, generally are not acceptable specimens for showing
`trademark use in connection with goods.(cid:160) See In re MediaShare Corp., 43 USPQ2d 1304, 1307 (TTAB 1997); In re Schiapparelli Searle, 26
`USPQ2d 1520, 1522 (TTAB 1993); TMEP §§904.04(b), (c), 1301.04.
`
`(cid:160)H
`
`owever, a printed catalog or similar specimen, which is otherwise a form of advertising, is acceptable to show trademark use as a display
`associated with the goods if it includes (1) a picture of the relevant goods or a textual description that identifies the actual features or inherent
`characteristics of the goods such that the goods are recognizable, (2) the mark appearing sufficiently near the picture or textual description of the
`goods so as to associate the mark with the goods, and (3) information necessary to order the goods (e.g., an order form or a phone number,
`mailing address, or e-mail address for placing orders) or a visible weblink to order the goods.(cid:160) See In re Sones, ___ F.3d ___, ___ USPQ2d ___,
`No. 2009-1140, 2009 U.S. App. LEXIS 28198, at *11-13 (Fed. Cir. Dec. 23, 2009); In re Dell Inc., 71 USPQ2d 1725, 1727-29 (TTAB 2004);
`
`(cid:160)(cid:160)
`
`
`Lands’ End, Inc. v. Manbeck , 797 F. Supp. 511, 513-14, 24 USPQ2d 1314, 1316 (E.D. Va. 1992); TMEP §904.03(h).(cid:160) Displays associated with
`the goods that comprise point-of-sale material such as banners, posters, shelf-talkers, window displays, menus, or similar devices are also
`
`acceptable specimens to show trademark use.(cid:160) See In re Bright of Am., Inc., 205 USPQ 63, 71 (TTAB 1979); TMEP §904.03(g).(cid:160)(cid:160)
`
`A statement of use must include a specimen showing the applied-for mark in use in commerce for each class of goods specified in the statement
`of use.(cid:160) Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.56(a), 2.88(b)(2); TMEP §§904, 1109.09(b).(cid:160) Trademark Act
`Section 45 requires use of the mark “on the goods or their containers or the displays associated therewith or on the tags or labels affixed
`thereto.” (cid:160) 15 U.S.C. §1127; see 37 C.F.R. §2.56(b)(1); TMEP §§904.03, 904.04(b), (c).
`
`(cid:160)T
`
`herefore, applicant must satisfy one of the following:
`
`Submit evidence of point-of-sale presentation, such as (a) a photograph, with the mark clearly discernible, showing the specimen
`(1)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`used in association with the goods as a point-of-sale display; or (b) a statement, verified with an affidavit or signed declaration under 37
`C.F.R. §2.20, providing sufficient detail to show how the specimen is actually used at the point of sale to link or associate applicant’s
`mark with the goods.(cid:160) A mere statement that the specimen is used in connection with the sale of the goods, such as distributed at sales
`presentations, is not sufficient to meet this requirement.(cid:160) See 37 C.F.R. §§2.61(b), 2.193(e)(1); In re Osterberg, 83 USPQ2d 1220, 1224
`(TTAB 2007); In re Drilco Indus., Inc., 15 USPQ2d 1671, 1672 (TTAB 1990); In re Ancha Elecs., 1 USPQ2d at 1319-20; TMEP
`§904.03(g).; or
`
`Submit a substitute specimen showing proper trademark use of the mark for each class of goods specified in the statement of use,
`(2)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`and the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:(cid:160) “ The substitute specimen was in
`use in commerce prior to the expiration of the deadline for filing the statement of use.” (cid:160) 37 C.F.R. §2.59(b)(2); TMEP §904.05; see
`37 C.F.R. §2.193(e)(1).(cid:160) If submitting a substitute specimen requires an amendment to the dates of use, applicant must also verify the
`amended dates.(cid:160) 37 C.F.R. §2.71(c); TMEP §904.05.
`
`(cid:160)E
`
`xamples of specimens for goods are tags, labels, instruction manuals, containers, or photographs that show the mark on the actual goods or
`packaging.(cid:160) See TMEP §§904.03 et seq.
`
`(cid:160)P
`
`ending receipt of a proper response, registration is refused because the specimen does not show the applied-for mark in use in commerce as a
`
`trademark.(cid:160) Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.56(a), 2.88(b)(2); TMEP §§904, 904.07(a).(cid:160)(cid:160)
`
`Applicant may not withdraw the statement of use.(cid:160) 37 C.F.R. §2.88(g); TMEP §1109.17.

`evidence as to why the refusal should be withdrawn and the mark should register.(cid:160) To respond to requirements, applicant should set forth in
`
`writing the required changes or statements and request that the Office enter them into the application record.(cid:160)(cid:160)
`
`The response must be signed by the individual applicant or someone with legal authority to bind a juristic applicant (e.g., a corporate officer or
`general partner).(cid:160) See 37 C.F.R. §§2.62(b), 2.193(e)(2)(ii); TMEP §§611.03(b), 611.06 et seq., 712.01.(cid:160) In the case of joint applicants, all must
`sign.(cid:160) 37 C.F.R. §2.193(e)(2)(ii); TMEP §611.06(a).(cid:160) In addition, the proper signatory must personally sign or personally enter his/her electronic
