`When applicant’s mark is compared to a registered mark, “the points of similarity are of greater

`egistration of a mark in typed or standard character form means that the mark may be displayed in any
`lettering style.(cid:160) 37 C.F.R. §2.52(a).(cid:160) The rights associated with a mark in typed or standard character form
`reside in the wording itself, and registrant is free to adopt any style of lettering, including lettering
`identical to that used by applicant.(cid:160) Therefore, applicant’s presentation of its mark in special form will not
`avoid likelihood of confusion with a mark that is registered in typed or standard character form because
`the marks presumably could be used in the same manner of display.(cid:160) See In re Melville Corp., 18 USPQ2d

`Disclaimed matter is typically less significant or less dominant when comparing marks.(cid:160) Although a
`disclaimed portion of a mark certainly cannot be ignored, and the marks must be compared in their
`entireties, one feature of a mark may be more significant in creating a commercial impression.(cid:160) In re Dixie
`Restaurants Inc., 105 F.3d 1405, 41 USPQ2d 1531 (Fed. Cir. 1997) (holding that DELTA is the dominant

`he top-level domain (TLD) “.COM” signifies to the public that the user of the domain name is a
`commercial entity.(cid:160) In re Oppedahl & Larsen LLP, 373 F.3d 1171, 71 USPQ2d 1370, 1373-1374 (Fed.
`Cir. 2004); Interactive Products Corp. v. a2z Mobile Office Solutions, Inc., 66 USPQ2d 1321, 1322 (6th
`Cir. 2003) citing Panavision Int’l , L.P. v. Toeppen, 141 F.3d. 1316, 1318-1319, 46 USPQ2d 1511, 1513
`(9th Cir. 1998); In re CyberFinancial.Net, Inc., 65 USPQ2d 1789 (TTAB 2002); In re Martin Container,

`customers as part of an Internet address, and, therefore, has no source identifying significance.(cid:160) In re

`BONDS.COM to have any meaning apart from the meaning of the individual terms combined”); In re

`rent containers, “CONTAINER.COM” would immediately indicate a commercial web site on the Internet
`which provides containers.”).

`n this case, the marks sound identical.(cid:160) Applicant argues that consumers will pronounce the Greek letter
`in applicant’s mark when calling for the goods. (cid:160) The examiner respectfully disagrees.(cid:160) Consumers are far
`more likely to simply view the Greek letter as a design element, and pronounce the wording presented to
`them, namely, HI PHI.(cid:160) This sounds identical to the leading portion of applicant’s mark, HIFI.
`
`(cid:160)T
`
`he marks also have highly similar meanings.(cid:160) Applicant’s use of the wording HI PHI applied to car
`audio speakers has no meaning to the consumer other than a phonetic equivalent for HI FI.(cid:160) The marks
`have highly similar commercial impressions.(cid:160) As noted above, consumers would perceive the .COM
`portion of the registrant’s mark as part of a web address and lacking source significance. Consumers are
`also highly unlikely to perceive applicant’s use of the PHI symbol as evoking a timeless classic virtue of
`ancient Greece, as applicant argues.(cid:160) Consumers are used to seeing Greek symbols used to indicate
`membership in fraternities and other organizations, and as mathematical symbols.(cid:160) See attached
`registrations where PHI is used to indicate membership in fraternities and other organizations.(cid:160) See
`attached dictionary definitions for Greek letters including PHI used as mathematical symbols.(cid:160) Thus, the
`consumer has no reason to evoke ancient Greece when seeing a Greek symbol used in conjunction with
`car audio speakers.(cid:160) Further, applicant has not provided any reason or evidence as to why consumers
`would do so.
`

`
`he marks also appear highly similar because the registrant’s mark is presented in standard character
`form, and thus can be written in the same stylized writing as the applicant’s proposed mark. (cid:160) Thus,
`applicant’s argument that stylization helps to distinguish the marks is unpersuasive.
`
`(cid:160)C
`
`onsidering all of these factors, the marks sound identical, and are highly similar in meaning and
`
`appearance.(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) b. (cid:160)(cid:160) As to the Goods and/or Services
`
`The goods and/or services of the parties need not be identical or directly competitive to find a likelihood
`of confusion.(cid:160) Instead, they need only be related in some manner, or the conditions surrounding their
`marketing be such that they could be encountered by the same purchasers under circumstances that could
`give rise to the mistaken belief that the goods and/or services come from a common source.(cid:160) In re
`Martin’s Famous Pastry Shoppe , Inc., 748 F.2d 1565, 223 USPQ 1289 (Fed. Cir. 1984); In re Melville

`confusingly similar to BIGGS for furniture); In re U.S. Shoe Corp., 229 USPQ 707 (TTAB 1985)
`(CAREER IMAGE (stylized) for retail women’s clothing store services and clothing held likely to be
`confused with CREST CAREER IMAGES (stylized) for uniforms); In re United Service Distributors, Inc.,
`229 USPQ 237 (TTAB 1986) (design for distributorship services in the field of health and beauty aids
`held likely to be confused with design for skin cream); In re Phillips-Van Heusen Corp., 228 USPQ 949
`(TTAB 1986) (21 CLUB for various items of men’s, boys’, girls’ and women’s clothing held likely to
`be confused with THE “21” CLUB (stylized) for restaurant services and towels); Steelcase Inc. v.
`Steelcare Inc., 219 USPQ 433 (TTAB 1983) (STEELCARE INC. for refinishing of furniture, office
`furniture, and machinery held likely to be confused with STEELCASE for office furniture and
`accessories); Mack Trucks, Inc. v. Huskie Freightways, Inc., 177 USPQ 32 (TTAB 1972) (use of similar
`marks for trucking services and on motor trucks and busses is likely to cause confusion).

`ikelihood of confusion is determined on the basis of the goods or services as they are identified in the
`application and the registration.(cid:160) Canadian Imperial Bank of Commerce v. Wells Fargo Bank, 811 F.2d
`1490, 1 USPQ2d 1813 (Fed. Cir. 1987); Paula Payne Products Co. v. Johnson Publishing Co., Inc., 473
`F.2d 901, 177 USPQ 76 (C.C.P.A. 1973).(cid:160) Where an identification of goods and/or services is very broad,
`it is presumed that the application encompasses all goods and/or services of the type described, that they
`move in all normal channels of trade and that they are available to all potential customers.(cid:160) TMEP
`§1207.01(a)(iii).
`
`(cid:160)(cid:160)In this case, the goods and services are highly related because retail services featuring audio electronic
`
`components are highly likely to include car audio speakers, and thus would be encountered by the same
`consumers.(cid:160) See web sites for retail services featuring audio products provided in the Office Action dated
`February 8, 2005.(cid:160) A component is simply part of something.(cid:160) See attached dictionary definition.(cid:160)(cid:160) The
`registrant’s identification of audio electronic components can include car audio speakers because the
`speakers would just be a component of a car audio system.(cid:160) See attached websites describing car audio
`systems.(cid:160) Thus, the goods and services in this case are highly related, and highly likely to be encountered
`together in the marketplace.

`c.(cid:160) Conclusion as to Likelihood of Confusion
`On balance, because the marks sound identical, are highly similar in meaning and appearance, and the
`goods and services are highly related, confusion is likely.(cid:160) Thus, applicant’s mark must be refused. (cid:160) For
`
`the reasons set forth herein, this refusal is maintained and made FINAL.(cid:160)(cid:160)

`2.(cid:160) Response Guidelines:
`If applicant fails to respond to this final action within six months of the mailing date, the application will
