`The marks also contain additional wording, but this does not eliminate the likelihood of confusion. Although marks are compared in their
`entireties, one feature of a mark may be more significant or dominant in creating a commercial impression.(cid:160) See In re Viterra Inc., 671 F.3d 1358,

`Here, “GENIUS” is the dominant term in the marks. (cid:160) The only additional wording in applicant’s mark is “SENSOR”, which is descriptive of
`applicant’s induction goods. (cid:160) The attached entry from the Merriam-Webster dictionary notes that “SENSOR” means “a device that detects or
`senses heat, light, sound, motion, etc., and then reacts to it in a particular way.” (cid:160) See attached dictionary definition.(cid:160) Sensors are common
`
`components of induction-based goods.(cid:160) See attached TDK screen capture. (cid:160)(cid:160)
`
`Nor does registrant’s use of the terms “THE” and “PRESTIGE” in its “THE GENIUS” and “GENIUS PRESTIGE” marks take away from
`similarities.(cid:160) The Trademark Trial and Appeal Board has found that inclusion of the term “the” at the beginning of one of the marks will
`generally not affect or otherwise diminish the overall similarity between the marks.(cid:160) See In re Thor Tech Inc., 90 USPQ2d 1634, 1635 (TTAB
`2009).(cid:160) Thus, the wording “THE” in registrant’s “THE GENIUS” mark is less significant.(cid:160) Additionally, “GENIUS” is the first term in
`registrant’s “GENIUS PRESTIGE” mark.(cid:160) Consumers are generally more inclined to focus on the first word, prefix, or syllable in any
`trademark or service mark.(cid:160) See Palm Bay Imps., Inc. v. Veuve Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d 1369, 1372, 73 USPQ2d
`1689, 1692 (Fed. Cir. 2005); Presto Prods., Inc. v. Nice-Pak Prods., Inc., 9 USPQ2d 1895, 1897 (TTAB 1988) (“it is often the first part of a
`mark which is most likely to be impressed upon the mind of a purchaser and remembered” when making purchasing decisions).(cid:160) Thus, the

`entity commonly produces the relevant goods and markets the goods under the same mark.(cid:160) Therefore, applicant’s and registrant’s goods are
