`his Final Office Action is written in response to the applicant’s response to office action letter dated April 14, 2011. (cid:160) In the applicant’s
`response, the applicant argued against a finding of confusion, amended the identification of goods and responded to the request for information.(cid:160)
`In light of the applicant’s responses, the examining attorney has withdrawn the refusal as to §2(d) and accepted the applicant’s information
`
`statement.(cid:160) However, portion of the International Class 09 goods remain indefinite.(cid:160) The applicant must respond to the following.(cid:160)(cid:160)

`The examining attorney has considered the applicant's amendment to the identification of goods , but has found the certain amendment(s)

`enclosures therefor” in the identification of goods needs clarification because it is too broad and could include goods classified in other
`international classes.(cid:160) TMEP §§1402.01 and 1402.03.(cid:160) Specifically, “light conducting filaments” are International Class 09 goods, but
`“filaments for electric lamps” are International Class 11 goods. (cid:160) As a result, the examining attorney must require further clarification.(cid:160) If the
`goods identified are properly classified in International Class 11, the applicant may seek to add the clarified goods to International Class 11 due

`to the broad nature of the original International Class 11 filing..

`owever, it appears the goods “organic luminescent filaments and enclosures therefor and electroluminescent filaments and light-emitting diode
`filaments and enclosures therefor” are beyond the scope of the goods originally contained in International Class 09. (cid:160) The examining attorney is
`unable to locate an original listing in International Class 09 that supports the amended goods.(cid:160) See 37 C.F.R. §2.71(a).(cid:160) Identifications can be
`amended only to clarify or limit the goods; adding to or broadening the scope of the goods and/or services is not permitted.(cid:160) 37 C.F.R. §2.71(a);
`see TMEP §1402.06 et seq.(cid:160) In addition, the international classification of goods and/or services in applications filed under Trademark Act
`Section 66(a) cannot be changed from the classification the International Bureau assigned to the goods in the corresponding international
`registration.(cid:160) 37 C.F.R. §2.85(d); TMEP §§1402.01(c), 1904.02(b).(cid:160) The scope of the identification for purposes of permissible amendments is

`The examining attorney invites the applicant to indicate what original goods, the amended goods are a subcategory of and propose the entry into
