`disclaimer of “coach,” found in the Office’s X-Search database (10/06/06).
`Also attached to this Office action are excerpts from websites showing use of the phrase “sports coach” to describe or identify a position or role

`When the UCLA Sports Laboratory surveyed I

`Just as it is importantfor athletes to have written trainincl plans. each coach should haye his
`or her own written training. or"|esson." plan. Many reasons exist for haying a plan. but one
`reason is help a coach defend against lawsuits for injuries suffered by an athlete.
`
`Injured players have many ayenuesto sue a coach. A coach may be sued for"battery'. both
`by hisfher own players. and by opposing players or otherswhere. for instance. a coach
`physically grabs a player. official or an opposing player. This can happen. for instance. in a
`situation where tensions and emotions are running high in a game and the coach acts
`inappropriately. A coach may even be found to be criminally negligent. with both fines and
`potential criminal liability imposed. for certain types of acts. The most obvious ofthese is
`where a coach instructs one of his or her athletesto engage in a behaviorknown to cause
`serious risk of harm to an opposing player. such as using a helmetto "speaf' the other
`player. In such instance. the coach may be found to have directed the action and have
`vicarious liabilityforthc ensuing injury.
