`
`The referenced application has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant
`must respond timely and completely to the issue(s) below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a),
`2.65(a); TMEP §§711, 718.03.

`(cid:160)(cid:160)
`(cid:160)
`
`
`2.
`
`3.
`
`Specimens for Class 9 are unacceptable because they do not show use of the mark on or in
`connection with the goods in Class 9
`Instructions for submitting declaration to support use of substitute specimen as of a date at
`least as early as the filing of the application

`
`earch Results – No Conflicting Marks Found
`
`The trademark examining attorney has searched the Office’s database of registered and pending marks
`and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).(cid:160) TMEP
`§704.02; see 15 U.S.C. §1052(d).
`
`(cid:160)I
`
`dentification of Services for Class 35
`
`(cid:160)T
`
`he wording “distributorship services in the field of multimedia” in the identification of services is
`indefinite and must be clarified because the word “multimedia” is unacceptable as indefinite. Applicant
`must clarify this wording to describe the specific types of products that are intended to be included by the
`term “multimedia” and the trade channels for these services.(cid:160) See TMEP §1402.01.(cid:160) Applicant may adopt
`the following formant in amending this wording, if accurate:(cid:160) Distributorship services in the field of
`multimedia
`_______________ [describe
`the
`specific
`types
`of
`“multimedia”
`products]
`for
`_______________ [describe the channels of trade]
`
`(cid:160)A
`
`n applicant may amend an identification of services only to clarify or limit the services; adding to or
`broadening the scope of the services is not permitted.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.,
`1402.07 et seq.
`
`(cid:160)F

`or assistance with identifying and classifying goods and services in trademark applications, please see
`the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual at
`
`http://tess2.uspto.gov/netahtml/tidm.html. (cid:160) See TMEP §1402.04.(cid:160)(cid:160)
`
`Specimen for Goods in Class 9
`
`(cid:160)T
`
`he specimen for the goods in Class 9 is not acceptable because it does not show the applied-for mark in
`use in commerce.(cid:160) Specifically, the specimen is not acceptable as evidence of actual use in commerce
`because it is a photograph of what appears to be a mock setting for the Applicant’s products. (cid:160)(cid:160) However,
`while the mark CONNECTING THE BUSINESS AND PLEASURE OF FLYING appears in the
`photograph, it is not clear that it appears of any of the hardware of software programs or on any of the
`electrical power devices or interactive multimedia computer programs described in the identification of
`goods for Class 9. Therefore, the use of the slogan on the side of the wall would not be considered to be
`use of the mark on or in connection with the goods in Class 9.(cid:160) The other material submitted with the
`application consists of advertising material, which would not be considered to be acceptable specimens for
`goods in trade.
`
`(cid:160)E
`
`xamples of specimens normally acceptable for goods are tags, labels, instruction manuals, containers,
`photographs that show the mark on the actual goods or packaging, or displays associated with the actual
`goods at their point of sale.(cid:160) See TMEP §§904.03 et seq.(cid:160) Webpages are also acceptable specimens for
`goods when they include a picture or textual description of the goods associated with the mark and the
`means to order the goods.(cid:160) TMEP §904.03(i).(cid:160) However, leaflets, handbills, advertising circulars, and
`other advertising materials generally are not acceptable specimens for goods.(cid:160) See TMEP §§904.03 et seq.(cid:160)
`A screenshot of the computer software bearing the mark CONNECTING THE BUSINESS AND
`
`(cid:160)
`
`
`PLEASURE OF FLYING that was in use in commerce as of the filing date of the application would also
`be considered to be an acceptable specimen for the goods in Class 9.
`
`(cid:160)A
`
`n application based on Trademark Act Section 1(a) must include a specimen showing the applied-for
`mark in use in commerce for each international class of goods identified in the application or amendment
`to allege use.(cid:160) Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv),
`2.56(a); TMEP §§904, 904.07(a).(cid:160) Therefore, applicant must satisfy one of the following, as appropriate:
`
`(1)(cid:160) Submit a different specimen (a verified “substitute” specimen ) that (a) was in actual use in
`commerce at least as early as the filing date of the application or prior to the filing of an
`amendment to allege use) and (b) shows the mark in actual use in commerce for the goods
`
`identified in the application or amendment to allege use.(cid:160)(cid:160)
`
`(2)(cid:160) Amend the filing basis to intent to use under Section 1(b).(cid:160) This option will later necessitate
`additional fee(s) and filing requirements.
`
`(cid:160)P
`
`ending receipt of a proper response, registration is refused because the specimen does not show the
`applied-for mark in use in commerce as a trademark.(cid:160) Trademark Act Sections 1 and 45, 15 U.S.C.
`§§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).

`
`nstructions for Submitting Declaration to Support Use of Substitute Specimen
