`The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to
`the issues below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

`SUMMARY OF ISSUES that applicant must address:

`Applicant must disclaim the wording “LAB” because it merely describes an ingredient, quality, characteristic, function, feature, purpose, or use
`of applicant’s goods and/or services, and thus is an unregistrable component of the mark.  See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS
`Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson
`
`LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); TMEP §§1213, 1213.03(a).  
`
`LAB is short for “laboratory,” which is defined as a “room or building equipped for scientific experiments, research, or teaching, or for the
`manufacture of drugs or chemicals.”   (See the attached definitions).  The applicant’s services are “ providing an online and mobile resource to
`the scientific and medical research community featuring information and news about scientific research, knowledge, and advancements,
`including but not limited to service and support on laboratory equipment and instruments, protocols, and experimental procedures; web and
`mobile services, namely, creating on-line virtual communities for registered users to interact with each other, post and respond to content on
`the site, and engage with interactive tools, all of the foregoing in connection with scientific research, knowledge, and advancements.” LAB
`describes the services because they pertain to laboratory subject matter, such as “scientific research,” “experimental procedures,” and “service
`and support on laboratory equipment.”
`
`The examining attorney references the attached page from the applicant’s website, which notes that the applicant provides goods for laboratory
`use.  A tagline on the website states that the applicant provides “Advanced Products and Technologies for Life Science, Pharmaceutical,
`Biotechnology, Clinical and Industrial Laboratories.” (Emphasis added).   Thus, the examining attorney presumes that the “scientific research,
`knowledge, and advancements” listed in the identification includes that related to research laboratories or goods used in laboratories.   As such,
`LAB describes a key feature of the services.  Thus, LAB is merely descriptive and must be disclaimed.
`
`An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services in the marketplace.  See
`Dena Corp. v. Belvedere Int’l, Inc. , 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825
`(TTAB 1983).  A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove
`the disclaimed matter from the mark.  See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP
`
`§1213.  
`
`If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark.  See In re Stereotaxis Inc., 429 F.3d
`1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP §1213.01(b).
`
`Applicant should submit a disclaimer in the following standardized format:
`
`No claim is made to the exclusive right to use “LAB” apart from the mark as shown.
`

`Identification of Services
`The identification of services is unacceptable because it is indefinite and lists services that may be misclassified.  TMEP §1402.01, 1403.
`
`First, the introductory language “providing an online and mobile resource” and “web and mobile services” is unacceptable because it does not
`specifically identify any service.  The applicant must amend the identification to specify the services provided, such as “providing a website” or
`“providing information.”
`
`In addition, the provision of information or a website is classified according to the subject matter of the information/website.  Thus, subject
`matter must be listed with sufficient specificity that proper classification can be determined.  In the applicant’s identification, the subject matter
`includes “service and support on laboratory equipment and instruments, protocols, and experimental procedures.”   This wording is not
`acceptable because the specific subject matter is not clear, and appears to be misclassified.  Service and support in the nature of maintenance and
`repair of physical objects is generally classified Class 37, while other support services are classified according to their specific nature or type. 
`Information about scientific research and procedures is properly in Class 42, while information about medical procedures is in Class 44.
`
`Further, the identification must be specific and all-inclusive.  Thus, the wording “including but not limited to” is unacceptable.   The applicant
`must amend the identification to specifically list all the subject matter covered.
`
`Creating online virtual communities is properly classified in Class 42.
`
`The applicant must amend the application to adopt an acceptable identification and classification of services.  For assistance with identifying and
`classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and
`Services Manual at http://tess2.uspto.gov/netahtml/tidm.html.   See TMEP §1402.04.
`

`INTERNATIONAL CLASS 44:  Providing a website for the scientific and medical research community featuring information and news
`about experimental medical procedures.
`
`An applicant may only amend an identification to clarify or limit the services, but not to add to or broaden the scope of the services.  37 C.F.R.
`§2.71(a); see TMEP §§1402.06 et seq., 1402.07.
`Multiple Class Application—Advisory and Requirements
`The application identifies services that may be classified in multiple classes; however, applicant submitted a fee sufficient for only 1 class.  In a
`multiple-class application, a fee for each class is required.  37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.
`
`Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for
`each additional class.
`
`In addition, the applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

`List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest
