`
`Applicant's mark has been refused registration under Section 2(e)(1) of the U.S. Trademark Act based on the Examining Attorney’s
`
`determination that the mark is "merely descriptive" of the goods.            
`
`Applicant submits that the subject mark is not merely descriptive and is registerable as a suggestive term.  As known by the Examining
`Attorney, “merely descriptive” terms are not registerable, but suggestive terms are registerable.   It is not prohibited that a mark have the
`capacity to draw attention to what the product or service is or what its characteristics are.  A term is suggestive if, when applied to the goods (or
`
`services), it required imagination, thought, and perception to reach a conclusion as to the nature of the goods.  
`
`Trademark Office Has The Burden Of Proof
`
`            
`
`The Trademark Office bears the burden of showing that a mark is merely descriptive of the identified goods or services.  See In re
`Merrill, Lynch, Pierce, Fenner, and Smith Inc., 828 F.2d 21567, 4 USPQ2nd 1141, 1143 (Fed. Cir. 1987).  Applicant submits that the
`Trademark Office has not met its burden.
`           
`A proper test for descriptiveness under Section 2(e)(1) is whether Applicant's mark immediately conveys to consumers the nature of the
`Applicant's goods, or whether consumers must use "imagination, thought, and perception" to draw that conclusion.  Stix Prods., Inc. v. United
`Merchants & Mfrs., Inc., 295 F. Supp. 479, 488 (S.D.N.Y. 1968).  To be characterized as "merely descriptive", a mark must "immediately
`convey to one seeing or hearing it the thought of appellant's services."  In re Bed & Breakfast Registry, 791 F.2d 157, 159 (Fed. Cir. 1986)
`(quoting In re American Society of Clinical Pathologists, Inc., 442 F.2d 1404, 1407 (C.C.P.A. 1971)).  Applicant submits that  “lanterna” does
`not immediately convey the nature of Applicant's goods.
`           
`Because the line between merely descriptive and only suggestive terms is "so nebulous," the Trademark Board takes the position that
`doubt is resolved in favor of the applicant on the assumption that competitors have the opportunity to oppose the registration once published and
`to present evidence that is usually not present in ex parte examination.  In re Conductive Systems, Inc.,  220 U.S.P.Q. 84  (T.T.A.B.
`1983)(doubts under § 2(e) about the merely descriptive nature of a term are resolved in favor of the applicant, unlike the situation in resolving §
`2(d) likely confusion disputes);  In re Aid Laboratories, Inc.,  221 U.S.P.Q. 1215   (T.T.A.B. 1983) (PEST PRUF for animal shampoo with
`insecticide held on the suggestive side of the line); In re Bel  Paese Sales Co., 1 U.S.P.Q.2d 1233 (T.T.A.B. 1986) (DOLCELATTE held not a
`generic name for a type of cheese); In re Merrill Lynch, Pierce, Fenner & Smith, Inc.,   828 F.2d 1567, 4  U.S.P.Q.2d 1141 (Fed. Cir.
`1987)(doubt on the sufficiency of secondary  meaning evidence should be resolved in favor of the applicant).

`Applicant’s Mark is Suggestive of the Goods
`           
`Applicant’s mark is the Italian word for lantern.   A lantern is a specific type of portable container for transporting light defined as “a
`light inside a container that has a handle for holding it or hanging it up, or the container itself.”   See Exhibit A.  While the term “lantern”
`suggests a portable container for light, it is not immediately descriptive of a feature or function of Applicant’s goods.     See In re Pennwalt
`Corporation, 173 USPQ 317, 318 (TTAB 1972) [holding mark DRI-FOOT for an anti-perspirant deodorant for feet registrable, as DRI-FOOT
`"is obviously not the usual or normal manner in which the purpose of an anti-perspirant and deodorant for the feet would be described"]. The
`term DRI-FOOT is highly suggestive of anti-perspirant deodorant for feet, but the registration of DRI-FOOT could not preclude the use by
`competitors of the ordinary descriptive phrase "keeps feet dry". (emphasis added)  Id.  Likewise, lantern is highly suggestive of lighting but
`competitors do not need to use the word lantern to describe Applicant’s goods.   The meaning of latern is no so direct, revealing or informative
`of Applicant’s goods as to be merely descriptive of them.   It takes some imagination to draw the conclusion that “lanterna” refers to
`Applicant’s goods.     "The fact that a mark is suggestive and that persons in the trade are capable of analyzing a mark and recognizing that
`suggestion, does not render the mark descriptive."  Audio Fidelity, Inc. v. London Records, Inc.,  332 F.2d 577 (1964).  For example, no
`reasonable consumer would immediately recognize lanterna to be descriptive of video display units or lamps for that matter.
`
`Conclusion:            
`
`In view of the foregoing, it is submitted that the Examining Attorney's objections have been overcome and that upon withdrawal of the
`Section 2(e)(1) “descriptiveness” refusal, this application is in condition for publication and subsequent registration.   Applicant respectfully
`requests withdrawal of the Section 2(e)(1) refusal.
