`TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S
`COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
`
`OFFICE ACTION
`
`(cid:160)I
`
`SSUE/MAILING DATE: 7/4/2015
`
`(cid:160)I
`
`NTRODUCTION
`
`(cid:160)T
`
`his Office action is in response to applicant’s communication filed on 6/18/2015 .
`
`(cid:160)I
`
`n a previous Office action(s) dated 5/19/2015, applicant was required to satisfy the following requirement(s):(cid:160) amend the identification of goods
`and/or services and comply with the multiple class application requirements if necessary.
`
`(cid:160)T
`
`he above requirements are continued and maintained and the following new issue(s) are presented below.
`
`(cid:160)S
`
`UMMARY OF ISSUES that applicant must address:
`
`Identification of Services
`Multiple Class Application Requirements
`Partial Abandonment Advisory
`
`(cid:160)I
`
`DENTIFICATION OF SERVICES
`
`(cid:160)T
`
`his requirement only applies to class 35.
`
`(cid:160)P
`
`articular wording in the proposed amendment to the identification is not acceptable because it exceeds the scope of the identification in the
`application.(cid:160) See 37 C.F.R. §2.71(a); TMEP §§1402.06 et seq., 1402.07.(cid:160) The original identification in the application, and any previously
`accepted amendments, remain operative for purposes of future amendment. (cid:160) See 37 C.F.R. §2.71(a); TMEP §1402.07(d).
`
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`(cid:160)
`

`

`An acceptable identification of goods and/or services is required in an application.(cid:160) See 37 C.F.R. §§2.32(a)(6), 2.71(a); TMEP §§805, 1402.01.(cid:160)
`An applicant may only amend an identification to clarify or limit the goods and/or services, but not to add to or broaden the scope of the goods
`and/or services.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.(cid:160) Scope is generally determined by the ordinary meaning of the
`
`wording in the identification.(cid:160) TMEP §1402.07(a).(cid:160)(cid:160)
`
`The application originally identified the goods and/or services as follows:(cid:160) “Import and export services, namely, transportation of the
`merchandise of others in the nature of electronic security and surveillance devices, namely, cameras, surveillance cameras, security cameras,
`motion detectors, ultrasonic wave detectors, microwave detectors and passive infrared detectors, smoke detectors, security devices for personal
`use, namely, personal security alarms, security equipment for surveillance of persons, buildings and transport, namely, cameras, surveillance
`cameras, security cameras, motion detectors, ultrasonic wave detectors, microwave detectors and passive infrared detectors, apparatus for
`recording, transmission or reproduction of sound and images; memory cards and SIM cards.”
`
`(cid:160)H
`
`owever, the proposed amendment identifies the goods and/or services as follows:(cid:160) “Import and export services in the field of electronic
`
`security equipment and surveillance devices.” (cid:160)(cid:160)
`
`This portion of the proposed amendment is beyond the scope of the original identification because the original identification only included
`transportation services in class 39 and not the very broadly worded import and export services.(cid:160) Also, the original services were limited to
`specific electronic security equipment and surveillance devices and deletion of such matter is also considered to be beyond the scope of the
`original application.
`
`(cid:160)T
`
`hus, the identification, incorporating this amendment, is not acceptable.(cid:160) See 37 C.F.R. §§2.32(a)(6), 2.71(a); TMEP §§805, 1402.01.
`
`(cid:160)F
`
`urther still, "import and export services" is indefinite and too broad because it could include import and export agency services in class 35 and
`import and export services related to transportation in class 39.(cid:160) See the note from the Trademark ID Manual Below:
`
`035(cid:160)(cid:160) Import and export agencies
`
`(cid:160)T
`
`he word “agency/agencies” is required in the import/export IDs, because import and export agencies are businesses that assist
`in arranging for the shipping of goods for others, but do not actually provide transportation services themselves. IDs such as
`“import and export services” or “importing and exporting goods of others” would be indefinite, because the IDs are broad
`enough to encompass the transportation of goods in Class 39.
`
`(cid:160)A
`
`pplicant is advised that it cannot amend the identification of services to include import and export agency services in class 35 because such an
`amendment would be beyond the scope of the original identification in the application.
`
`(cid:160)A
`
`pplicant may substitute the following wording, if accurate:
`
`(cid:160)C
`
`lass 35(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`"Mediation of contracts for purchase and sale of products; Import and export services in the field of electronic security
`
`equipment and surveillance devices; Business consultation in the field of security, safety and crime control; Business advice and information" (cid:160)(cid:160)(cid:160)
`
`"Import and export services, namely, transportation of the merchandise of others in the nature of electronic security
`Class 39(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`equipment and surveillance devices, namely, cameras, surveillance cameras, security cameras, motion detectors, ultrasonic wave
`detectors, microwave detectors and passive infrared detectors, smoke detectors, security devices for personal use, namely, personal
`security alarms, security equipment for surveillance of persons, buildings and transport, namely, cameras, surveillance cameras,
`security cameras, motion detectors, ultrasonic wave detectors, microwave detectors and passive infrared detectors, apparatus for
`recording, transmission or reproduction of sound and images, memory cards and SIM cards"
`
`(cid:160)S
`
`ee TMEP §§1402.01, 1402.03.
`
`(cid:160)I
`
`f applicant adopts the suggested amendment of the goods and/or services, then applicant must amend the classification to International Classes
`9, 35, 39, and 45.(cid:160) See 37 C.F.R. §§2.32(a)(7), 2.85; TMEP §§805, 1401.
`
`(cid:160)A
`
`n applicant may only amend an identification to clarify or limit the goods and/or services, but not to add to or broaden the scope of the goods
`and/or services.(cid:160) 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.
`
`(cid:160)F
`
`or assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S.
`Acceptable Identification of Goods and Services Manual at http://tess2.uspto.gov/netahtml/tidm.html. (cid:160) See TMEP §1402.04.
`
`(cid:160)M
`
`ULTIPLE – CLASS APPLICATION REQUIREMENTS
`
`(cid:160)T
`
`he application identifies goods and/or services that are classified in at least 4 classes; however, applicant submitted a fee(s) sufficient for only 3

`

`

`class(es).(cid:160) In a multiple-class application, a fee for each class is required.(cid:160) 37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.
`
`(cid:160)T
`
`herefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for
`each additional class.
`
`(cid:160)T
`
`he application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below
`for each international class based on Trademark Act Section 1(b):
`
`(1)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`(2)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest
`numbered class.
`
`Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule at
`http://www.uspto.gov/trademarks/tm_fee_info.jsp).(cid:160) The application identifies goods and/or services that are classified in at least 4
`classes; however, applicant submitted a fee(s) sufficient for only 3 class(es).(cid:160) Applicant must either submit the filing fees for the
`classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

`(cid:160)T
`
`he fee for adding classes to a TEAS Reduced Fee (RF) application is $275 per class.(cid:160) See 37 C.F.R. §§2.6(a)(1)(iii), 2.23(a).(cid:160) For information
