`
`OFFICE ACTION
`
`(cid:160)I
`
`SSUE/MAILING DATE: 5/4/2011
`
`(cid:160)T
`
`HIS IS A FINAL ACTION.
`
`(cid:160)I
`
`NTERNATIONAL REGISTRATION NO. 1049855
`
`(cid:160)T
`
`his Final Office Action is written in response to the applicant’s response to office action letter dated April 14, 2011. (cid:160) In the applicant’s
`response, the applicant argued against a finding of confusion, amended the identification of goods and responded to the request for information.(cid:160)
`In light of the applicant’s responses, the examining attorney has withdrawn the refusal as to §2(d) and accepted the applicant’s information
`
`statement.(cid:160) However, portion of the International Class 09 goods remain indefinite.(cid:160) The applicant must respond to the following.(cid:160)(cid:160)
`
`The examining attorney has considered the applicant's amendment to the identification of goods , but has found the certain amendment(s)
`unacceptable.(cid:160) For the reasons below, the refusal as to the identification of goods and services is maintained and made FINAL.
`
`(cid:160)T
`
`he examining attorney invites the applicant to email or telephone the examining attorney if the applicant believes it may expedite the
`prosecution of this application.
`
`(cid:160)I
`
`dentification of Goods – Clarification Required – Partial Final:
`
`(cid:160)T
`
`he wording “organic luminescent filaments and enclosures therefor and electroluminescent filaments and light-emitting diode filaments and
`enclosures therefor” in the identification of goods needs clarification because it is too broad and could include goods classified in other
`international classes.(cid:160) TMEP §§1402.01 and 1402.03.(cid:160) Specifically, “light conducting filaments” are International Class 09 goods, but
`“filaments for electric lamps” are International Class 11 goods. (cid:160) As a result, the examining attorney must require further clarification.(cid:160) If the
`goods identified are properly classified in International Class 11, the applicant may seek to add the clarified goods to International Class 11 due
`
`(cid:160)
`
`
`to the broad nature of the original International Class 11 filing..
`
`(cid:160)H
`
`owever, it appears the goods “organic luminescent filaments and enclosures therefor and electroluminescent filaments and light-emitting diode
`filaments and enclosures therefor” are beyond the scope of the goods originally contained in International Class 09. (cid:160) The examining attorney is
`unable to locate an original listing in International Class 09 that supports the amended goods.(cid:160) See 37 C.F.R. §2.71(a).(cid:160) Identifications can be
`amended only to clarify or limit the goods; adding to or broadening the scope of the goods and/or services is not permitted.(cid:160) 37 C.F.R. §2.71(a);
`see TMEP §1402.06 et seq.(cid:160) In addition, the international classification of goods and/or services in applications filed under Trademark Act
`Section 66(a) cannot be changed from the classification the International Bureau assigned to the goods in the corresponding international
`registration.(cid:160) 37 C.F.R. §2.85(d); TMEP §§1402.01(c), 1904.02(b).(cid:160) The scope of the identification for purposes of permissible amendments is
`
`limited by the class.(cid:160) 37 C.F.R. §2.85(f); TMEP §§1402.07(a), 1904.02(c).(cid:160)(cid:160)
`
`The examining attorney invites the applicant to indicate what original goods, the amended goods are a subcategory of and propose the entry into
`the identification.(cid:160) For example, if appropriate, the following may be acceptable: “semi conductor elements, namely organic luminescent
`filaments and enclosures therefor and electroluminescent filaments and light-emitting diode filaments and enclosures therefor.”
`
`(cid:160)I
`
`n the alternative, applicant may delete the unacceptable wording from the identification.(cid:160) Once an application has been expressly amended to
`delete goods and/or services, those items may not be later re-inserted.(cid:160) TMEP §1402.07(e).
`
`(cid:160)P
`
`lease note: The international classification of goods and/or services in applications filed under Trademark Act Section 66(a) cannot be changed
`from the classification the International Bureau of the World Intellectual Property Organization assigned to the goods in the corresponding
`international registration.(cid:160) TMEP §§1401.03(d) and 1904.02(b).(cid:160) Therefore, any modification to this wording must identify goods in properly
`
`classified in the original International Class specified in the application for these goods.(cid:160)(cid:160)
`
`Please note:(cid:160) In accordance with the abovementioned requirements, the examining attorney has indicated acceptable changes to the applicant’s
`identification of goods and services below in bold font.(cid:160) Applicant may adopt the following identification of goods and services, if accurate:
`
`Class 09:(cid:160) (cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`“Semi-conductor elements, namely, semi-conductors comprised of silicon, boron nitride, or a combination thereof,
`electroluminescent and light-emitting diode; Electroluminescent (EL) lighting panels, namely, light-emitting diodes, electrical
`power connectors; Semi-conductors elements, namely light conducting filaments in the nature of organic luminescent
`filaments and enclosures therefor and electroluminescent filaments and light-emitting diode filaments and enclosures therefor”
`and
`
`Class 11:(cid:160) (cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`“Electroluminescent (EL) panels for lighting, namely, lighting installations, not in the field of consumer products; Filaments
`for electric lamps, namely organic luminescent filaments and enclosures therefor and electroluminescent filaments and
`light-emitting diode filaments and enclosures therefor, not in the field of consumer products”
`
`(cid:160)§
`
`66 (a) Applications – Classification for Good/Services cannot be Changed (Advisory)
`
`(cid:160)T
`
`he international classification of goods and/or services in applications filed under Trademark Act Section 66(a) cannot be changed from the
`classification given to the goods and/or services by the International Bureau in the corresponding international registration.(cid:160) TMEP §§1401.03(d),
`1904.02(b).
`
`(cid:160)P
`
`TO Online Searching Manual:
`
`(cid:160)F
`
`or aid in selecting acceptable identifications of goods and services and determining proper classification, the searchable Manual of Acceptable
`Identifications of Goods and Services is available on the PTO website at http://tess2.uspto.gov/netahtml/tidm.html.
`
`(cid:160)P
`
`lease also note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.(cid:160)
`37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Therefore, the applicant may not amend to include any goods or services that are not within the scope of
`the goods and services recited in the present identification.

`therefor and electroluminescent filaments and light-emitting diode filaments and enclosures therefor.” (cid:160) The application will then proceed for the
`remaining goods.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).
