`
`STRICT DEADLINE TO RESPOND TO THIS LETTER
`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S
`COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
`
`(cid:160)I
`
`SSUE/MAILING DATE: 12/1/2014
`
`(cid:160)T
`
`he assigned examining attorney has reviewed the referenced application and determined the following:
`
`(cid:160)S
`
`earch Results: No Conflicting Marks Found
`The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under
`Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).(cid:160) TMEP section 704.02.
`
`(cid:160)N
`
`evertheless, the applicant’s mark cannot be approved for publication unless and until the applicant responds completely and timely to the
`following issue.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`(cid:160)I
`
`dentification and Classification of Goods
`The identification of goods is unacceptable because it includes indefinite wording and lists goods that are or may be misclassified.(cid:160) TMEP
`§1402.01.
`
`(cid:160)F
`
`irst, some goods identified in the application are classified according to whether they are for medical or scientific/research use.(cid:160) For example,
`incubators for laboratory use are in Class 9, while incubators for medical use are in Class 10.(cid:160) (Incubators for eggs are in Class 7).(cid:160) Where
`indicated in the suggestions below, certain goods require further clarification as to purpose so that proper classification can be determined.(cid:160) For
`purposes of identification, “medical use” in Class 10 describes a medical device or instrument that is used directly on patients for a treatment or
`diagnostic purpose.(cid:160) Items that merely work in conjunction with medical equipment (such as software) are not classified in Class 10 unless they
`are a component feature of medical equipment.
`
`(cid:160)F
`
`reezers and refrigerators are properly classified in Class 11 regardless of any more specific purpose.(cid:160)
`
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`
`
`“Cell processing workstations” is indefinite; the particular components of the workstations must be listed. (cid:160) While most laboratory equipment is
`properly classified in Class 9, other items are in Class 11.(cid:160) For example, clean rooms and clean room installations are in Class 11.
`
`(cid:160)A
`
`utomatic counting machines are properly classified in Class 9.(cid:160) However, packaging machines are classified in Class 7.(cid:160) Thus, “automatic
`tablet counting and packaging machines” is unacceptable in Class 9. (cid:160) The applicant must identify and classify the goods according to their
`primary purpose; if no purpose is primary, the goods must be classified according to the first-listed function.
`
`(cid:160)“
`
`Medication counting and vial filling systems” is unacceptable as indefinite. (cid:160) The applicant must list the parts of the “systems,” or describe
`these goods using their common commercial name.(cid:160) In addition, as noted above, counting machines are properly classified in Class 9 but filling
`machines are in Class 7.(cid:160) Thus, classification of the goods depends upon their primary or primary-listed function.
`
`(cid:160)T
`
`(cid:160) The applicant must
`he wording “orbital shakers” and “bio-clean benches” is unacceptable because the nature of the listed goods is not clear.
`amend this portion of the identification to further specify the goods.(cid:160) For “orbital shakers,” it is sufficient to indicate the goods are laboratory
`equipment.
`
`(cid:160)A
`
`utoclaves not for medical purposes are properly classified in Class 11 if electric and in Class 21 if not electric.
`
`(cid:160)“
`
`Electric ovens” is unacceptable as indefinite. (cid:160) The applicant must list the specific type of oven or provide information about their purpose.(cid:160)
`Cooking ovens are in Class 11. However, ovens for laboratory use are in Class 9.
`
`(cid:160)“
`
`Dry heat sterilizers” is unacceptable because the specific purpose of the goods is not provided. (cid:160) Dry heat sterilizers for medical or dental use are
`in Class 10, while those for other purposes (including laboratory use) are in Class 11.
`
`(cid:160)T
`
`he applicant must amend the application to adopt an acceptable identification and classification of goods.(cid:160) For assistance with identifying and
`classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and
`Services Manual at http://tess2.uspto.gov/netahtml/tidm.html. (cid:160) See TMEP §1402.04.
`
`(cid:160)T
`
`(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`he applicant may amend to adopt one or more of the following identifications, if accurate:
`
`INTERNATIONAL CLASS 7:(cid:160) Tablet packaging machines; medication vial filling machines.
`
`INTERNATIONAL CLASS 9:(cid:160)(cid:160) Incubators, namely, cell culture incubators, laboratory research incubators, incubators for laboratory
`applications; cell processing workstations, namely, [provide additional information about workstations properly classified in this class;
`e.g., self-contained laboratory installation for processing and manufacturing stem cells and cell therapies]; computer graphics software;
`computer hardware; computer hardware and computer peripheral devices; computer hardware and software, for use with medical patient
`monitoring equipment, for receiving, processing, transmitting and displaying data; computer memories; computer networking hardware;
`medical software for processing and displaying images on ultrasound medical imaging machines; medical workstation comprised of computer
`hardware and software for gathering and transmitting patient image data for use during surgical procedures; temperature controllers for
`warming and cooling medical and surgical liquids, equipment and instruments; automatic tablet counting machines that also include a
`packaging function; medication counting machine also featuring a vial filling function; laboratory equipment, namely, orbital shakers; bio-
`clean benches, namely, laminar flow cabinets and similar enclosures featuring a filtered air supply, for laboratory and research use;
`electric ovens for laboratory use.
`
`INTERNATIONAL CLASS 10:(cid:160) Incubators for medical use; dry heat sterilizers for medical use.
`
`INTERNATIONAL CLASS 11:(cid:160) Freezers, namely, ultra-low freezers, cryogenic freezers, chest freezers, industrial freezers, biomedical
`freezers; refrigerators, namely, blood bank refrigerators, pharmaceutical refrigerators, laboratory refrigerators; cell processing workstations in
`the nature of clean room installations; electric autoclaves; dry heat sterilizers for laboratory use.
`
`(cid:160)I
`
`NTERNATIONAL CLASS 21:(cid:160) Non-electric autoclaves.
`
`(cid:160)A
`
`n applicant may only amend an identification to clarify or limit the goods, but not to add to or broaden the scope of the goods.(cid:160) 37 C.F.R.
`
`§2.71(a); see TMEP §§1402.06 et seq., 1402.07.(cid:160)(cid:160)
`Multiple Class Application—Advisory and Requirements
`The application identifies goods that may be classified in up to 5 classes; however, applicant submitted a fee sufficient for only 2 classes.(cid:160) In a
`multiple-class application, a fee for each class is required.(cid:160) 37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.
`
`(cid:160)T
`
`herefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for
`each additional class.
`
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`
`
`(cid:160)I
`

`
`(2)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)

`numbered class.
`
`Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule at
