`
`OFFICE ACTION
`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO
`MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS
`OF THE ISSUE/MAILING DATE BELOW.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 4/23/2013
`
`The referenced application has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant
`must respond timely and completely to the issues below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a);
`TMEP §§711, 718.03.
`
`(cid:160)S
`
`earch Results
`The Office records have been searched and there are no similar registered or pending marks that would bar
`
`(cid:160)
`(cid:160)
`

`
`registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
`
`(cid:160)S
`
`ummary of Issues That Applicant Must Address
`
`Disclaimer of Descriptive Wording
`Identification of Goods
`
`(cid:160)D
`
`isclaimer of Descriptive Wording
`Applicant must disclaim the descriptive wording “PET” apart from the mark as shown because it merely
`describes an ingredient, quality, characteristic, function, feature, purpose or use of applicant’s goods.(cid:160) See
`15 U.S.C. §§1052(e)(1), 1056(a); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421
`(Fed. Cir. 2005); In re Gyulay, 820 F.2d 1216, 1217-18, 3 USPQ2d 1009, 1010 (Fed. Cir. 1987); TMEP
`
`§§1213, 1213.03(a).(cid:160)(cid:160)
`
`Specifically, the attached evidence from The American Heritage Dictionary shows this wording is defined
`as “An animal kept for amusement or companionship.” Applicant will provide vacuums and vacuum
`accessories that include specialized features for dealing with pet hair or other pet waste.(cid:160) Therefore, the
`wording merely describes a feature of applicant’s goods.
`
`(cid:160)T
`
`he Office can require an applicant to disclaim an unregistrable part of a mark consisting of particular
`wording, symbols, numbers, design elements or combinations thereof.(cid:160) 15 U.S.C. §1056(a).(cid:160) Under
`Trademark Act Section 2(e), the Office can refuse registration of an entire mark if the entire mark is
`merely descriptive, deceptively misdescriptive, or primarily geographically descriptive of the goods.(cid:160) 15
`U.S.C. §1052(e).(cid:160) Thus, the Office may require an applicant to disclaim a portion of a mark that, when
`used in connection with the goods or services, is merely descriptive, deceptively misdescriptive, primarily
`
`geographically descriptive, or otherwise unregistrable (e.g., generic).(cid:160) See TMEP §§1213, 1213.03.(cid:160)(cid:160)
`
`The following is the standard format used by the Office:
`
`No claim is made to the exclusive right to use “PET” apart from the mark as shown.
`
`(cid:160)T
`
`MEP §1213.08(a)(i); see In re Owatonna Tool Co., 231 USPQ 493 (Comm’r Pats. 1983).
`
`(cid:160)F
`
`ailure to comply with a disclaimer requirement can result in a refusal to register the entire mark.(cid:160) TMEP
`§1213.01(b).
`
`(cid:160)I
`
`dentification of Goods
`The identification of goods is indefinite and must be clarified because the term “accessories” is not
`sufficiently specific.(cid:160) See TMEP §1402.01.(cid:160) Applicant may adopt the following identification, if accurate:
`
`Class 7: Vacuum cleaners and vacuum accessories, namely, [indicate specific accessories, e.g.
`hoses, bags].
`
`Identifications of goods can be amended only to clarify or limit the goods; adding to or broadening the
`scope of the goods is not permitted.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.(cid:160)
`Therefore, applicant may not amend the identification to include goods that are not within the scope of the
`goods set forth in the present identification.
