`In a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation and

`n this case, applicant’s mark JETSPIN CYCLONE and design is similar to the registered mark ROOT CYCLONE because the applicant’s
`mark is simply the registered mark with the word ROOT substituted in the registered mark for the word JETSPIN in the applicant’s mark. Both
`marks however contain the dominant element CYCLONE, with the words JETSPIN and ROOT simply modifying the word CYCLONE. As
`such, consumers recalling these marks would remember the dominant element CYCLONE, and therefore mistakenly believe that the marks
`originate from a common source.

`OMPARISON OF THE GOODS
`The goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160) See Safety-Kleen Corp. v.
`Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A. 1975); TMEP §1207.01(a)(i).(cid:160) Rather, it is sufficient that the goods
`and/or services are related in some manner and/or the conditions surrounding their marketing are such that they would be encountered by the
`same purchasers under circumstances that would give rise to the mistaken belief that the goods and/or services come from a common source.(cid:160) In

`n this case, the applicant’s (cid:160) goods are “vacuum cleaners” while the registrant’s goods are, “electrical apparatus for kitchen and laundry use,

`polishing machines, floor washing machines, floor scrubbing machines and carpet cleaning machines; vacuum cleaners, carpet shampooers and
`floor polishers; steam cleaners for floors and carpets; electric motors for use in vacuum cleaners, carpet shampooers, floor polishers, washing
`machines and dishwashers; separation apparatus for separating dust and debris from the airflow in vacuum cleaners; parts and fittings for all the
`aforesaid goods.” The applicant’s goods and the registrant’s goods both include an identical item, namely, vacuum cleaners. However, the
`registrant’s other goods are also used to clean and maintain floors and carpets, and are therefore also similar to vacuum cleaners in their purpose

`namely, clothes washing machines and dishwashers; apparatus for cleaning, polishing and shampooing floors and carpets, namely, floor
