`Proposed Amendment to the Identification of Services

`n the initial application, applicant identified the following services:(cid:160) “promoting the use and sale of consumer electronics products, namely,
`plasma TVs, digital still cameras, camcorders and DVD players used during environmental sports shows which will catch or display the motion
`of participants on camera and share the captured images on related displays, plasma TVs, camcorders and DVD players” in International Class
`35.

`pplicant now seeks to amend the identification of services to: “capturing or displaying the motion of participants at environmental sports
`shows on camera and sharing the captured images on displays, plasma TVs, camcorders and DVD players in connection with sponsorship of said
`
`environmental sports shows.” (cid:160)(cid:160)
`
`The proposed amendment to the identification cannot be accepted because it refers to services that are not within the scope of the identification
`that was set forth in the application at the time of filing.(cid:160)(cid:160) Capturing and displaying motion on camera (e.g., video recording services) and
`sponsorship of environmental shows are not within the scope of promotion services consisting of the promotion of various electronic products.(cid:160)(cid:160)
`While the identification of services may be amended to clarify or limit the services, additions to the identification or a broadening of the scope of
`the identification are not permitted.(cid:160) 37 C.F.R. §2.71(a); TMEP §§1402.06 et seq. and 1402.07.(cid:160) Therefore, applicant’s amendment is not
`acceptable.(cid:160) In re United States Tobacco, which applicant cites in support of its proposed amendment, is not applicable here, in that in that case,
`the applicant merely clarified the nature of the entertainment services.(cid:160) 1 USPQ2d 1502, 1505 (TTAB 1986).(cid:160) Here, applicant’s proposed
`amendment does not clarify the nature of the promotion services, but rather seeks to identify entirely different services.(cid:160) Because the initial
`Office Action indicated that the identification of services could not be amended to add new services or broaden the scope of the original
`
`In light of the fact that the proposed identification is beyond the scope of the original identification, the examining attorney will not address
`
`identification, applicant’s proposed amendment does not raise a new issue. (cid:160)(cid:160)
`whether the proposed identification of services would otherwise be acceptable.(cid:160)(cid:160)(cid:160)(cid:160)

`REFUSAL MADE FINAL - Trademark Act Section 1, 2, 3 and 45 Refusal to Register

`he refusal to register the proposed mark because the activities recited in the description of services are not “services” as contemplated by the

`Trademark Act is now made FINAL.(cid:160) Trademark Act Sections 1, 2, 3 and 45, 15 U.S.C. §§1051, 1052, 1053 and 1127; TMEP §§1301.01 et seq.(cid:160)(cid:160)

`As noted above, applicant’s amended identification of services is not acceptable because it identifies services that are outside the scope of the
`original identification.(cid:160) Thus, the proposed identification of services does not overcome the refusal.(cid:160) The original description of services
`identifies the following activities: “promoting the use and sale of consumer electronics products, namely, plasma TVs, digital still cameras,
`camcorders and DVD players used during environmental sports shows which will catch or display the motion of participants on camera and
`
`share the captured images on related displays, plasma TVs, camcorders and DVD players.” (cid:160)(cid:160)

`It appears that applicant is promoting the use and sale of its own goods.(cid:160) Please see the attached internet evidence from applicant’s website
`showing that applicant produces its own line of electronics products, including televisions, cameras, camcorders, and DVD players.(cid:160) It is well
`settled that the promotion of one's own goods is not a service.(cid:160) TMEP §§1301.01(b)(i); In re Radio Corp. of America, 205 F.2d 180, 98 USPQ
`157 (C.C.P.A. 1953) (record manufacturer who prepares radio programs primarily designed to advertise and sell records is not rendering service);
`In re SCM Corp., 209 USPQ 278 (TTAB 1980) (supplying merchandising aids and store displays to retailers does not constitute separate
`service); Ex parte Wembley, Inc., 111 USPQ 386 (Comm'r Pats. 1956) (national advertising program designed to sell manufacturer's goods to
`ultimate purchasers is not service to wholesalers and retailers, because national product advertising is normally expected of manufacturers of
`nationally distributed products, and is done in furtherance of the sale of the advertised products).
