`disposition of the earlier-filed referenced applications.
`
`(cid:160)I
`
`n response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict
`between applicant’s mark and the marks in the referenced applications.(cid:160) Applicant’s election not to submit arguments at this time in no way
`limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
`
`(cid:160)A
`
`lthough applicant’s application may be suspended, applicant should note the following ground for refusal.
`
`Section 2(d) Refusal – Likelihood of Confusion
`
`Registration of the applied-for mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 1923531 (“THE
`GENIUS”) and 2981585 (“GENIUS PRESTIGE”). (cid:160) Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.(cid:160) See the
`enclosed registrations. (cid:160) The same registrant owns both marks.
`
`(cid:160)A
`
`pplicant is Panasonic Corporation, a corporation organized in Japan.(cid:160) The registrant of both marks is Panasonic Corporation of North America,
`a corporation organized in Delaware.(cid:160) If applicant is the owner of the cited registrations, please see the advisory below.
`
`(cid:160)T
`
`rademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely a potential consumer
`would be confused, mistaken, or deceived as to the source of the goods of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160) A determination
`of likelihood of confusion under Section 2(d) is made on a case-by case basis and the factors set forth in In re E. I. du Pont de Nemours & Co.,
`476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973) aid in this determination.(cid:160) Citigroup Inc. v. Capital City Bank Grp., Inc., 637 F.3d
`1344, 1349, 98 USPQ2d 1253, 1256 (Fed. Cir. 2011) (citing On-Line Careline, Inc. v. Am. Online, Inc., 229 F.3d 1080, 1085, 56 USPQ2d 1471,
`1474 (Fed. Cir. 2000)).(cid:160) Not all the du Pont factors, however, are necessarily relevant or of equal weight, and any one of the factors may control
`in a given case, depending upon the evidence of record.(cid:160) Citigroup Inc. v. Capital City Bank Grp., Inc., 637 F.3d at 1355, 98 USPQ2d at 1260; In
`re Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont de Nemours & Co., 476 F.2d at
`1361-62, 177 USPQ at 567.
`
`(cid:160)I
`
`n this case, the following factors are the most relevant:(cid:160) similarity of the marks, similarity and nature of the goods, and similarity of the trade
`channels of the goods.(cid:160) See In re Viterra Inc., 671 F.3d 1358, 1361-62, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re Dakin’s Miniatures Inc. ,
`59 USPQ2d 1593, 1595-96 (TTAB 1999); TMEP §§1207.01 et seq.
`
`(cid:160)S
`
`imilarity of the Marks
`
`(cid:160)A
`
`pplicant has applied to register the mark “GENIUS SENSOR”.
`
`(cid:160)T
`
`(cid:160)T
`
`he mark in Registration No. 1923531 is “THE GENIUS”.
`
`he mark in Registration No. 2981585 is “GENIUS PRESTIGE”.
`
`(cid:160)M
`
`arks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.(cid:160) Stone Lion Capital
`Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve
`Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).(cid:160)
`“Similarity in any one of these elements may be sufficient to find the marks confusingly similar.” (cid:160) In re Davia, 110 USPQ2d 1810, 1812 (TTAB
`2014) (citing In re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB 2007)); In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB
`1988)); TMEP §1207.01(b).
`
`(cid:160)W
`
`hen comparing marks, the test is not whether the marks can be distinguished in a side-by-side comparison, but rather whether the marks are
`sufficiently similar in terms of their overall commercial impression that confusion as to the source of the goods offered under the respective
`marks is likely to result.(cid:160) Midwestern Pet Foods, Inc. v. Societe des Produits Nestle S.A., 685 F.3d 1046, 1053, 103 USPQ2d 1435, 1440 (Fed.
`Cir. 2012); In re Davia, 110 USPQ2d 1810, 1813 (TTAB 2014); TMEP §1207.01(b).(cid:160) The proper focus is on the recollection of the average
`purchaser, who retains a general rather than specific impression of trademarks.(cid:160) United Global Media Grp., Inc. v. Tseng, 112 USPQ2d 1039,
`1049, (TTAB 2014); L’Oreal S.A. v. Marcon , 102 USPQ2d 1434, 1438 (TTAB 2012); TMEP §1207.01(b).
`
`(cid:160)I
`
`(cid:160) According to the Merriam-Webster dictionary, this wording
`n this instance, the marks’ similarities stem from the shared wording “GENIUS”.
`means “a very smart or talented person.” (cid:160) See attached dictionary definition.(cid:160) Thus, the marks share the same commercial impression that the
`
`goods used in connection with the marks are smart or talented in their function.(cid:160)(cid:160)
`
`The marks also contain additional wording, but this does not eliminate the likelihood of confusion. Although marks are compared in their
`entireties, one feature of a mark may be more significant or dominant in creating a commercial impression.(cid:160) See In re Viterra Inc., 671 F.3d 1358,
`1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re Nat’l Data Corp. , 753 F.2d 1056, 1058, 224 USPQ 749, 751 (Fed. Cir. 1985); TMEP
`
`(cid:160)
`
`
`§1207.01(b)(viii), (c)(ii).(cid:160) Matter that is descriptive of or generic for a party’s goods is typically less significant or less dominant when
`comparing marks.(cid:160) See In re Dixie Rests., Inc., 105 F.3d 1405, 1407, 41 USPQ2d 1531, 1533-34 (Fed. Cir. 1997); In re Nat’l Data Corp. , 753
`
`F.2d at 1060, 224 USPQ at 752; TMEP §1207.01(b)(viii), (c)(ii).(cid:160)(cid:160)
`
`Here, “GENIUS” is the dominant term in the marks. (cid:160) The only additional wording in applicant’s mark is “SENSOR”, which is descriptive of
`applicant’s induction goods. (cid:160) The attached entry from the Merriam-Webster dictionary notes that “SENSOR” means “a device that detects or
`senses heat, light, sound, motion, etc., and then reacts to it in a particular way.” (cid:160) See attached dictionary definition.(cid:160) Sensors are common
`
`components of induction-based goods.(cid:160) See attached TDK screen capture. (cid:160)(cid:160)
`
`Nor does registrant’s use of the terms “THE” and “PRESTIGE” in its “THE GENIUS” and “GENIUS PRESTIGE” marks take away from
`similarities.(cid:160) The Trademark Trial and Appeal Board has found that inclusion of the term “the” at the beginning of one of the marks will
`generally not affect or otherwise diminish the overall similarity between the marks.(cid:160) See In re Thor Tech Inc., 90 USPQ2d 1634, 1635 (TTAB
`2009).(cid:160) Thus, the wording “THE” in registrant’s “THE GENIUS” mark is less significant.(cid:160) Additionally, “GENIUS” is the first term in
`registrant’s “GENIUS PRESTIGE” mark.(cid:160) Consumers are generally more inclined to focus on the first word, prefix, or syllable in any
`trademark or service mark.(cid:160) See Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d 1369, 1372, 73 USPQ2d
`1689, 1692 (Fed. Cir. 2005); Presto Prods., Inc. v. Nice-Pak Prods., Inc., 9 USPQ2d 1895, 1897 (TTAB 1988) (“it is often the first part of a
`mark which is most likely to be impressed upon the mind of a purchaser and remembered” when making purchasing decisions).(cid:160) Thus, the
`wording “GENIUS” is also the more dominant feature in registrant’s “GENIUS PRESTIGE” mark.
`
`(cid:160)B
`
`ased on the above analysis, applicant’s and registrant’s marks are sufficiently similar to find a likelihood of confusion.
`
`(cid:160)S
`
`imilarity of the Goods
`
`(cid:160)A
`
`pplicant has applied to register its mark in connection with “induction cookers; induction heaters designed as food warmers; induction heating
`hobs.”
`
`(cid:160)T
`
`(cid:160)T
`
`he goods in Registration No. 1923531 are “microwave ovens for cooking”.
`
`he goods in Registration No. 2981585 are “microwave ovens”.
`
`(cid:160)T
`
`he goods of the parties need not be identical or even competitive to find a likelihood of confusion.(cid:160) See On-line Careline Inc. v. Am. Online Inc.,
`229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894, 1898 (Fed. Cir.
`2000) (“[E]ven if the goods in question are different from, and thus not related to, one another in kind, the same goods can be related in the mind
`
`of the consuming public as to the origin of the goods.”); TMEP §1207.01(a)(i). (cid:160)(cid:160)
`
`The respective goods need only be “related in some manner and/or if the circumstances surrounding their marketing [be] such that they could
`give rise to the mistaken belief that [the goods and/or services] emanate from the same source.” (cid:160) Coach Servs., Inc. v. Triumph Learning LLC,
`668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724 (TTAB 2007));
`TMEP §1207.01(a)(i).
`
`(cid:160)T
`
`he attached Internet evidence consists of screen captures from Thermador, GE Appliances, Samsung, and Jenn-Air, entities that produce
`induction cooking apparatus (applicant’s goods) alongside microwave ovens (registrant’s goods).
`(cid:160) This evidence establishes that the same
`entity commonly produces the relevant goods and markets the goods under the same mark.(cid:160) Therefore, applicant’s and registrant’s goods are
`considered related for likelihood of confusion purposes.(cid:160) See, e.g., In re Davey Prods. Pty Ltd., 92 USPQ2d 1198, 1202-04 (TTAB 2009); In re
`Toshiba Med. Sys. Corp., 91 USPQ2d 1266, 1268-69, 1271-72 (TTAB 2009).
`
`(cid:160)A
`
`ccordingly, because applicant’s and registrant’s marks are similar and the goods are related, consumers are likely to be confused and
`registration must be refused under Section 2(d) of the Lanham Act.
`
`(cid:160)A
`
`dvisory – Ownership of Cited Registrations
`
`(cid:160)I
`
`f the marks in the cited registrations have been assigned to applicant, applicant may provide evidence of ownership of the marks by satisfying
`one of the following:
`
`(1)(cid:160) Record the assignment with the USPTO’s Assignment Recordation Branch (ownership transfer documents such as assignments can
`be filed online at http://etas.uspto.gov) and promptly notify the trademark examining attorney that the assignment has been duly recorded.
`
`(2)(cid:160) Submit copies of documents evidencing the chain of title.
`
`(3)(cid:160) Submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:(cid:160) “Applicant is the owner of
`U.S. Registration Nos. 1923531 and 2981585.”(cid:160)
`
`(cid:160)
`(cid:160)
`(cid:160)
`
`
`(cid:160)T
`
`MEP §812.01; see 15 U.S.C. §1060; 37 C.F.R. §§2.193(e)(1), 3.25, 3.73(a)-(b); TMEP §502.02(a).
`
`(cid:160)R
`
`ecording a document with the Assignment Recordation Branch does not constitute a response to an Office action.(cid:160) TMEP §503.01(d).
`
`(cid:160)A
`
`lthough applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support
`of registration.(cid:160) However, if applicant responds to the refusal, applicant must also respond to the requirements set forth below.
`
`(cid:160)I
`
`dentification and Classification of Goods
`
`(cid:160)T
`
`he wording “induction cookers” in the identification of goods is indefinite and must be clarified because applicant must specify how the
`
`induction cookers are powered, such as electromagnetic induction cookers.(cid:160) See TMEP §1402.01.(cid:160)(cid:160)
`
`Applicant may adopt the following identification, if accurate:
`
`Class 11:(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)
`
`{Specify how induction cookers are powered, e.g., electromagnetic} induction cookers; induction heaters designed as food
`warmers; induction heating hobs
`
`(cid:160)A
`
`n applicant may only amend an identification to clarify or limit the goods, but not to add to or broaden the scope of the goods.(cid:160) 37 C.F.R.
`
`§2.71(a); see TMEP §§1402.06 et seq., 1402.07.(cid:160)(cid:160)
`
`For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S.
`Acceptable Identification of Goods and Services Manual at http://tess2.uspto.gov/netahtml/tidm.html. (cid:160) See TMEP §1402.04.
`
`(cid:160)D
`
`isclaimer Required
`
`(cid:160)A
`
`pplicant must disclaim the wording “SENSOR” in the mark because it merely describes a feature of applicant’s goods, and thus is an
`unregistrable component of the mark.(cid:160) See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d
`1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371
`
`(Fed. Cir. 2004)); TMEP §§1213, 1213.03(a).(cid:160)(cid:160)
`
`As noted above, “SENSOR” means “a device that detects or senses heat, light, sound, motion, etc., and then reacts to it in a particular way.” (cid:160)
`See earlier-referenced dictionary definition.(cid:160) Sensors are common components of induction-based goods.(cid:160) See earlier-referenced TDK screen
`capture. (cid:160) Therefore, the wording merely describes that applicant’s induction goods use sensors while they operate.
`
`(cid:160)A
`
`n applicant may not claim exclusive rights to terms that others may need to use to describe their goods in the marketplace.(cid:160) See Dena Corp. v.
`Belvedere Int’l, Inc. , 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983).(cid:160)
`A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove the disclaimed
`
`matter from the mark.(cid:160) See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213.(cid:160)(cid:160)
`
`If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark.(cid:160) See In re Stereotaxis Inc., 429 F.3d
`1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP §1213.01(b).
`
`(cid:160)A
`
`pplicant should submit a disclaimer in the following standardized format:
`
`No claim is made to the exclusive right to use “SENSOR” apart from the mark as shown.
`
`(cid:160)F
`
`or an overview of disclaimers and instructions on how to satisfy this disclaimer requirement online using the Trademark Electronic Application
`System (TEAS) form, please go to http://www.uspto.gov/trademarks/law/disclaimer.jsp.
`
`(cid:160)A
`
`mended Mark Description Required
`
`(cid:160)T
`
`he description of the mark is inaccurate because it presents the literal element in the mark as the compound term “GENIUSSENSOR”, rather
`than the separate term “GENIUS SENSOR” as it appears in the drawing.(cid:160) Applications for marks not in standard characters must include an
`accurate and concise description of the entire mark that identifies literal elements as well as any design elements.(cid:160) See 37 C.F.R. §2.37; TMEP
`
`§§808.02, 808.03(d).(cid:160)(cid:160)
`
`Therefore, applicant must provide a more accurate description of the applied-for mark.(cid:160) The following is suggested:
`
`The mark consists of the wording “GENIUS SENSOR” in stylized font.
