`The determination of whether a mark is merely descriptive is made in relation to an applicant’s goods and/or services, not in the abstract. (cid:160) In re
`The Chamber of Commerce of the U.S., 675 F.3d 1297, 1300, 102 USPQ2d 1217, 1219 (Fed. Cir. 2012); In re Bayer Aktiengesellschaft, 488 F.3d

`n this case, the applicant seeks to register “ eHELP" for use on a “feature of a television remote control which enables the user to display an

`electronic version of the television's owner manual from supporting information stored in the television's built-in memory.” (cid:160)(cid:160)
`
`According to the attached evidence, the letter “e” used as a prefix has become commonly recognized as a designation for goods and/or services
`that are electronic in nature or are sold or provided electronically.(cid:160) Specifically, the evidence consists of multiple dictionary definitions which
`show that the prefix means “electronic” and is used in connection with goods and services that are provided in electronic form, usually in
`association with the Internet.

`hen a mark consists of the “e” prefix coupled with a descriptive word or term for electronic goods and/or services, then the entire mark may
`be considered merely descriptive under Trademark Act Section 2(e)(1).(cid:160) See In re SPX Corp., 63 USPQ2d 1592 (TTAB 2002) (holding E-

`shopping via a global computer network and of electronic retailing services); TMEP §1209.03(d).

`n this case, the applicant combines the prefix “e-“ with the descriptive term “HELP” for use on a television remote control feature that provides
`the users with electronic help in the form of an electronic user’s manual.
`
`(cid:160)T
`
`he applicant argues that there is no evidence of others using the term “ ehelp” descriptively. (cid:160) This statement is untrue.(cid:160) The examining
`attorney attached representative examples of third party usage of “ ehelp” to the first Office action, which shows usage of the descriptive term in
`commection with a variety of electronically provided assistance services.
`
`(cid:160)T
`
`he applicant’s argument that third parties have registered “ ehelp” for other goods and services, is noted, but is not persuasive. (cid:160) Unlike the
`applicant’s case, in which the goods are a feature which provides help, the two registrations referred to by the applicant are not for such use.
`Ratherr, in Reg. No. 3788638, for the mark EHELP, the services are online encyclopedias, and in Reg. No. 3377716, the mark EHELPS and
`design is registered for use in connection with legal consulting services in the medical field.(cid:160)(cid:160) Both of these situations are readily distinguishable
`from the applicant’s case, in which the remote control feature is intended to provide electronic help, so that a user does not have to resort to the
`printed instruction manual.(cid:160) In fact, as set forth in the attached printouts from the applicant’s web site, the help button on the remote
`
`control is pressed to access the “ eHELP" feature.(cid:160)(cid:160)
`
`The applicant’s notes that even if the components of a mark are descriptive, it does not follow that the composite mark is descriptive, stating
`that the critical test is whether the mark in its entirety is descriptive to prospective purchasers.(cid:160) While the examining attorney agrees with this
`statement of the law, the applicant’s application of the law to its particular case is flawed. (cid:160) The evidence attached to the first Office action
`clearly shows that “EHELP” is used in connection with a variety of electronically provided assistance services. (cid:160) This evidence shows that the
`combination of descriptive terms would be readily understood by the general public to refer to help that is provided electronically.(cid:160) Therefore,
`
`when viewed in relation to the applicant’s remote control feature, the descriptive meaning of the mark is clear. (cid:160)(cid:160)
`
`For the reasons set forth above, the Section 2(e)(1) refusal to register is maintained and made FINAL.
`
`Proper Response to a Final Refusal
`If applicant does not respond within six months of the date of issuance of this final Office action, the application will be abandoned.(cid:160) 15 U.S.C.

`Well generally with stand—alone DVD recorders, you must do it from the remote. So
`first of all, prepare whatever you wish to record by running it into the input on the
`back of the unit. Obviously you'll want the output to run to the TV so you can see
`what you're doing. From there, depending on the recorder, there's either a record
`button on the remote, or you have to select record from the menu. Either way, you
`begin the recording, and once you're at the end, you just press stop on the remote.
`Once that's done, it may ask you if you want to Finalize. If it does, hit yes. If it
`doesn't, open the menu and try to find the option to finalize the DVD. It must be
`finalized if you want to be able to play it.
