`Furthermore, the determination of whether a mark is merely descriptive is made in relation to an applicant’s services, not in the abstract. (cid:160)

`USPQ2d 1061, 1062-63 (TTAB 1999) (finding DOC in DOC-CONTROL would refer to the “documents” managed by applicant’s software
`rather than the term “doctor” shown in a dictionary definition); In re Digital Research Inc., 4 USPQ2d 1242, 1243-44 (TTAB 1987) (finding
`CONCURRENT PC-DOS and CONCURRENT DOS merely descriptive of “computer programs recorded on disk” where the relevant trade
`used the denomination “concurrent” as a descriptor of a particular type of operating system). (cid:160)
`“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.” (cid:160) In re Am. Greetings
`Corp., 226 USPQ 365, 366 (TTAB 1985).
`Rather, the question is “whether someone who knows what the goods and[/or] services are will understand the mark to convey information about
`them.” DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1254, 103 USPQ2d 1753, 1757 (Fed. Cir. 2012) (quoting In re
`Tower Tech, Inc., 64 USPQ2d 1314, 1316-17 (TTAB 2002)); In re Franklin Cnty. Historical Soc’y , 104 USPQ2d 1085, 1087 (TTAB 2012).
`In this case, the proposed mark FLIGHTLINK merely describes meteorological and weather services provided to various airplanes and airline

`fleets connected to a shared voice and data communications system for safe travel, airspace management and accurate real-time aviation
`monitoring, analysis and reporting.(cid:160) Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); TMEP §§1209 et seq.
`The terms “Flight” and “Link” mean “a trip made by or in an airplane or spacecraft” and/or “a group of similar beings or objects flying
`through the air together” and “a connecting element or factor”, “a unit in a communication system” and/or “an identifier attached to an element
`(as an index term) in a system in order to indicate or permit connection with other similarly identified elements”. See the attached dictionary
`definitions.
`This refusal is further supported by the specimen of record indicating that “ connected aircraft benefit from a wide range of aviation applications
`that enhance the operations of partnering airlines, including automatic, global real-time aircraft position reports” and “[t]he shared satellite
`datalink provides carriers with improved air-ground and ground-air communications, including both voice & text during each flight.” (cid:160)
`[Emphasis added].
`In addition, applicant’s attention is respectfully directed to the attached sample third-party registrations and approved application demonstrating
`the descriptive significance of the words “FLIGHT”, “LINK” and variants thereof in relation to meteorological/weather-related goods and
`services.(cid:160) Third-party registrations featuring services the same as or similar to applicant’s services are probative evidence on the issue of
`descriptiveness where the relevant word or term is disclaimed, registered under Trademark Act Section 2(f) based on acquired distinctiveness, or
`registered on the Supplemental Register.(cid:160) See Inst. Nat’l des Appellations D’Origine v. Vintners Int’l Co.
`, 958 F.2d 1574, 1581-82, 22 USPQ2d
`1190, 1196 (Fed. Cir. 1992); In re Box Solutions Corp., 79 USPQ2d 1953, 1955 (TTAB 2006); In re Finisar Corp., 78 USPQ2d 1618, 1621
`(TTAB 2006).
`Accordingly, when the term FLIGHTLINK is applied to meteorological and weather services rendered to airplanes and airlines connected to
`shared voice and data communications systems, consumers will immediately recognize and perceive the nature of the services.
`Finally, if the individual components of a mark retain their descriptive meaning in relation to the services, the combination results in a
`composite mark that is itself descriptive and not registrable. In re Phoseon Tech., Inc., 103 USPQ2d 1822, 1823 (TTAB 2012); TMEP
`§1209.03(d); see, e.g., In re Associated Theatre Clubs Co., 9 USPQ2d 1660, 1663 (TTAB 1988) (holding GROUP SALES BOX OFFICE merely
`descriptive of theater ticket sales services, because such wording “is nothing more than a combination of the two common descriptive terms most
`applicable to applicant’s services which in combination achieve no different status but remain a common descriptive compound expression”); In
`re Putnam Publ’g Co., 39 USPQ2d 2021, 2022 (TTAB 1996) (holding FOOD & BEVERAGE ON-LINE merely descriptive of “a news and
`information service updated daily for the food processing industry, contained in a database”).
`In this case, the combination of the descriptive words FLIGHT and LINK creates no incongruity or unique commercial impression apart from
`that of the previously-stated descriptive connotation, and no imagination is required to understand the nature of the services. Accordingly, the
`mark is merely descriptive. TMEP §1209.03(d); In re Copytele, Inc., 31 USPQ2d 1540, 1542 (TTAB 1994); In re Associated Theatre Clubs, 9
`USPQ2d at 1662.
`Based on the foregoing remarks, registration must be refused under Section 2(e)(1) of the Trademark Act.
`Amendment to Supplemental Register Suggested
`The applied-for mark has been refused registration on the Principal Register. Applicant may respond to the refusal by submitting evidence and
`arguments in support of registration and/or by amending the application to seek registration on the Supplemental Register. See 15 U.S.C. §1091;
`37 C.F.R. §§2.47, 2.75(a); TMEP §§801.02(b), 816. Amending to the Supplemental Register does not preclude applicant from submitting
`evidence and arguments against the refusal(s). TMEP §816.04.
`Refusal –Specimen Does Not Show Mark With Services
`Registration is also refused because the specimen does not show the applied-for mark in use in commerce in connection with any of the services
`specified in International Class 42 in the application.(cid:160) Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv),
`
`2.56(a); In re Chengdu AOBI Info. Tech. Co., 111 USPQ2d 2080, 2081-82 (TTAB 2011); TMEP §§904, 904.07(a), 1301.04(d), (g)(i).(cid:160)(cid:160)
`
`Specifically, the “ brochure” specimen merely shows the applied-for mark used to identify a technological weather system comprised of, among
`other things, a “patented device [that] collects and transmits weather data” rather than showing the mark used in the sale or advertising of the
`identified services of “meteorological forecasting”, “providing meteorological information”, “providing weather information”, “weather
`forecasting”, “weather information services” and “weather reporting” .(cid:160) Therefore, consumers will not perceive the proposed mark as an
`indication of source for these services.
`

`his refusal is supported by the specimen of record indicating that “ FLIGHTLINK is a complete end-to-end solution that includes multi-
`function atmospheric and GPS sensors, dedicated two-way satellite communication system, and ground-based data management and quality
`assurance” while also referencing “FLIGHTLINK equipped aircraft” and a FLIGHTLINK “ system”. (cid:160) [Emphasis added].
`

`n application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each
`
`international class of services identified in the application.(cid:160) 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).(cid:160)(cid:160)

`Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and
