`This letter responds to the applicant’s communication dated October 12, 2006. (cid:160) The amended(cid:160) identification of goods submitted is accepted.(cid:160)
`Moreover, the examiner acknowledges that the applicant wishes to rely upon a dual basis for filing.(cid:160) However, the potential refusal under
`Section 2(d) of the Act is maintained and CONTINUED.(cid:160)(cid:160) As previously indicated, the respective marks, LUXLIFT and LIFTLUX, are very
`similar in sound, appearance and meaning and create the same overall commercial impression. Furthermore, the respective lifting apparatuses are
`very closely related goods presumably used for identical purposes.(cid:160) Therefore, the applicant’s argument that the registrant’s goods are generally
`used only in temporary construction applications is without merit.(cid:160) It is well settled that the issue of likelihood of confusion between marks must
`be determined on the basis of the goods or services as they are identified in the application and the registration. Canadian Imperial Bank of
`Commerce v. Wells Fargo Bank, 811 F.2d 1490, 1 USPQ2d 1813 (Fed. Cir. 1987); Paula Payne Products Co. v. Johnson Publishing Co., Inc.,
`473 F.2d 901, 177 USPQ 76 (C.C.P.A. 1973).(cid:160) Since the identification of the registrant’s goods is very broad, it is presumed that the registration
`encompasses all goods of the type described for a variety of purposes, that they move in all normal channels of trade and that they are available
`to all potential customers.(cid:160) In re Elbaum, 211 USPQ 639, 640 (TTAB 1981).(cid:160) TMEP §1207.01(a)(iii).(cid:160) Furthermore, the applicant’s lighting
`fixtures for lifting apparatuses, presumably lighting fixtures for any type of lifting apparatuses including those in the cited registration, are also
`closely related goods likely to be used “conjointly”. (cid:160) When goods offered under very similar names in trade are used “conjointly”, confusion is
`likely.
