`OFFICE ACTION
`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE
`RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 3/17/2011
`
`The referenced application has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant must respond timely and completely to
`the issue(s) below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
`
`THE FOLLOWING REFUSAL APPLIES TO THE GOODS IN CLASSES 9, 11, AND 12.
`
`(cid:160)R
`
`egistration of the applied-for mark is refused because of a likelihood of confusion with the mark(s) in U.S. Registration No(s). 1689926.(cid:160)
`Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.(cid:160) See the enclosed registration(s).
`
`(cid:160)T
`
`he cited registration is a stylized mark consisting of a series of three instances of the word PANASONIC over black and white boxes for dry
`
`batteries.(cid:160)(cid:160)
`
`The applicant applied to register the mark PANASONIC for the following:
`
`Class 9:(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`3D television apparatus; fuel cells; batteries, namely NI-CD batteries and solar batteries; PLC (power line communication)
`adapters; distribution panels having facility of conversion of direct current/alternating current
`Class 11:(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) LED lamps; natural refrigerant CO2 heat pump water heaters; refrigerating display showcases; freezing display showcases
`Class 12:(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) Traction engines; AC motors or DC motors for land vehicles, not including their parts; automobiles and their parts and fittings;
`two-wheeled motor vehicles, bicycles and their parts and fittings; baby carriages (prams); wheelbarrows; electric cars, parts and
`fittings thereof; golf carts; motors for electric bicycles; units for electric bicycles, comprising motors, rechargeable batteries and
`control devices thereof; motors for electric cars; units for electric cars, comprising motors, batteries and/or cells including but not
`limited to fuel cells, and control devices thereof .
`
`(cid:160)T
`
`rademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely that a potential consumer
`would be confused or mistaken or deceived as to the source of the goods and/or services of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160)
`The court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be considered
`when determining whether there is a likelihood of confusion under Section 2(d).(cid:160) See TMEP §1207.01.(cid:160) However, not all of the factors are
`necessarily relevant or of equal weight, and any one factor may be dominant in a given case, depending upon the evidence of record.(cid:160) In re
`Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at
`567.
`
`(cid:160)I
`
`n this case, the following factors are the most relevant:(cid:160) similarity of the marks, similarity of the goods and/or services, and similarity of trade
`channels of the goods and/or services.(cid:160) See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc. , 59 USPQ2d
`1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.

`
`Similarities Between the Marks
`
`(cid:160)I
`
`n a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation and
`commercial impression.(cid:160) In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b).(cid:160)
`Similarity in any one of these elements may be sufficient to find a likelihood of confusion.(cid:160) In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB
`1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP §1207.01(b).
`
`(cid:160)T
`
`he parties’ marks are similar in sound as they both consist of the word PANASONIC and are similar in appearance, because the wording
`PANASONIC is displayed in the same font and stylization in both marks.(cid:160) Marks may be confusingly similar in appearance where there are
`similar terms or phrases or similar parts of terms or phrases appearing in both applicant’s and registrant’s mark.
`(cid:160) See Crocker Nat’l Bank v.
`Canadian Imperial Bank of Commerce, 228 USPQ 689 (TTAB 1986), aff’d sub nom. Canadian Imperial Bank of Commerce v. Wells Fargo
`Bank, Nat’l Ass’n , 811 F.2d 1490, 1 USPQ2d 1813 (Fed. Cir. 1987) (COMMCASH and COMMUNICASH); In re Phillips-Van Heusen Corp.,
`228 USPQ 949 (TTAB 1986) (21 CLUB and “21” CLUB (stylized)); In re Corning Glass Works, 229 USPQ 65 (TTAB 1985) (CONFIRM and
`CONFIRMCELLS); In re Collegian Sportswear Inc., 224 USPQ 174 (TTAB 1984) (COLLEGIAN OF CALIFORNIA and COLLEGIENNE);
`In re Pellerin Milnor Corp., 221 USPQ 558 (TTAB 1983) (MILTRON and MILLTRONICS); In re BASF A.G., 189 USPQ 424 (TTAB 1975)
`(LUTEXAL and LUTEX); TMEP §1207.01(b)(ii)-(iii).
`
`(cid:160)W
`
`hen a mark consists of a word portion and a design portion, the word portion is more likely to be impressed upon a purchaser’s memory and
`to be used in calling for the goods and/or services.(cid:160) Therefore, the word portion is normally accorded greater weight in determining likelihood of
`confusion.(cid:160) In re Dakin’s Miniatures, Inc. , 59 USPQ2d 1593, 1596 (TTAB 1999); In re Appetito Provisions Co., 3 USPQ2d 1553, 1554 (TTAB
`1987); Amoco Oil Co. v. Amerco, Inc., 192 USPQ 729, 735 (TTAB 1976); TMEP §1207.01(c)(ii).(cid:160) Thus, the design element of the stylized mark
`does not serve to distinguish the marks due to the similar wording of the marks.
`
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`Similarities Between the Goods(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`The goods and/or services of the parties need not be identical or directly competitive to find a likelihood of confusion.(cid:160) See Safety-Kleen Corp. v.
`Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A. 1975); TMEP §1207.01(a)(i).(cid:160) Rather, it is sufficient that the goods
`and/or services are related in some manner and/or the conditions surrounding their marketing are such that they would be encountered by the
`same purchasers under circumstances that would give rise to the mistaken belief that the goods and/or services come from a common source.(cid:160) In
`re Total Quality Group, Inc., 51 USPQ2d 1474, 1476 (TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc.,
`229 F.3d 1080, 1086-87, 56 USPQ2d 1471, 1475-76 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc. , 748 F.2d 1565, 1566-68, 223
`USPQ 1289, 1290 (Fed. Cir. 1984).(cid:160) The parties’ goods both include batteries, which are commonly sold together. (cid:160) The parties’ goods are
`
`complementary in nature or are commonly provided by the same source as demonstrated by the attached representative third-party registrations.(cid:160)(cid:160)
`
`Attached are copies of printouts from the USPTO X-Search database, which show third-party registrations of marks used in connection with the
`same or similar goods and/or services as those of applicant and registrant in this case.(cid:160) These printouts have probative value to the extent that
`they serve to suggest that the goods and/or services listed therein are of a kind that may emanate from a single source.(cid:160) In re Infinity Broad.
`Corp. of Dallas, 60 USPQ2d 1214, 1217-18 (TTAB 2001); In re Albert Trostel & Sons Co., 29 USPQ2d 1783, 1785-86 (TTAB 1993); In re
`Mucky Duck Mustard Co., 6 USPQ2d 1467, 1470 n.6 (TTAB 1988); TMEP §1207.01(d)(iii).
`
`(cid:160)I
`
`n a likelihood of confusion analysis, the comparison of the parties’ goods and/or services is based on the goods and/or services as they are
`identified in the application and registration, without limitations or restrictions that are not reflected therein.(cid:160) Hewlett-Packard Co. v. Packard
`Press Inc., 281 F.3d 1261, 1267-68, 62 USPQ2d 1001, 1004-05 (Fed. Cir. 2002); In re Dakin’s Miniatures, Inc. , 59 USPQ2d 1593, 1595 (TTAB
`1999); see TMEP §1207.01(a)(iii).(cid:160) In this case, applicant’s goods and/or services are identified broadly. (cid:160) Therefore, it is presumed that the
`application encompasses all goods and/or services of the type described, including those in the registrant’s more specific identification, that the
`goods and/or services move in all normal channels of trade, and that they are available to all potential customers.(cid:160) See In re La Peregrina Ltd., 86
`USPQ2d 1645, 1646 (TTAB 2008); In re Jump Designs LLC, 80 USPQ2d 1370, 1374 (TTAB 2006); TMEP §1207.01(a)(iii).(cid:160) For example,
`applicant’s broadly identified parts and fittings may include batteries or the like for use in connection with vehicles.
`
`(cid:160)A
`
`lthough applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in
`support of registration.
`
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`Potential Ownership of Cited Registration By Applicant
`
`(cid:160)I
`
`f the mark in the cited registration has been assigned to applicant, applicant can provide evidence of ownership of the mark by satisfying one of
`the following:
`
`(1)(cid:160) Record the assignment with the Office’s Assignment Services Branch (ownership transfer documents such as assignments can be
`filed online at http://etas.uspto.gov) and promptly notify the trademark examining attorney that the assignment has been duly recorded;
`
`(cid:160)
`(cid:160)
`

`

`(2)(cid:160) Submit copies of documents evidencing the chain of title; or
`
`(3)(cid:160) Submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:(cid:160) “Applicant is the owner of
`
`U.S. Registration No. 1689926.”(cid:160)(cid:160)
`
`TMEP §812.01; see 15 U.S.C. §1060; 37 C.F.R. §§2.193(e)(1), 3.25, 3.73; TMEP §502.02(a).
`
`(cid:160)M
`
`erely recording a document with the Assignment Services Branch does not constitute a response to an Office action.(cid:160) TMEP §503.01(d).
`
`(cid:160)C
`
`laim of Ownership
`Trademark Rule 2.36, 37 C.F.R. §2.36, states that prior registrations of the same or similar marks owned by the applicant should be identified in
`the application. However, if the applicant owns numerous prior registrations, such as in the present case, it is not necessary to list them all. The
`applicant should specifically identify the two or three registration numbers that are most relevant (due to the similarity of the marks and/or
`relatedness of the goods or services), and then indicate that it owns other registrations as well, e.g., “the applicant is the owner of Reg. Nos.
`<specify the numbers> and others.” (cid:160) TMEP §812.(cid:160) In this case, the applicant may adopt the following ownership claim, if accurate:(cid:160) Applicant is
`the owner of U.S. Registration Nos. 3425266, 3397300, and others.
`
`(cid:160)I
`
`dentification and Classification of Goods
`The following wording in the identification of goods is unacceptable as indefinite and requires clarification:(cid:160) 3D television apparatus, NI-CD
`batteries, distribution panels having facility of conversion of direct current/alternating current; Traction engines; AC motors or DC motors for
`land vehicles, not including their parts; each instance of “parts and fittings”; golf carts; units for electric cars, comprising motors, batteries
`and/or cells including but not limited to fuel cells, and control devices thereof.(cid:160) In the identification of goods, applicant must use the common
`commercial or generic names for the goods, be as complete and specific as possible, and avoid the use of indefinite words and phrases.(cid:160) If
`applicant uses indefinite words such as “accessories,” “components,” “devices,” “equipment,” “materials,” “parts,” “systems” or
`“products,” such words must be followed by “namely,” followed by a list of the specific goods identified by their common commercial or
`generic names.(cid:160) See TMEP §§1402.01, 1402.03(a).(cid:160) The wording parts and fittings and golf carts may also identify goods in more than one
`class.(cid:160)(cid:160) While “parts” is generally unacceptable, the wording “structural parts therefor” is acceptable after the name of a specific type of motor
`vehicle, as indicated in the suggested wording below.
`
`(cid:160)A
`
`n application must specify, in an explicit manner, the particular goods or services on or in connection with which the applicant uses, or has a
`bona fide intention to use, the mark in commerce.(cid:160) See 15 U.S.C. §1051(a)(2), (b)(2); 37 C.F.R. §2.32(a)(6); TMEP §1402.01.(cid:160) Generally, the
`terminology “and/or” and “or” is not sufficiently explicit language in identifications because it is not clear whether applicant is using the mark,
`or intends to use the mark, on all the identified goods or services.(cid:160) See TMEP §1402.03(a).(cid:160) Therefore, applicant should replace “and/or” with
`“and” in the identification of goods or services, if appropriate, or rewrite the identification with the “and/or” deleted and the goods or services
`specified using definite and unambiguous language.(cid:160) Similarly, wording such as “including but not limited to” is overly broad and must be
`deleted and replaced with the common name of the goods.
`
`(cid:160)T
`
`he applicant may adopt the following, if accurate, specifying information where indicated:
`
`Class 9:(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)

`
`3D televisions; fuel cells; batteries, namely nickel-cadmium (NI-CD) batteries and solar batteries; PLC (power line
`communication) adapters; power distribution panels (please clarify “having facility of conversion of direct current/alternating
`current”)
`LED lamps; natural refrigerant CO2 heat pump water heaters; refrigerating display showcases; freezing display showcases
`traction engines being locomotives; AC motors and DC motors for land vehicles, not including their parts; automobiles and
`structural parts therefor; two-wheeled motor vehicles, bicycles and their structural parts; baby carriages (prams); wheelbarrows;
`electric cars and structural parts thereof; motorized golf carts; motors for electric bicycles; units for electric bicycles, comprising
`motors, rechargeable batteries and control devices thereof; motors for electric cars; units for electric cars, comprising motors,
`batteries, fuel cells, and control devices thereof
`non-motorized golf carts
`warehouse storage of goods; transport brokerage services
`
`(cid:160)I
`
`f applicant adopts the suggested amendment of the identification of goods and/or services, then applicant must amend the classification to
`International Classes 9, 11, 12, 28, 39.(cid:160) See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§805, 1401.
`
`(cid:160)A
`
`n applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the
`scope of the goods and/or services is not permitted.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.

`
`or assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of
`Acceptable Identifications of Goods and Services at http://tess2.uspto.gov/netahtml/tidm.html.(cid:160) See TMEP §1402.04.
`
`(cid:160)F
`
`or an application with more than one international class, called a “multiple-class application,” an applicant must meet all of the requirements
`
`(cid:160)
`(cid:160)
`

`

`below for those international classes based on an intent to use the mark in commerce under Trademark Act Section 1(b):
`

`
`LIST GOODS AND/OR SERVICES BY INTERNATIONAL CLASS:(cid:160) Applicant must list the goods and/or services by international
`class; and
`
`PROVIDE FEES FOR ALL INTERNATIONAL CLASSES:(cid:160) Applicant must submit an application filing fee for each international
`class of goods and/or services not covered by the fee(s) already paid (confirm current fee information at http://www.uspto.gov, click
`on “View Fee Schedule” under the column titled “Trademarks”).
