`
`The assigned trademark examining attorney has reviewed the referenced application and has determined the following:
`
`Results of Trademark Act Section 2(d) Search
`
`(cid:160)T
`
`he Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark
`Act Section 2(d), 15 U.S.C. §1052(d).(cid:160) TMEP §704.02.
`
`Trademark Act Section 1, 2, 3 and 45 Refusal to Register
`
`(cid:160)R
`
`egistration is REFUSED because the activities recited in the description of services are not “services” as contemplated by the Trademark Act. (cid:160)
`Trademark Act Sections 1, 2, 3 and 45, 15 U.S.C. §§1051, 1052, 1053 and 1127; TMEP §§1301.01 et seq.(cid:160) Specifically, the description of
`services identifies the following activities: “promoting the use and sale of consumer electronics products, namely, plasma TVs, digital still
`cameras, camcorders and DVD players used during environmental sports shows which will catch or display the motion of participants on camera
`
`(cid:160)
`(cid:160)(cid:160)
`(cid:160)(cid:160)(cid:160)
`
`
`and share the captured images on related displays, plasma TVs, camcorders and DVD players.” (cid:160)(cid:160)
`
`It appears from the record that applicant is promoting the use and sale of its own products.(cid:160) It is well settled that the promotion of one's own
`goods is not a service.(cid:160) TMEP §§1301.01(b)(i); In re Radio Corp. of America, 205 F.2d 180, 98 USPQ 157 (C.C.P.A. 1953) (record manufacturer
`who prepares radio programs primarily designed to advertise and sell records is not rendering service); In re SCM Corp., 209 USPQ 278 (TTAB
`1980) (supplying merchandising aids and store displays to retailers does not constitute separate service); Ex parte Wembley, Inc., 111 USPQ 386
`(Comm'r Pats. 1956) (national advertising program designed to sell manufacturer's goods to ultimate purchasers is not service to wholesalers and
`retailers, because national product advertising is normally expected of manufacturers of nationally distributed products, and is done in
`furtherance of the sale of the advertised products).
`
`(cid:160)T
`
`he following criteria have evolved for determining what constitutes a service, in connection with which a mark may be registered:(cid:160) (1) a service
`must be a real activity; (2) a service must be performed to the order of, or for the benefit of, someone other than applicant; and (3) a service must
`be an activity that is qualitatively different from anything necessarily done in connection with the sale of applicant’s goods or the performance
`of another service.(cid:160) In re Betz Paperchem, Inc., 222 USPQ 89, 90 (TTAB 1984); see In re Canadian Pacific Ltd., 754 F.2d 992, 224 USPQ 971
`(Fed. Cir. 1985); In re Moore Business Forms, Inc., 24 USPQ2d 1638 (TTAB 1992); In re Integrated Resources, Inc., 218 USPQ 829 (TTAB
`1983); In re Landmark Communications, Inc., 204 USPQ 692 (TTAB 1979).
`
`(cid:160)I
`
`f applicant is in fact promoting the use and sale of the products of others, rather than applicant’s own products, then applicant should amend the
`identification of services to make clear that it is promoting the sale and use of plasma TVs, digital still cameras, camcorders and DVD players of
`others.(cid:160) TMEP §§1301.01(b)(i), 1402.01 and 1402.03.(cid:160) Applicant's specimens of use will have to show that it is promoting the sale and use of the
`
`plasma TVs, digital still cameras, camcorders and DVD players of others.(cid:160)(cid:160)
`
`Please note that, while the identification of services may be amended to clarify or limit the services, adding to the services or broadening the
`scope of the services is not permitted.(cid:160) 37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Therefore, applicant may not amend the identification to include
`services that are not within the scope of the services set forth in the present identification.
`
`If applicant has any questions, please feel free to contact the undersigned.
