`
`he examining attorney raises the following new issue concerning the identification of goods for International Class 9, as indicated in
`my telephone messages to Ms. Pekowsky of May 16 and May 21, 2007.(cid:160) Applicant is encouraged to contact the examining attorney by
`telephone to resolve the issue raised below.
`
`NEW ISSUE – Identification of Goods - International Class 9
`
`(cid:160)T
`
`he wording “software soldering machine” in the identification of goods needs clarification because it is indefinite. (cid:160) TMEP §§1402.01 and
`1402.03.(cid:160) “Autogenous soldering machines” are classified in International Class 7 and “Electric soldering machines” are classified in
`International Class 9.(cid:160) It is unclear from the present wording whether applicant is intending to identifying a soldering machine for use on
`software (in which case applicant must specify whether the soldering machine is “electric” or “autogenous” for classification purposes) or
`whether applicant intended to identify some type of computer software for use with soldering machines.(cid:160) If the latter, applicant must specify how
`the computer software is used in connection with the soldering machines, e.g., “computer software for operating electric soldering machines” in
`International Class 9.(cid:160) Applicant must either clarify the nature of the goods or delete them from the identification.
`
`(cid:160)P
`
`lease note that, while the identification of goods may be amended to clarify or limit the goods, adding to the goods or broadening the scope of
`the goods is not permitted.(cid:160) 37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Therefore, applicant may not amend the identification to include goods that are
`not within the scope of the goods set forth in the present identification.

`NOTICE OF NEW PROCEDURE FOR E-MAILED OFFICE ACTIONS:(cid:160) In late spring 2007, for any applicant who authorizes e-mail
`communication with the USPTO, the USPTO will no longer directly e-mail the actual Office action to the applicant.(cid:160) Instead, upon issuance of an
`Office action, the USPTO will e-mail the applicant a notice with a link/web address to access the Office action using Trademark Document
`Retrieval (TDR),(cid:160)which is located on the USPTO website at http://portal.uspto.gov/external/portal/tow.(cid:160) The Office action will not be attached to
`the e-mail notice.(cid:160) Upon receipt of the notice, the applicant can then view and print the actual Office action and any evidentiary attachments
`using the provided link/web address.(cid:160) TDR is available 24 hours a day, seven days a week, including holidays and weekends.(cid:160) This new process
`is intended to eliminate problems associated with e-mailed Office actions that contain numerous attachments.
