`OFFICE ACTION
`
`(cid:160)I
`
`SSUE/MAILING DATE: 8/26/2015
`
`SUMMARY OF ISSUES that applicant must address:
`
`Section 2(e)(1) Refusal – Merely Descriptive
`Information About Goods Required
`Foreign Registration Certificate Required(cid:160)
`SEARCH OF OFFICE’S DATABASE OF MARKS
`The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that
`would bar registration under Trademark Act Section 2(d).(cid:160) TMEP §704.02; see 15 U.S.C. §1052(d).
`SECTION 2(e)(1) REFUSAL - MERELY DESCRIPTIVE
`Registration is refused because the applied-for mark merely describes a characteristic of applicant’s goods. (cid:160) Trademark Act Section 2(e)(1), 15
`U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.
`A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose, or use of an applicant’s goods
`and/or services.(cid:160) TMEP §1209.01(b); see, e.g., In re TriVita, Inc., 783 F.3d 872, 874, 114 USPQ2d 1574, 1575 (Fed. Cir. 2015) (quoting In re
`Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75
`USPQ2d 1420, 1421 (Fed. Cir. 2005) (citing Estate of P.D. Beckwith, Inc. v. Comm’r of Patents , 252 U.S. 538, 543 (1920)).(cid:160)
`The attached dictionary definition shows that the word “GLUE” means “ an adhesive substance used for
`sticking objects or materials together” ( http://www.oxforddictionaries.com/us/definition/american_english/glue). Applicant’s goods are
`adhesives.(cid:160) The word “GLUE” is therefore descriptive of applicant’s goods because it describes a characteristic of their product, namely that
`they are adhesive substances.
`In addition, the attached dictionary definition shows that the word “fine” means “ of high quality” (
`http://www.oxforddictionaries.com/us/definition/american_english/fine). “M arks that are merely laudatory and descriptive of the alleged merit
`

`

`of a product [or service] are . . . regarded as being descriptive” because “[s]elf-laudatory or puffing marks are regarded as a condensed form of
`describing the character or quality of the goods [or services].” (cid:160) DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1256,
`103 USPQ2d 1753, 1759 (Fed. Cir. 2012) (quoting In re The Boston Beer Co., 198 F.3d 1370, 1373, 53 USPQ2d 1056, 1058 (Fed. Cir. 1999));
`see In re Nett Designs, Inc., 236 F.3d 1339, 1342, 57 USPQ2d 1564, 1566 (Fed. Cir. 2001) (holding THE ULTIMATE BIKE RACK merely
`laudatory and descriptive of applicant’s bicycle racks being of superior quality); In re The Boston Beer Co., 198 F.3d at 1373-74, 53 USPQ2d at
`1058-59 (holding THE BEST BEER IN AMERICA merely laudatory and descriptive of applicant’s beer and ale being of superior quality);
`TMEP §1209.03(k).(cid:160) In fact, “puffing, if anything, is more likely to render a mark merely descriptive, not less so.” (cid:160) DuoProSS Meditech Corp.
`v. Inviro Med. Devices, Ltd., 695 F.3d at 1256, 103 USPQ2d at 1759.
`Generally, if the individual components of a mark retain their descriptive meaning in relation to the goods and/or services, the combination
`results in a composite mark that is itself descriptive and not registrable.(cid:160) In re Phoseon Tech., Inc., 103 USPQ2d 1822, 1823 (TTAB 2012);
`TMEP §1209.03(d); see, e.g., In re King Koil Licensing Co., 79 USPQ2d 1048, 1052 (TTAB 2006) (holding THE BREATHABLE MATTRESS
`merely descriptive of beds, mattresses, box springs, and pillows where the evidence showed that the term “BREATHABLE” retained its
`ordinary dictionary meaning when combined with the term “MATTRESS” and the resulting combination was used in the relevant industry in a
`descriptive sense); In re Associated Theatre Clubs Co., 9 USPQ2d 1660, 1663 (TTAB 1988) (holding GROUP SALES BOX OFFICE merely
`descriptive of theater ticket sales services, because such wording “is nothing more than a combination of the two common descriptive terms
`most applicable to applicant’s services which in combination achieve no different status but remain a common descriptive compound
`expression”). (cid:160)
`Only where the combination of descriptive terms creates a unitary mark with a unique, incongruous, or otherwise nondescriptive meaning in
`relation to the goods and/or services is the combined mark registrable.(cid:160) See In re Colonial Stores, Inc., 394 F.2d 549, 551, 157 USPQ 382, 384
`(C.C.P.A. 1968); In re Positec Grp. Ltd., 108 USPQ2d 1161, 1162-63 (TTAB 2013).
`In this case, both the individual components and the composite result are descriptive of applicant’s goods and/or services and do not create a
`unique, incongruous, or nondescriptive meaning in relation to the goods and/or services.
`Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support
`of registration.
`ADVISORY: SUPPLEMENTAL REGISTER
`
`(cid:160)A
`
`lthough an amendment to the Supplemental Register would normally be an appropriate response to this refusal, such a response is not
`appropriate in the present case.(cid:160) The instant application was filed under Trademark Act Section 1(b) and is not eligible for registration on the
`Supplemental Register until an acceptable amendment to allege use meeting the requirements of 37 C.F.R. §2.76 has been timely filed.(cid:160) 37 C.F.R.
`§2.47(d); TMEP §§816.02, 1102.03.
`
`(cid:160)I
`
`f applicant files an acceptable allegation of use and also amends to the Supplemental Register, the effective filing date of the application will be
`the date on which applicant met the minimum filing requirements of 37 C.F.R. §2.76(c) for the amendment to allege use.(cid:160) 37 C.F.R. §2.75(b);
`TMEP §§816.02, 1102.03.(cid:160) In addition, the undersigned trademark examining attorney will conduct a new search of the USPTO records for
`conflicting marks based on the later application filing date.(cid:160) TMEP §§206.01, 1102.03.
`If applicant responds to the refusal, applicant must also respond to the requirements set forth below.
`INFORMATION ABOUT GOODS REQUIRED
`Due to the descriptive nature of the applied-for mark, applicant must provide the following information regarding the goods and/or services and
`
`wording appearing in the mark:(cid:160)(cid:160) (1)(cid:160) Applicant must respond to the following questions:(cid:160)
`
`·(cid:160)(cid:160)(cid:160) (cid:160)(cid:160)(cid:160) What is the meaning of “FINEGLUE” in the mark?
`·(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160) Does “FINEGLUE” have any other meaning in relation to any of applicant’s services?
`See 37 C.F.R. §2.61(b); In re AOP LLC, 107 USPQ2d 1644, 1650-51 (TTAB 2013); In re Cheezwhse.com, Inc., 85 USPQ2d 1917, 1919 (TTAB
`2008); In re Planalytics, Inc., 70 USPQ2d 1453, 1457-58 (TTAB 2004); TMEP §§814, 1402.01(e).(cid:160)
`Failure to comply with a request for information can be grounds for refusing registration.(cid:160) In re AOP LLC, 107 USPQ2d at 1651; In re DTI
`P’ship LLP , 67 USPQ2d 1699, 1701-02 (TTAB 2003); TMEP §814.(cid:160)
`FOREIGN REGISTRATION CERTIFICATE REQUIRED
`
`(cid:160)T
`
`he application specifies Trademark Act Section 44(d) as the sole filing basis and indicates that applicant intends to rely on Section 44(e) as a
`
`basis for registration; however no copy of a foreign registration was provided.(cid:160) See 15 U.S.C. §1126(d), (e).(cid:160)(cid:160)
`
`An application with a Section 44(e) basis must include a true copy, photocopy, certification, or certified copy of a foreign registration from an
`applicant’s country of origin. (cid:160) 15 U.S.C. §1126(e); 37 C.F.R. §2.34(a)(3)(ii); TMEP §§1004, 1004.01, 1016.(cid:160) In addition, the applicant’s
`country of origin must be a party to a convention or treaty relating to trademarks to which the United States is also a party, or must extend
`reciprocal registration rights to nationals of the United States by law.(cid:160) 15 U.S.C. §1126(b); TMEP §§1002.01, 1004.
`
`(cid:160)T
`
`herefore, applicant must provide a copy of the foreign registration from applicant’s country of origin when it becomes available. (cid:160) TMEP
`§1003.04(a).(cid:160) A copy of a foreign registration must consist of a document issued to an applicant by, or certified by, the intellectual property
`office in applicant’s country of origin. (cid:160) TMEP §1004.01.(cid:160) If applicant’s country of origin does not issue registrations or Madrid Protocol
`certificates of extension of protection, the applicant may submit a copy of the Madrid Protocol international registration that shows that
`protection of the international registration has been extended to applicant’s country of origin. (cid:160) TMEP §1016.(cid:160) In addition, applicant must also
`
`

`

`provide an English translation if the foreign registration is not written in English.(cid:160) 37 C.F.R. §2.34(a)(3)(ii); TMEP §1004.01(a)-(b).(cid:160) The
`translation should be signed by the translator.(cid:160) TMEP §1004.01(b).
`
`(cid:160)I
`
`f the foreign registration is not yet available, applicant should inform the trademark examining attorney that the foreign application is still
`pending and request that the U.S. application be suspended until a copy of the foreign registration is available.(cid:160) TMEP §§716.02(b), 1003.04(a).
`
`(cid:160)I
`
`f applicant cannot satisfy the requirements of the Section 44(e) basis, applicant may amend the basis to Section 1(a) or 1(b), if applicant can
`satisfy the requirements for the new basis.(cid:160) See 15 U.S.C. §§1051(a)-(b), 1126(e); TMEP §806.03.(cid:160) Please note that, if the U.S. application
`satisfied the requirements of Section 44(d) as of the U.S. application filing date, applicant may retain the priority filing date under Section 44(d)
`without perfecting the Section 44(e) basis, provided there is a continuing valid basis for registration.(cid:160) See 37 C.F.R. §2.35(b)(3)-(4); TMEP
`§§806.02(f), 806.03(h).(cid:160)(cid:160)
`ASSISTANCE
`If applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney.(cid:160) All relevant e-
`mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to
`this Office action and will not extend the deadline for filing a proper response.(cid:160) See 37 C.F.R. §§2.62(c), 2.191; TMEP §§304.01-.02, 709.04-.05.(cid:160)

`Office action, the trademark examining attorney may not provide legal advice or statements about applicant’s rights. (cid:160) See TMEP §§705.02,
`709.06.
`TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL

`online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to
`Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address;
`and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application.(cid:160) See 37 C.F.R. §§2.22(b),
`2.23(b); TMEP §§819, 820.(cid:160) TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of
`$50 per international class of goods and/or services.(cid:160) 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04.(cid:160) However, in certain
`situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone without
`
`incurring this additional fee.(cid:160)(cid:160)(cid:160)(cid:160)
