`(TTAB 1987); TMEP §§1202 et seq.(cid:160)(cid:160) Invoices, announcements, order forms, bills of lading, leaflets, brochures, publicity releases and
`other printed advertising material generally are not acceptable specimens.(cid:160) In re Bright of America, Inc., 205 USPQ 63 (TTAB 1979);

`The applicant believes that its specimens are acceptable, because they are displays associated with the goods. However, it is the examining
`attorney’s belief that the applicant’s specimens do not satisfy the statutory criteria for displays associated with the goods.

`ccordingly, examining attorneys should accept any catalog or similar specimen as a display associated with the goods, provided: (1) it includes
`
`(cid:160)
`
`
`a picture of the relevant goods; (2) it shows the mark sufficiently near the picture of the goods to associate the mark with the goods; and (3) it
`includes the information necessary to order the goods, (e.g., an order form, or a phone number, mailing address, or e-mail address for placing
`orders). Any form of advertising that satisfies these criteria should be construed as a display associated with the goods.(cid:160) TMEP section 904.06(a).

`n this case, the specimen is not acceptable because it consists of advertising material for goods.(cid:160) Section 45 of the Trademark Act requires use
`“on the goods or their containers or the displays associated therewith or on tags or labels affixed thereto.” (cid:160) 15 U.S.C. §1127; see 37 C.F.R.
`
`§2.56(b)(1); TMEP §904.05.(cid:160)(cid:160)
`
`Material that functions merely to tell prospective purchasers about the goods, or to promote the sale of the goods, is unacceptable to show
`trademark use.(cid:160) Indeed, invoices, business cards, announcements, price lists, listings in trade directories, order forms, bills of lading, leaflets,
`brochures, publicity releases, advertising circulars and other printed advertising material, while normally acceptable for showing use in
`connection with services, generally are not acceptable specimens for showing trademark use in connection with goods.(cid:160) See In re MediaShare
`
`Corp., 43 USPQ2d 1304, 1307 (TTAB 1997); In re Schiapparelli Searle, 26 USPQ2d 1520, 1522 (TTAB 1993); TMEP §§904.05 and 904.07.(cid:160)(cid:160)

`An application based on Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each class of goods.(cid:160)

`herefore, applicant must submit the following:

`applicant later amends the application back to use in commerce by filing an acceptable allegation of use with a proper specimen.(cid:160) 15 U.S.C.
