`OFFICE ACTION
`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S
`COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 1/31/2014
`
`(cid:160)T
`
`he referenced application has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant must respond timely and completely to
`the issues below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`(cid:160)N
`
`O LIKELIHOOD OF CONFUSION FOUND
`
`(cid:160)
`

`

`The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that
`would bar registration under Trademark Act Section 2(d).(cid:160) TMEP §704.02; see 15 U.S.C. §1052(d).
`
`(cid:160)D
`
`ISCLAIMER
`
`(cid:160)A
`
`pplicant must disclaim the descriptive wording “240” and “BACK LIGHT BLINKING” apart from the mark as shown because it merely
`describes a characteristic, function or feature of applicant’s goods. (cid:160) See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro
`Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171,
`1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421 (Fed. Cir. 2005); TMEP
`
`§§1213, 1213.03(a).(cid:160)(cid:160)
`
`Specifically, “BACK LIGHT” refers to the light source behind an LCD panel of a television. (cid:160) See attached evidence from Geek.com.(cid:160) In order
`to reduce image retention problems inherent in LCD televisions (a problem not present in plasma televisions, which applicant Panasonic has
`been a leader in, but has recently announced they will be ceasing production of), applicant’s television turns the backlight of the screen on and
`off in rapid-succession, up to 240 times per second, so that the retained image is not seen by the viewer, this reducing motion judder and blur
`inherent in LCD television sets.(cid:160) See attached evidence from HDTVTest.co.uk, as well as WIlcoxFurniture.com.
`
`(cid:160)B
`
`ecause applicant’s televisions incorporate a feature in which the back light turns on and off up to 240 times per second in order to reduce image
`retention, the wording “240” and “BACK LIGHT BLINKING” are merely descriptive of a feature of applicant’s goods.
`
`(cid:160)A
`
` “disclaimer” is a statement in the application record that applicant does not claim exclusive rights to an unregistrable component of a mark; a
`disclaimer of unregistrable matter does not affect the appearance of the mark or physically remove disclaimed matter from the mark.(cid:160) See
`Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213.(cid:160) An unregistrable component of a
`mark includes wording and designs that are merely descriptive or generic of an applicant’s goods. (cid:160) 15 U.S.C. §1052(e); see TMEP §§1209.03(f),
`1213.03 et seq.(cid:160) Such words need to be freely available for other businesses to market comparable goods or services and should not become the
`proprietary domain of any one party.(cid:160) See Dena Corp. v. Belvedere Int’l, Inc. , 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In
`re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983).
`
`(cid:160)I
`
`f applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark.(cid:160) See In re Stereotaxis Inc., 429 F.3d
`1039, 1041, 77 USPQ2d 1087, 1089 (Fed. Cir. 2005); TMEP §1213.01(b).
`
`(cid:160)A
`
`pplicant may submit the following standardized format for a disclaimer:
`
`No claim is made to the exclusive right to use “240” and “BACK LIGHT BLINKING” apart from the mark as shown.
`
`(cid:160)T
`
`MEP §1213.08(a)(i); see In re Owatonna Tool Co., 231 USPQ 493 (Comm’r Pats. 1983).
`
`(cid:160)I
`
`DENTIFICATION OF GOODS
`
`A)(cid:160)(cid:160)(cid:160) COMPONENT FEATURE
`
`(cid:160)T
`
`he mark appears to identify a component feature of the finished product rather than the finished product itself.(cid:160) If so, then applicant must
`rewrite the identification of goods to identify the component feature by its purpose or function and to describe it as “sold as an integral
`component of television sets,” naming the finished product. (cid:160) The proper international class is that of the final product.(cid:160) TMEP §1402.05(a).
`
`B)(cid:160)(cid:160)(cid:160) DECEPTIVENESS INQUIRY/ADVISORY
`
`(cid:160)I
`
`n addition, the use or intended use of the applied-for mark on goods that do not in fact have or exhibit 240hz blinking and/or image refresh rates
`will be deceptive.(cid:160) See TMEP §1203.02-.02(b).(cid:160) To avoid a deceptiveness refusal, applicant must amend the identification to indicate that the
`goods possess this relevant feature or characteristic.(cid:160) See TMEP §§1203.02(e)(ii), (f)(i), 1402.05 et seq.(cid:160) Merely amending the identification to
`exclude goods with the named feature or characteristic will not avoid a deceptiveness refusal.(cid:160) TMEP §1203.02(f)(i).
`
`(cid:160)A
`
`pplicant may amend the identification of goods to the following, if accurate:
`
`(cid:160)I
`
`nternational Class 9 – “A feature of a television set in which the light source and refresh rate of the display panel combines with blinking of the
`television’s light source so that up to 240 different images are displayed within a second, reducing perceived motion blur and judder to the
`viewer.”
`
`(cid:160)A
`
`n applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not
`permitted.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.(cid:160)
`

`
`or assistance with identifying and classifying goods in trademark applications, please see the USPTO’s online searchable U.S. Acceptable
`Identification of Goods and Services Manual at http://tess2.uspto.gov/netahtml/tidm.html. (cid:160) See TMEP §1402.04.
`
`(cid:160)M
`
`ARK DESCRIPTION – REFERENCES BLACK
`
`(cid:160)T
`
`he description of the mark is inaccurate because is states that “240blb” appears below “BACK LIGHT BLINKING,” when it actually appears
`above it.(cid:160) Applications for marks not in standard characters must include an accurate and concise description of the entire mark that identifies
`
`literal elements as well as any design elements.(cid:160) See 37 C.F.R. §2.37; TMEP §§808.02, 808.03(d).(cid:160)(cid:160)
`
`In addition, although applicant does not include a color claim, the mark description mentions the color black.(cid:160) Accordingly, it is unclear whether
`black is intended to be a feature of the mark.(cid:160) Color claims and mark descriptions must be complete and reference all the colors in the mark.(cid:160) See
`37 C.F.R. §§2.37, 2.52(b)(1); TMEP §§807.07(a) et seq.(cid:160) Therefore, applicant must clarify whether black and white are being claimed as color
`and/or are intended to indicate background, outlining, shading and/or transparent areas.(cid:160) TMEP §807.07(d).
`
`(cid:160)T
`
`o clarify whether black and white are being claimed as color, applicant must satisfy one of the following:
`
`(1)(cid:160) If black or white are being claimed as colors in the mark, applicant must amend the color claim to include these colors, and
`amend the mark description to identify the literal and design elements that include these colors and specify where the black and white
`appear in these elements; or
`
`(2)(cid:160) If black and/or white are not being claimed as colors in the mark, applicant must amend the mark description to remove
`references to black.
`
`(cid:160)I
`
`d.
`
`(cid:160)T
`
`(cid:160)P
`
`he following mark description is suggested, if accurate:
`
`The mark is not in color.(cid:160) The mark consists of a rectangle with rounded corners.(cid:160) Inside the rectangle is the wording “240 BLB,”
`with the wording “BACK LIGHT BLINKING” below it.
`
`RIOR REGISTRATION CLAIM
`
`(cid:160)I
`
`f applicant owns U.S. Registration No. 4329225, then applicant must submit for the application record a claim of ownership of this registration.(cid:160)
`
`See 37 C.F.R. §2.36; TMEP §812.(cid:160) See the attached copy of the registration.(cid:160) See TMEP §812.(cid:160)(cid:160)
`
`Applicant may use the following format to claim ownership of the registration:
`
`Applicant is the owner of U.S. Registration No. 4329225.
`
`(cid:160)T
`
`EAS PLUS FEE
`
`(cid:160)A
`
`pplicant must submit an additional application processing fee of $50 per class because the application as filed did not meet the TEAS Plus
`application filing requirements.(cid:160) See 37 C.F.R. §§2.6(a)(1)(iv), 2.22(a), (b); TMEP §§819.01 et seq., 819.04.(cid:160) Specifically, applicant failed to
`
`meet the following application filing requirement:(cid:160) no color claim was provided, even though color was included in the mark description.(cid:160)(cid:160)
`
`The additional fee is required even if applicant later corrects these application requirements.
`
`(cid:160)I
`
`f applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney.(cid:160) All relevant e-
`mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to
`this Office action and will not extend the deadline for filing a proper response.(cid:160) See 37 C.F.R. §2.191; TMEP §§304.01-.02, 709.04-.05.(cid:160) Further,
`although the trademark examining attorney may provide additional explanation pertaining to the requirements in this Office action, the
`trademark examining attorney may not provide legal advice or statements about applicant’s rights. (cid:160) See TMEP §§705.02, 709.06.

`
`Black Level
`
`The MVA LCD panel deployed on the Panasonic T)(—L42E6B has really done wonders for its
`black-level performance. Alter calibration, we recorded the Tv's unassisted blacir level (i.e_
`
`using an ANSI checkerboard pattern} at 0.0268 cdfmz. a supremely impressive figure which is
`beyond the reach of IF-‘S~type panels that the company has been using on its LED LCD
`displays over the past few years.
`
`It is important to point out that all of Panasonic's 2U‘T3 3D—{:apab|e LED televisions — that's
`basically every series higher than the Viera E6 — will be using LG Display's IPS LCD panel with
`FPR (film—type pattemed retarder) passive 3D technology. Whilst capable of delivering cleaner
`motion and wider viewing angles. IPS LCDs are typically handicapped by weaker black level.
`and so we find the T}-(—L42E6 in an advantageous if bizarre position where it should comfortably
`outperform more expensive models higher up the viera LED Tv hierarchy as far as blacks go.
`
`Like most LED Tvs these days. the T:-(Lz12E6B partaices in some auto-dimming across all its
`picture presets when fed with full—screer: video black signal. Instead of switching the LEDs off
`completely. Panasonic's engineers have chosen to dim the backlight down to near—blacE<
`
`{measured luminance level was 0.008 cdfm2}, presumably to minimise anyjarring efiect that
`viewers may experience. Asking the TV to display even the smallest amount of non—blacK
`content {for example a pause icon} will defeat the autogimming. at which point blacks will
`return to its native level of0.0268 cdfmz.

`
`Screen 8: Backlight Uniformity
`
`Given the way LEDs are affixed around the periphery of the LCD panel on an edge—lit LED
`television, "It's unrealistic to expect perfect screen.’ backiight consistency from such displays
`(especially larger—sized ones). The Panasonic Viera E6 cannot escape this inevitable side
`efiect that stems from TV makers‘ quest to make sligmner and sliminer TVs, but we'll say that
`our 42-inch review sample fared better in this regard than many other edge LED models that
`have passed through our test room. Only in a very dark viewing environment AND on a full—fleld
`black xreen did we see some backlight bleeding at the bottom corners, and this was
`attenuated somewhat by the auto41i:rming that kicked in. if we peered hard enough, some
`“dirty screen efiect“ (DSE) was also visible against panning shots of evenly toned background,
`but it never really bothered us in reaiworld viewing.

`Standard Definition
`
`
`
`
`
`There’s almost no chink in the SD processing amiour on the T}(—L42E6 ‘viera television. The
`quality of upscaling was first-rate — all the details in the SMPTE RP-133 test card were
`captured in fuil and displayed crisply with only minimal ringing. Video—mo-de deinterlacing was
`also excellent: we saw no iaggies at all in HOV Benchmaflcs rotating line test pattern, and only
`very fewjagged edges on the last of the bouncing bars.
`
`As long as [Film Cadence Mode] was engaged (it's greyed out for non—fllm or HD content), the
`LED TV correctly identified and processed 2:2 cadence over 5761, and 322 over 4130i. Add in
`deep blacks as well as accurate greyscale and the Panasonic TX—L42E6B is an excellent

`
`Putting the TXL42E6B through a variety of high41ef materiai starting with Biu—rays_ the tirst
`thing that grabbed us was how good the biack Eevel was on the HDTV — we've never quite fin
`the top and bottom black bars in 2.35:1 movies virtually dissoive into nothingness on previous
`Viera LED LCD TVs as they did on the E6. its reaiiy a shame that this sort of hypnotic biacics
`wiii be missing from more expensive models higher up Panasonic's 2013 LED LCD lineup, aii
`because of an executive decision to use passive 3D across its entire LCD—based 3D'W range.
`
`
`
`Given its pedigree in Biu—ray authoring and post—production through its Panasonic Hoiiywood
`Laboratory (PHL) facility, the Japanese company obviousiy understands the importance of
`ietting pristine HD content speak for itself without imposing any superfiuous picture processing
`(Sony is another brand who does this very well). With the correct settings appiied on the 42E6,
`there's absoiuteiy no undemanded fiim grain smoothing nor edge enhancement at piay, thus
`aiiowing the exquisite detail of each pixei in 1920x1030 images to shine through on screen.
`
`Every singie Panasonic Viera fiat—panei HDTV we've reviewed since 2008 has handied
`108Gpr2a£ signal impeccabiy without any hint of teiecine judder, and the TX-L42E6B continues
`this line tradition.

`
`We took the opportunity this week to watch some live European football action on .‘TV HD,
`which confinrled the TXL42E6's low motion resolution. Fast pans across the field would blurthe
`words on the pitch-side advenising boards as well as individual definition within the crowd,
`which is to be expected from an LCD panel lacking lvlCFl enhancement. Whether or not this will
`pose a problem for you depends on your own sensitivity and tolerance to motion blumng, but
`be forewarned if you're coming from a plasma or CRT background.
`
`The UEFA Champions League last 16 fiond—leg match between Manchester United and Real
`Madrid made apparent another minor shortcoming on the E6 LED TV. By and large colours
`appealed natural, but the led jerseys worn by Man Utd players did look a touch muted
`because of the slightly shrunken gamut. Most viewers probably won‘t notice this outside of a
`side-by-side comparison with a reference display though.
`
`Sound Quality
`
`The Panasonic ‘D{L42E6B's acoustic perromiance was par for the course fora llat—screen
`television. Speech clarity was decent, and volume could be cranked up reasonably high without
`distortion, but iryou're looking for a full-bodied audio experience, an eiitemal soundbar or
`home theatre system certainly wouldn‘t go amiss.
`
`Conclusion
`
`In case we haven't made it clear enough in the preceding review text, the Panasonic TX-
`L42E6B is hands down the best LCD-based display we've fin from the company thus far.
`The combination Of deep blacks furnished D]? the newly sourced VA panel and PEilI1aSu0|'IlC'S
`video processing l(now—how rrlarks a watershed moment for the Japanese manufacturer,
`putting it finnly on the radar as a serious challenger to Samsung and Sony in the LED TV
`arena.
`
`While the low motion resolution, relatively limited viewing angles, and of course lack of 3D
`capabilities may put olT sonle buyers, the precision olTered by the televis.ion's calibration
`controls, not to mention its standard—definition handling, is simply top—notch, making for
`accurate and compelling pictures in both so and HD. If you're looking to buy a 42in LED LCD

`
`This is a more technical area. and one that more casual consumers
`
`might want only to gloss over. Backlighting is just what it sounds
`|ike—|ight that comes from the rear of the television in order
`It’s a
`to illuminate the image on the Liquid Crystal Display (LCD).
`simple enough concept, but there are a number of different ways it
`can be done.
`
`It’s not crucial for consumers to understand the technologies
`involved, but different methods have advantages and this is
`becoming an increasingly important selling point when choosing
`between certain models and manuiacturers, especially towards the
`higher end of the market.
`It applies to LCD televisions, not plasma
`screens.

`This‘ method‘ is cheap, but not very

`power efficient. A television using this generally won't have any
`mention of the backlighting in its sales materials.
`
`A newer and increasingly popular technology is using light-emitting
`diodes (LEDs). This technology can come in a number of different
`varieties, but it's generally a step up from a standard LCD. While not
`particularly new. the use of LEDs is still a premium technology not
`found in all HDTVs. LED backlighting tends to offer improved color
`gamut. contrast ratios. and less power consumption. They are also
`more reliable and can offer over 100.000 hours of life. compared to
`CGFLs which are often rated at 20,000 hours.
`
`LED backlighting can be broken down into a few different varieties.
`These include full arrays of LEDs (with individual LEDs spread out
`over the entire area behind the screen} and edge-lit, which only
`places LEDs on the edges of the display. (Here is a Geek.co
