`OFFICE ACTION
`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S
`COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 5/20/2014
`
`The referenced application has been reviewed by the assigned trademark examining attorney.(cid:160) Applicant must respond timely and completely to
`the issue below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`Mark is Likely to Cause Confusion
`
`(cid:160)T
`
`he examining attorney refuses registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d), because the applicant's mark, when
`used on or in connection with the identified goods, so resembles the mark in U.S. Registration Nos. 2631398 and 1661934 as to be likely to
`cause confusion, or to cause mistake, or to deceive.(cid:160) TMEP section 1207.(cid:160) See the enclosed registrations.
`
`(cid:160)T
`
`rademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely that a potential consumer
`would be confused or mistaken or deceived as to the source of the goods and/or services of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160)
`The court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) listed the principal factors to be considered
`when determining whether there is a likelihood of confusion under Section 2(d).(cid:160) See TMEP §1207.01.(cid:160) However, not all of the factors are
`necessarily relevant or of equal weight, and any one factor may be dominant in a given case, depending upon the evidence of record.(cid:160) In re
`
`(cid:160)
`(cid:160)
`(cid:160)(cid:160)
`
`
`Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont, 476 F.2d at 1361-62, 177 USPQ at
`567.
`
`(cid:160)T
`
`he examining attorney must analyze each case in two steps to determine whether there is a likelihood of confusion.(cid:160) First, the examining
`attorney must look at the marks themselves for similarities in appearance, sound, connotation and commercial impression.(cid:160) In re E. I. DuPont de
`Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (CCPA 1973).(cid:160) Second, the examining attorney must compare the goods or services to
`determine if they are related or if the activities surrounding their marketing are such that confusion as to origin is likely.(cid:160) In re August Storck KG,
`218 USPQ 823 (TTAB 1983);(cid:160) In re International Telephone and Telegraph Corp., 197 USPQ 910 (TTAB 1978);(cid:160)(cid:160) Guardian Products Co., v.
`Scott Paper Co., 200 USPQ 738 (TTAB 1978).
`
`(cid:160)A
`
`nalysis of Applicant’s Mark and Registered Mark
`
`(cid:160)F
`
`irst, a comparison of the respective marks show that they are comprised either in whole or significant part of the term “PROTECTION PLUS.” (cid:160)
`Accordingly, the applicant’s mark, “PROTECTION PLUS,” is similar in sound, appearance, connotation and commercial impression to
`Registration No. 1661934’s mark “PROTECTION PLUS” and Registration No. 2361398’s mark “BJ’S PROTECTION PLUS.”
`(cid:160)(cid:160) Similarity
`in any one of these elements alone is sufficient to find a likelihood of confusion.(cid:160)(cid:160) In re Mack, 197 USPQ 755 (TTAB 1977).
`
`(cid:160)A
`
`s to Registration No. 2631398, it should be noted that the mere deletion of wording from a registered mark may not be sufficient to overcome a
`likelihood of confusion.(cid:160) See In re Mighty Leaf Tea, 601 F.3d 1342, 94 USPQ2d 1257 (Fed. Cir. 2010); In re Optica Int’l , 196 USPQ 775, 778
`(TTAB 1977); TMEP §1207.01(b)(ii)-(iii).(cid:160) Applicant’s mark does not create a distinct commercial impression because it contains the same
`common wording as the registered mark, and there is no other wording to distinguish it from the registered mark.
`
`(cid:160)A
`
`nalysis of Services
`
`(cid:160)S
`
`econd, a comparison of the applicant’s services, “providing extended warranties for computer tablets, laptops and mobile digital video system
`comprised of video cameras and digital video recorders for real-time recording of events and evidence,” to the registrant’s services shows the
`relationship between them.(cid:160) Registration No. 1661934’s mark is for underwriting warranty programs in the field of power equipment. (cid:160)
`Registration No. 2631398’s mark is for providing extended warranties on products subject to manufacturers’ warranties for goods including
`
`computer equipment.(cid:160) The overlapping identifications of providing extended warranties for computer equipment evidence the relationship.(cid:160)(cid:160)
`
`The examining attorney must determine whether there is a likelihood of confusion on the basis of the goods identified in the application and
`registration.(cid:160) If the application or cited registration describes the goods broadly and there are no limitations as to their nature, type, channels of
`trade or classes of purchasers, it is presumed that the application and registration encompass all goods of the type described, that they move in all
`normal channels of trade, and that they are available to all potential customers. Canadian Imperial Bank of Commerce v. Wells Fargo Bank, 811
`F.2d 1490, 1 USPQ2d 1813 (Fed. Cir. 1987); Paula Payne Products Co., v. Johnson Publishing Co., Inc., 473 F.2d(cid:160) 901, 177 USPQ 76 (CCPA
`1973); In re Elbaum, 211 USPQ 639 (TTAB 1981).(cid:160) Accordingly, the applicant’s provision of extended warranties for computer tablets, laptops
`and mobile digital video systems is seen to include such goods used in the field of power equipment.(cid:160) Similarly, the applicant’s goods are seen to
`include such products that are subject to manufacturers’ warranties.
`
`(cid:160)I
`
`t should be noted that where the services of an applicant and registrant are identical or virtually identical, the degree of similarity between the
`marks required to support a finding of likelihood of confusion is not as great as in the case of diverse services.(cid:160) See In re Viterra Inc., 671 F.3d
`1358, 1363, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012) (citing Century 21 Real Estate Corp. v. Century Life of Am., 970 F.2d 874, 877, 23
`USPQ2d 1698, 1701 (Fed. Cir. 1992)); In re Mighty Leaf Tea, 601 F.3d 1342, 1348, 94 USPQ2d 1257, 1260 (Fed. Cir. 2010); TMEP
`§1207.01(b).(cid:160) Accordingly, the mark is likely to cause consumer confusion as to source.
`
`(cid:160)P
`
`rior Pending Application
`
`(cid:160)I
`
`nformation regarding pending Application Serial No. 86-092313 is enclosed.(cid:160) The effective filing date of the referenced application precedes
`the applicant’s filing date. (cid:160) There may be a likelihood of confusion under Trademark Act Section 2(d) between applicant’s mark and the
`referenced mark.(cid:160) If the referenced applications mature into a registration, registration may be refused in this case under Section 2(d).(cid:160) 37 C.F.R.
`§2.83; TMEP §§1208 et seq.(cid:160) Therefore, upon entry of a response to this Office action, action on this case may be suspended pending final
`disposition of the earlier-filed applications.
`
`(cid:160)I
`
`f applicant believes that there is no potential conflict between this application and the earlier-filed applications, then applicant may present
`arguments relevant to the issue in a response to this Office action.(cid:160) The election not to submit arguments at this time in no way limits applicant’s
`right to address this issue at a later point.
`
`(cid:160)O
`
`ther Considerations
`
`(cid:160)A
`
`lthough the examining attorney has refused registration, the applicant may respond to the refusal to register by submitting evidence and
`arguments in support of registration.(cid:160) If applicant chooses to respond to the refusal to register, the following issue must also be addressed.
`
`
`
`(cid:160) D
`
`isclaimer of “ PROTECTION” Required
`
`(cid:160)A
`
`pplicant must disclaim the descriptive wording “ PROTECTION” apart from the mark as shown. (cid:160) See 15 U.S.C. §1056(a); TMEP §§1213,
`
`1213.03(a).(cid:160) “Protection” is defined as the act of protecting or the state of being protected; preservation from injury or harm. [1](cid:160)(cid:160)
`
`The word “ PROTECTION” is merely descriptive of the function of the applicant’s extended warranty services and does not serve as an
`indication of the source of the services.(cid:160) TMEP Section 1213.03(a).(cid:160) This is illustrated by the specimens that state that “Protection Plus” is a
`“supplemental warranty covering accidental, physical damage to a Toughbook mobile computer…”(cid:160) The service protects the consumer from
`injury or harm by loss of the computer.(cid:160) The computerized printing format for the Trademark Official Gazette requires a standard form for a
`disclaimer.(cid:160)(cid:160) TMEP §1213.08(a)(i).(cid:160) A properly worded disclaimer should read as follows:
`
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`(cid:160)S
`
`No claim is made to the exclusive right to use “ PROTECTION” apart from the mark as shown.

`
`(cid:160)I
`
`f applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney.(cid:160) All relevant e-
`mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to
`this Office action and will not extend the deadline for filing a proper response.(cid:160) See 37 C.F.R. §2.191; TMEP §§304.01-.02, 709.04-.05.(cid:160) Further,
`although the trademark examining attorney may provide additional explanation pertaining to the refusal and/or requirement in this Office action,
`the trademark examining attorney may not provide legal advice or statements about applicant’s rights. (cid:160) See TMEP §§705.02, 709.06.
