`his is a PROVISIONAL PARTIAL REFUSAL of the request for extension of protection of the mark in the above-referenced U.S. application

`powered steam heaters”; “hand dryers”; “electric futons (bedding)”; “distillers (for chemical processing)”; “room coolers”; and

`NTRODUCTION
`
`In a previous Office action mailed December 1, 2015, the trademark examining refused registration of the applied-for mark based on Section
`2(d) for a likelihood of confusion with several registered marks.(cid:160) In addition, applicant was advised of a prior-filed application that could bar
`registration of applicant’s mark, and was required to amend the identification of goods .(cid:160)(cid:160)
`This Office action is in response to applicant’s communication filed on June 1, 2016, in which applicant argued against the Section 2(d) refusal
`and amended the identification of goods.(cid:160)(cid:160)
`Based on applicant’s response, the Section 2(d) refusal is hereby WITHDRAWN.(cid:160) Portions of applicant’s amendments to the identification of

`goods have been accepted and entered into the record, while some require additional clarification.(cid:160) Thus, the requirement to provide a definite
`identification of goods is hereby CONTINUED and MAINTAINED.(cid:160)(cid:160)
`Additionally, upon further review, certain wording in the identification of goods that the examining attorney did not address in the initial Office
`action require clarification.(cid:160) Therefore, this non-final Office action is being issued to address this new issue.(cid:160) A discussion of the wording from
`applicant’s response that requires further is also incorporated therein.

`indefinite and must be clarified because the terminology “or” is not sufficiently explicit language in identifications because it is not clear
`whether applicant is using the mark, or intends to use the mark, on all the identified goods.(cid:160) See TMEP §1402.03(a).(cid:160) Therefore, applicant should
`replace “or” with “and” in the identification of goods or services, if appropriate, or rewrite the identification with the “or” deleted and the
`goods or services specified using definite and unambiguous language.

`he wording “hand dryers” in the identification of Class 11 goods is indefinite and must be clarified because applicant must specify how the

`hand dryers are powered, such as “electric hand dryers.” (cid:160) See TMEP §1402.01.(cid:160)(cid:160)

`The wording “electric futons (bedding)” and “distillers (for chemical processing)” contains parentheses.(cid:160) Generally, applicants should not use
`parentheses in identifications in their applications so as to avoid confusion with the USPTO’s practice of using parentheses in registrations to
`indicate goods that have been deleted from registrations. (cid:160) See TMEP §1402.12. (cid:160) The only exception is that parenthetical information is permitted
`in identifications in an application if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such a way that
`it does not affect the clarity of the identification, e.g., “obi (Japanese sash).” (cid:160) Id.(cid:160) Therefore, applicant must remove the parentheses from the
`identification and incorporate any parenthetical or bracketed information into the description of the goods.
