` novel spelling or an intentional misspelling that is the phonetic equivalent of a merely descriptive word or term is also merely descriptive if
`purchasers would perceive the different spelling as the equivalent of the descriptive word or term.  See In re Hercules Fasteners, Inc., 203 F.2d
`753, 97 USPQ 355 (C.C.P.A. 1953) (holding “FASTIE,” phonetic spelling of “fast tie,” merely descriptive of tube sealing machines); Andrew
`J. McPartland, Inc. v. Montgomery Ward & Co., 164 F.2d 603, 76 USPQ 97 (C.C.P.A. 1947) (holding “KWIXTART,” phonetic spelling of
`“quick start,” merely descriptive of electric storage batteries); In re Carlson, 91 USPQ2d 1198 (TTAB 2009) (holding “URBANHOUZING”
`phonetic spelling of “urban” and “housing,” merely descriptive of real estate services); In re State Chem. Mfg. Co., 225 USPQ 687 (TTAB
`1985) (holding “FOM,” phonetic spelling of “foam,” merely descriptive of foam rug shampoo); TMEP §1209.03(j).

`In this case, applicant has applied to register the mark FOLDZ for “headphones.”   FOLDZ is a novel spelling or intentional misspelling of the
`phonetically equivalent term “FOLDS.”   “FOLD” (or plural “FOLDS”) means “to bend or press (something) so that one part is over another;
`double up on itself” (verb) or “a folded part or layer” (noun).   See attached evidence from
`http://www.collinsdictionary.com/dictionary/american/fold captured 12/9/14.

`As evidence that headphones that fold are widely available, see the attachments from www.walmart.com and
`https://www.google.com/search?q=%22foldable+headphones captured 12/9/14.
`
`Given that the goods could include a headphone that folds and/or contains folds, the proposed mark FOLDZ merely describes a feature or
`characteristic of the goods.  Accordingly, registration on the Principal Register is refused under Section 2(e)(1) of the Trademark Act.
`
`SUPPLEMENTAL REGISTER (ADVISORY)
`Although an amendment to the Supplemental Register would normally be an appropriate response to this refusal, such a response is not
`appropriate in the present case.  The instant application was filed under Trademark Act Section 1(b) and is not eligible for registration on the
`Supplemental Register until an acceptable amendment to allege use meeting the requirements of 37 C.F.R. §2.76(b), (c) has been timely filed.  37
`C.F.R. §2.47(d); TMEP §§816.02, 1102.03.
`
`If applicant files an acceptable allegation of use and also amends to the Supplemental Register, the effective filing date of the application will be
`the date on which applicant met the minimum filing requirements of 37 C.F.R. §2.76(e) for the amendment to allege use.  37 C.F.R. §2.75(b);

`(3)  A written statement describing in detail the nature, purpose, and channels of trade of the goods.
