`because it is a photograph of what appears to be a mock setting for the Applicant’s products. (cid:160)(cid:160) However,
`while the mark CONNECTING THE BUSINESS AND PLEASURE OF FLYING appears in the
`photograph, it is not clear that it appears of any of the hardware of software programs or on any of the
`electrical power devices or interactive multimedia computer programs described in the identification of
`goods for Class 9. Therefore, the use of the slogan on the side of the wall would not be considered to be
`use of the mark on or in connection with the goods in Class 9.(cid:160) The other material submitted with the
`application consists of advertising material, which would not be considered to be acceptable specimens for
`goods in trade.

`xamples of specimens normally acceptable for goods are tags, labels, instruction manuals, containers,
`photographs that show the mark on the actual goods or packaging, or displays associated with the actual
`goods at their point of sale.(cid:160) See TMEP §§904.03 et seq.(cid:160) Webpages are also acceptable specimens for
`goods when they include a picture or textual description of the goods associated with the mark and the
