`OMPARISON OF THE MARKS
`In a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation, and
`commercial impression.(cid:160) In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b)-
`(b)(v).(cid:160) Similarity in any one of these elements may be sufficient to find the marks confusingly similar.(cid:160) In re White Swan Ltd., 8 USPQ2d 1534,
`1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b).

`n the present case, applicant’s mark JETSPIN CYCLONE is similar to the registered mark SYCLONE in sound and appearance because of the
`common use of the word CYCLONE in both marks. Although SYCLONE is spelled differently in the registrant’s mark, it is the phonetic
`equivalent of the correct spelling of CYCLONE in the applicant’s mark, and therefore sounds the same when spoken. As such, the addition of
`the word JETSPIN to the applicant’s mark is not enough to lessen the likelihood of confusion in this case. CYCLONE (SYCLONE) is what
`consumers will recall when remembering both of the marks. As such, a likelihood of confusion exists in this case.

`
`OMPARISON OF THE GOODS
`The goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160) See Safety-Kleen Corp. v.
`Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A. 1975); TMEP §1207.01(a)(i).(cid:160) Rather, it is sufficient to show that
`because of the conditions surrounding their marketing, or because they are otherwise related in some manner, the goods and/or services would be
`encountered by the same consumers under circumstances such that offering the goods and/or services under confusingly similar marks would
`lead to the mistaken belief that they come from, or are in some way associated with, the same source.(cid:160) In re Iolo Techs., LLC, 95 USPQ2d 1498,
`1499 (TTAB 2010); see In re Martin’s Famous Pastry Shoppe, Inc. , 748 F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed. Cir. 1984); TMEP

`pplicant’s “machinery for building construction, restoration, mold remediation, and abatement of asbestos and lead paint, namely, air suction
`machines” is related to the registrant’s “vacuum cleaners” because both air suction machines and vacuum cleaners are machines that use air,
`and the process of(cid:160) drawing in or sucking air to clean. As such, the goods would be used by the same class of purchasers and encountered under
`circumstances leading one to mistakenly believe the goods originate from the same source.
`The trademark examining attorney has attached evidence from the USPTO’s X-Search database consisting of a number of third-party marks
`registered for use in connection with the same or similar goods and/or services as those of both applicant and registrant in this case.(cid:160) This
`evidence shows that the goods and/or services listed therein, namely “machinery for building construction, restoration, mold remediation, and
`abatement of asbestos and lead paint, namely, air suction machines” and “vacuum cleaners,” are of a kind that may emanate from a single
`source under a single mark.(cid:160) See In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1203 (TTAB 2009); In re Albert Trostel & Sons Co., 29 USPQ2d
