`
`SSUE/MAILING DATE: 10/17/2011
`
`(cid:160)T
`
`his office action is in response to the applicant’s correspondence of September 7, 2011. (cid:160)(cid:160)
`
`The disclaimer, mark description and amended identification are accepted.
`
`(cid:160)E
`
`arlier filed Application Serial No. 77822630 has matured to registration; thus, applicant must address the following issue(s).(cid:160) Upon further
`consideration, the applicant must also address the Section 2(d) refusals discussed below. The examining attorney regrets the delay in raising these
`issues.
`
`SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
`
`Registration of the applied-for mark is refused because of a likelihood of confusion with the mark(s) in U.S. Registration No(s). 4003022,
`3081095, 3081094.(cid:160) Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.(cid:160) See the enclosed registration(s).
`
`(cid:160)T
`
`he applicant applied to register the mark(cid:160) NEO PLASMA and design (PLASMA disclaimed) for “ Plasma televisions; LCD televisions; Video
`apparatus, namely slim television sets, digital video disc players, and digital video disc recorders, all equipped with a flat display.”
`
`(cid:160)T
`
`he registered marks are NEO TV (standard character mark; TV disclaimed) for consumer electronics, namely, hardware, namely, a combination
`receiver and player for in-home reception, display and playing of video, still images, photographs, graphics, audio, and text from a global
`computer network, a LAN local area network, a wireless communications network, a digital camera or from a digital storage device,(cid:160)(cid:160) and the
`marks NEO in standard character form and in special form for the following goods:(cid:160) TELEVISION, VIDEO AND AUDIO SIGNAL
`PROCESSING, SWITCHING AND GENERATING EQUIPMENT, NAMELY, FRAME SYNCHRONIZERS, AUDIO SYNCHRONIZERS,
`AUDIO DELAYS, AUDIO EMBEDDERS/DEEMBEDDERS, AUDIO PROCESSORS, LOGO GENERATORS AND INSERTERS,

`SWITCHERS AND SWITCHING ROUTERS, EQUIPMENT ENCLOSURES, REMOTE CONTROL PANELS, AND COMPUTER
`SOFTWARE FOR CONTROLLING AND MONITORING THE AFORESAID GOODS, ALL FOR INDUSTRIAL USE.
`
`(cid:160)T
`
`rademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely that a potential consumer
`would be confused or mistaken or deceived as to the source of the goods and/or services of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160)
`The court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be considered
`when determining whether there is a likelihood of confusion under Section 2(d).(cid:160) See TMEP §1207.01.(cid:160) However, not all the factors are
`necessarily relevant or of equal weight, and any one factor may be dominant in a given case, depending upon the evidence of record.(cid:160) Citigroup
`Inc. v. Capital City Bank Grp., Inc., 637 F.3d 1344, 1355, 98 USPQ2d 1253, 1260 (Fed. Cir. 2011); In re Majestic Distilling Co., 315 F.3d 1311,
`1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at 567.
`
`(cid:160)I
`
`n this case, the following factors are the most relevant:(cid:160) similarity of the marks, similarity of the goods and/or services, and similarity of trade
`channels of the goods and/or services.(cid:160) See In re Dakin’s Miniatures Inc. , 59 USPQ2d 1593 (TTAB 1999); TMEP §§1207.01 et seq.
`
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Similarities Between the Marks
`
`In a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation, and
`commercial impression.(cid:160) In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b)-
`(b)(v).(cid:160) Similarity in any one of these elements may be sufficient to find the marks confusingly similar.(cid:160) In re White Swan Ltd., 8 USPQ2d 1534,
`1535 (TTAB 1988); see In re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB 2007); TMEP §1207.01(b).
`
`(cid:160)T
`
`he parties’ marks create a similar commercial impression due to the common dominant wording NEO. (cid:160) Marks may be confusingly similar in
`appearance where there are similar terms or phrases or similar parts of terms or phrases appearing in both applicant’s and registrant’s mark.
`See Crocker Nat’l Bank v. Canadian Imperial Bank of Commerce , 228 USPQ 689 (TTAB 1986), aff’d sub nom. Canadian Imperial Bank of
`Commerce v. Wells Fargo Bank, Nat’l Ass’n , 811 F.2d 1490, 1 USPQ2d 1813 (Fed. Cir. 1987) (COMMCASH and COMMUNICASH); In re
`Phillips-Van Heusen Corp., 228 USPQ 949 (TTAB 1986) (21 CLUB and “21” CLUB (stylized)); In re Corning Glass Works, 229 USPQ 65
`(TTAB 1985) (CONFIRM and CONFIRMCELLS); In re Collegian Sportswear Inc., 224 USPQ 174 (TTAB 1984) (COLLEGIAN OF
`CALIFORNIA and COLLEGIENNE); In re Pellerin Milnor Corp., 221 USPQ 558 (TTAB 1983) (MILTRON and MILLTRONICS); In re
`BASF A.G., 189 USPQ 424 (TTAB 1975) (LUTEXAL and LUTEX); TMEP §1207.01(b)(ii)-(iii).
`
`(cid:160)T
`
`he marks are compared in their entireties under a Trademark Act Section 2(d) analysis.(cid:160) See TMEP §1207.01(b).(cid:160) Nevertheless, one feature of a
`mark may be recognized as more significant in creating a commercial impression; greater weight is given to that dominant feature in determining
`whether the marks are confusingly similar.(cid:160) See In re Nat’l Data Corp. , 753 F.2d 1056, 1058, 224 USPQ 749, 751 (Fed. Cir. 1985); In re J.M.
`Originals Inc., 6 USPQ2d 1393, 1394 (TTAB 1987); TMEP §1207.01(b)(viii), (c)(ii).(cid:160) The previously attached definition and Wikipedia article
`and the currently attached representative LEXIS articles demonstrate that PLASMA is the generic name for a type of television.(cid:160) The
`identification of goods in this case includes plasma televisions.(cid:160) Thus, the wording PLASMA is generic or descriptive wording when viewed in
`the context of the applicant’s televisions and television related products. (cid:160) As such, the wording PLASMA is less dominant than the wording
`NEO.(cid:160)(cid:160)(cid:160) Similarly, the wording TV has been disclaimed from the registered mark NEO TV.(cid:160) Disclaimed matter is typically less significant or less
`dominant when comparing marks.(cid:160) See In re Dixie Rests., Inc., 105 F.3d 1405, 1407, 41 USPQ2d 1531, 1533-34 (Fed. Cir. 1997); In re Nat’l
`Data Corp., 753 F.2d 1056, 1060, 224 USPQ 749, 752 (Fed. Cir. 1985); TMEP §1207.01(b)(viii), (c)(ii).
`
`(cid:160)W
`
`hen a mark consists of a word portion and a design portion, the word portion is more likely to be impressed upon a purchaser’s memory and
`to be used in calling for the goods and/or services; therefore, the word portion is normally accorded greater weight in determining whether marks
`are confusingly similar.(cid:160) In re Dakin’s Miniatures, Inc. , 59 USPQ2d 1593, 1596 (TTAB 1999); TMEP §1207.01(c)(ii); see CBS Inc. v. Morrow,
`708 F. 2d 1579, 1581-82, 218 USPQ 198, 200 (Fed. Cir 1983); In re Kysela Pere et Fils, Ltd., 98 USPQ2d 1261, 1267-68 (TTAB 2011).(cid:160) The
`design element in this mark is a stylized version of a television and thus suggests the applicant’s products which are television and television
`
`related products.(cid:160) Thus, the design element is less dominant in creating a commercial impression.(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Relatedness of the Goods and/or Services
`
`(cid:160)
`(cid:160)
`

`

`(cid:160)T
`
`he goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160) See Safety-Kleen Corp. v.
`Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A. 1975); TMEP §1207.01(a)(i).(cid:160) Rather, it is sufficient to show that
`because of the conditions surrounding their marketing, or because they are otherwise related in some manner, the goods and/or services would be
`encountered by the same consumers under circumstances such that offering the goods and/or services under confusingly similar marks would
`lead to the mistaken belief that they come from, or are in some way associated with, the same source.(cid:160) In re Iolo Techs., LLC, 95 USPQ2d 1498,
`1499 (TTAB 2010); see In re Martin’s Famous Pastry Shoppe, Inc. , 748 F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed. Cir. 1984); TMEP
`§1207.01(a)(i).
`
`(cid:160)T
`
`he parties’ goods are highly related electronic products which are commonly sold in the same channels of trade, such as electronics stores or
`the like.(cid:160) They parties’ goods may be used together for watching television or viewing videos or the like. (cid:160) Different goods in the electrical,
`electronic, and/or electromechanical fields have been found to be related where the evidence shows that the goods would be marketed through
`the same channels of trade and/or sold to the same classes of purchasers.(cid:160) See, e.g., Alliance Mfg. Co. v. ABH Diversified Prods., Inc., 226 USPQ
`348 (TTAB 1985) (finding cycling-type furnace controllers and various home products, including garage door openers and remote controls for
`operating lights and appliances, to be related, where both parties’ goods were electrically powered/electronically operated, had similar energy
`conserving characteristics, and were sold for residential use); In re Globe-Union Inc., 189 USPQ 158, 159 (TTAB 1975) (finding resistor-
`capacitor components and ceramic condensers to be related, where such goods “would be sold in the same trade channels to the same classes of
`purchasers such as original equipment manufacture[r]s for incorporation in the same piece of electronic equipment or apparatus”); In re Dynaco,
`Inc., 189 USPQ 104, 105 (TTAB 1975) (finding two-channel stereophonic amplifiers, loudspeakers, and non-electronic devices for connecting
`amplifiers and speakers, on the one hand, and switching transistors, on the other, to be related because the goods would be “invariably sold to the
`same class of purchasers in such circumstances and conditions that if persons were to encounter them under the same or similar marks, they
`might well be induced to believe that they originate from a common source”); Nat’l Steel Constr. Co. v. Matsushita Elec. Indus. Co. , 158 USPQ
`464 (TTAB 1968) (finding electric washing machines and electric water heaters to be related, where such goods were sold through the same
`channels of trade to the same class of purchaser, where the purchase of one of the party’s goods could lead to the purchase of the other party’s
`goods, and where the evidence of record indicated that a single manufacturer might produce both electric washing machines and electric water
`heaters); see also Ultra Elec., Inc. v. Workman Elec. Prods., Inc., 192 USPQ 497 (TTAB 1976); In re Int’l Components Corp. , 191 USPQ 653
`(TTAB 1976).
`
`(cid:160)T
`
`he trademark examining attorney has attached evidence from the USPTO’s X-Search database consisting of a number of third-party marks
`registered for use in connection with the same or similar goods and/or services as those of both applicant and registrant in this case.(cid:160) This
`evidence shows that the goods and/or services listed therein are of a kind that may emanate from a single source under a single mark.(cid:160) See In re
`Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1203 (TTAB 2009); In re Albert Trostel & Sons Co., 29 USPQ2d 1783, 1785-86 (TTAB 1993); In re
`Mucky Duck Mustard Co., 6 USPQ2d 1467, 1470 n.6 (TTAB 1988); TMEP §1207.01(d)(iii).
`
`(cid:160)A
`
`pplicant noted other third-party registrations for similar marks.(cid:160) Prior decisions and actions of other trademark examining attorneys in
`registering different marks have little evidentiary value and are not binding upon the Office.(cid:160) TMEP §1207.01(d)(vi).(cid:160) Each case is decided on its
`own facts, and each mark stands on its own merits.(cid:160) See AMF Inc. v. Am. Leisure Prods., Inc., 474 F.2d 1403, 1406, 177 USPQ 268, 269
`(C.C.P.A. 1973); In re Int’l Taste, Inc. , 53 USPQ2d 1604, 1606 (TTAB 2000); In re Sunmarks, Inc., 32 USPQ2d 1470, 1472 (TTAB 1994).(cid:160)
`Also, please note that the mere submission of a list of registrations or a copy of a private company search report does not make such registrations
`part of the record.(cid:160) In re Promo Ink, 78 USPQ2d 1301, 1304 (TTAB 2006); TBMP §1208.02; TMEP §710.03.(cid:160) To make third-party registrations
`part of the record, an applicant must submit copies of the actual registrations or printouts of the registrations from the USPTO’s database. (cid:160) In re
`Ruffin Gaming LLC, 66 USPQ2d 1924, 1925 n.3 (TTAB 2002); In re Carolina Apparel, 48 USPQ2d 1542, 1543 n.2 (TTAB 1998); TBMP
`§1208.02; TMEP §710.03.
`
`(cid:160)A
`
`lthough applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in
`support of registration.
`
`Questions
`If applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney.(cid:160) All relevant e-
`mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to
