`on February 8, 2008.(cid:160) The mark was subsequently returned to the examining attorney by the Office of the Official Gazette for a clarification of
`the identification and classification of particular goods.(cid:160) The following requirement is therefore now added.

`use with an external display screen or monitor” used to describe the goods needs clarification because it may identify goods in a different
`International Class.(cid:160) Applicant is required to specify how the goods are both connectable to the internet and not intended for use with an external
`monitor or display screen.(cid:160) For example, if the goods incorporate a display screen and are connectable to the internet in the manner of a PDA or
`GPS device, then applicant has classified them appropriately but needs to so specify.(cid:160) For example, the following language would be acceptable,
`if accurate:(cid:160) “Units for playing electronic disk games that incorporate a display and are connectable to the Internet and remotely controllable via
`a wireless internet connection,” in Class 28.

`n the other hand, if the goods identified by this language are intended to be connected to the internet via a personal computer, laptop or other
`device such that the computer’s monitor or display screen becomes the video screen for playing the electronic game, then the goods are more
`properly classified in Class 9 and need to be either (1) deleted from the application or (2) classified in Class 9 and identified more specifically.(cid:160)
`For example, the following wording would be acceptable, if accurate:(cid:160) “Units for playing electronic disk games connectable to the Internet and
`remotely controllable via a connection to a personal computer, laptop computer or other internet-connected device incorporating a display or
`monitor,” in Class 9.
