`withdrawn from publication and returned to the examining attorney by the Official Gazette office(cid:160) for correction of an identification problem.(cid:160)
`The following requirement is therefore now added.

`because it is too broad.(cid:160) Applicant needs to specify the particular goods in commerce with which it will use the mark.(cid:160)(cid:160)

`The goods are currently recited as follows:(cid:160) “cinematographic apparatus and instruments connectable to the Internet and remotely controllable,
`other cinematographic apparatus and instruments, namely, optical apparatus and instruments, namely, optical disk drivers, optical disc players,
`and optical disk recorders connectable to the Internet and remotely controllable, other optical apparatus and instruments, namely, optical disc
`drivers, optical disc players, and optical disc recorders.” (cid:160) What is unclear, in reading this identification, is whether “optical apparatus and
`instruments” is intended to modify “cinematographic apparatus and instruments connectable to the Internet and remotely controllable” and/or
`“other cinematographic apparatus and instruments.” (cid:160) In reading the entire Class 9 identification of goods, it appears that the omitted the list of
`particular cinematographic instruments may simply have been an oversight, both by the applicant in amending its list, and by the examining
`attorney in not noticing the problem.

`f accurate, applicant may substitute the following language:(cid:160) “cinematographic apparatus and instruments connectable to the Internet and
`remotely controllable, namely, ______ {specify cinematographic apparatus and instruments, e.g., cameras, projectors}; other cinematographic
`apparatus and instruments, namely, ______ {specify cinematographic apparatus and instruments, e.g., cameras, projectors}; optical apparatus
`and instruments, namely, optical disk drivers, optical disc players, and optical disk recorders connectable to the Internet and remotely

`controllable; other optical apparatus and instruments, namely, optical disc drivers, optical disc players, and optical disc recorders,” in Class 9. (cid:160)(cid:160)

`In her recommended language, the examining attorney’s use of semi-colons in place of some commas currently used in this identification is for
`purposes of clarity; this particular change was recommended by the Official Gazette office.(cid:160) In fact, the Official Gazette office specifically
`recommends re-drafting the entire identification of goods and services to (1) add semi-colons at the end of each good and/or service and (2)
`delete the use of the word “other” at the beginning of the goods/services. (cid:160) In its current state, applicant’s identification of goods and services is
`difficult to parse.
