`irst, a comparison of the respective marks show that they are comprised either in whole or significant part of the term “PROTECTION PLUS.” (cid:160)
`Accordingly, the applicant’s mark, “PROTECTION PLUS,” is similar in sound, appearance, connotation and commercial impression to
`Registration No. 1661934’s mark “PROTECTION PLUS,” Registration No. 4773525’s mark “SAMSUNG PROTECTION PLUS” and
`Registration No. 2361398’s mark “BJ’S PROTECTION PLUS.” (cid:160)(cid:160) Similarity in any one of these elements alone is sufficient to find a
`likelihood of confusion.(cid:160)(cid:160) In re Mack, 197 USPQ 755 (TTAB 1977).(cid:160) The applicant’s mark is identical to Registration No. 1661934’s mark.

`he Court of Appeals for the Federal Circuit and the Trademark Trial and Appeal Board have recognized that marks deemed “weak” or merely
`descriptive are still entitled to protection against the registration by a subsequent user of a similar mark for closely related goods and/or services.(cid:160)
`TMEP §1207.01(b)(ix); see King Candy Co. v. Eunice King’s Kitchen, Inc. , 496 F.2d 1400, 1401, 182 USPQ 108, 109 (C.C.P.A. 1974)

`econd, a comparison of the applicant’s services, “providing extended warranties for computer tablets, laptops and mobile digital video system
`comprised of video cameras and digital video recorders for real-time recording of events and evidence,” to the registrant’s services shows the
`relationship between them.(cid:160) Registration No. 4773525’s mark is for providing extended warranties on consumer electronic products and
`consumer appliances.(cid:160) Registration No. 1661934’s mark is for underwriting warranty programs in the field of power equipment. (cid:160) Registration
`No. 2631398’s mark is for providing extended warranties on products subject to manufacturers’ warranties for goods including computer
`equipment.(cid:160) The overlapping identifications of providing extended warranties for computer equipment evidence the relationship with
`
`Registration No. 2631398.(cid:160)(cid:160)
`
`The examining attorney must determine whether there is a likelihood of confusion on the basis of the goods and services identified in the
`application and registration.(cid:160) If the application or cited registration describes the goods and services broadly and there are no limitations as to
`their nature, type, channels of trade or classes of purchasers, it is presumed that the application and registration encompass all goods and services
`of the type described, that they move in all normal channels of trade, and that they are available to all potential customers. Canadian Imperial
`Bank of Commerce v. Wells Fargo Bank, 811 F.2d 1490, 1 USPQ2d 1813 (Fed. Cir. 1987); Paula Payne Products Co., v. Johnson Publishing
`Co., Inc., 473 F.2d(cid:160) 901, 177 USPQ 76 (CCPA 1973); In re Elbaum, 211 USPQ 639 (TTAB 1981).(cid:160) Accordingly, the applicant’s provision of
`extended warranties for computer tablets, laptops and mobile digital video systems is seen to include such goods used in the field of power
`equipment.(cid:160) Similarly, the applicant’s identified goods covered by the services are seen to include such products that are subject to
`manufacturers’ warranties and are considered consumer electronic products.

`he trademark examining attorney has attached evidence from the USPTO’s X-Search database consisting of a number of third-party marks
`registered for use in connection with the same or similar services as those of both applicant and registrant in this case.(cid:160) This evidence shows that
`the services listed therein, namely providing warranties in the field of electronics and computers, are of a kind that may emanate from a single
`source under a single mark.(cid:160) See In re Aquamar, Inc., 115 USPQ2d 1122, 1126 n.5 (TTAB 2015) (citing In re Mucky Duck Mustard Co., 6
