`the issues below.(cid:160) 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
`
`SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
`
`Registration of the applied-for mark is refused because of a likelihood of confusion with the marks in U.S. Registration Nos. 2219862, 3108573,
`3425266 and 4893862.(cid:160) Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.(cid:160) Please see the enclosed registrations.
`
`(cid:160)A
`
`pplicant has applied to register the mark PANASONIC P·180 for “end-to-end solution including network connectivity for purchase and
`support of mobility platform turnkey.” (cid:160) The registered marks are PANASONIC for goods including “computer software featuring office
`management applications, namely, word processing, spread sheets and electronic mail, interactive multimedia disc players, software for
`interactive multimedia disc players which allows the contents of multimedia discs to be transmitted across global communications networks;”
`PANASONIC for goods including “children's educational software, compiler software for music and visual images, and computer graphic
`software;.” PANASONIC for goods including “recording software exclusively used for network cameras; “computer software for classifying,
`managing, browsing and editing documents and images; computer software for industrial equipment control;” and PANASONIC for goods and
`services including “full-text search engine software; newspaper distribution systems, namely, computer hardware and software systems for use in
`the transmission of data and information; data broadcast and electric program guide systems, namely, computer hardware and software systems
`for use in the transmission of data and information;” “providing non-downloadable computer software for use in digital image processing;
`providing non-downloadable computer software for browsing information on the Internet.”
`
`(cid:160)T
`
`rademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely a potential consumer
`would be confused, mistaken, or deceived as to the source of the goods and/or services of the applicant and registrant.(cid:160) See 15 U.S.C. §1052(d).(cid:160)
`A determination of likelihood of confusion under Section 2(d) is made on a case-by case basis and the factors set forth in In re E. I. du Pont de
`Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973) aid in this determination.(cid:160) Citigroup Inc. v. Capital City Bank Grp., Inc., 637
`F.3d 1344, 1349, 98 USPQ2d 1253, 1256 (Fed. Cir. 2011) (citing On-Line Careline, Inc. v. Am. Online, Inc., 229 F.3d 1080, 1085, 56 USPQ2d
`1471, 1474 (Fed. Cir. 2000)).(cid:160) Not all the du Pont factors, however, are necessarily relevant or of equal weight, and any one of the factors may
`control in a given case, depending upon the evidence of record.(cid:160) Citigroup Inc. v. Capital City Bank Grp., Inc., 637 F.3d at 1355, 98 USPQ2d at
`1260; In re Majestic Distilling Co., 315 F.3d 1311, 1315, 65 USPQ2d 1201, 1204 (Fed. Cir. 2003); see In re E. I. du Pont de Nemours & Co., 476
`F.2d at 1361-62, 177 USPQ at 567.
`
`(cid:160)I
`
`n this case, the following factors are the most relevant:(cid:160) similarity of the marks, similarity and nature of the goods and services, and similarity of
`the trade channels of the goods and services.(cid:160) See In re Viterra Inc., 671 F.3d 1358, 1361-62, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re
`Dakin’s Miniatures Inc. , 59 USPQ2d 1593, 1595-96 (TTAB 1999); TMEP §§1207.01 et seq.
`
`(cid:160)C
`
`omparison of the Marks
`
`(cid:160)M
`
`arks are compared in their entireties for similarities in appearance, sound, connotation, and commercial impression.(cid:160) Stone Lion Capital
`Partners, LP v. Lion Capital LLP, 746 F.3d 1317, 1321, 110 USPQ2d 1157, 1160 (Fed. Cir. 2014) (quoting Palm Bay Imps., Inc. v. Veuve
`
`(cid:160)
`(cid:160)
`(cid:160)
`
`
`Clicquot Ponsardin Maison Fondee En 1772, 396 F. 3d 1369, 1371, 73 USPQ2d 1689, 1691 (Fed. Cir. 2005)); TMEP §1207.01(b)-(b)(v).(cid:160)
`“Similarity in any one of these elements may be sufficient to find the marks confusingly similar.” (cid:160) In re Davia, 110 USPQ2d 1810, 1812 (TTAB
`2014) (citing In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); In re 1st USA Realty Prof’ls, Inc. , 84 USPQ2d 1581, 1586 (TTAB
`2007)); TMEP §1207.01(b).
`
`(cid:160)I
`
`n this case, applicant has applied to register the mark PANASONIC P·180.(cid:160) Registrant’s marks are all PANASONIC. (cid:160) Both applicant’s mark
`and registrant’s marks feature the identical term PANASONIC. (cid:160) Overall, the marks have the same commercial impression.
`
`(cid:160)C
`
`omparison of the Goods and Services
`
`(cid:160)T
`
`he goods or services of the parties need not be identical or even competitive to find a likelihood of confusion.(cid:160) See On-line Careline Inc. v. Am.
`Online Inc., 229 F.3d 1080, 1086, 56 USPQ2d 1471, 1475 (Fed. Cir. 2000); Recot, Inc. v. Becton, 214 F.3d 1322, 1329, 54 USPQ2d 1894, 1898
`(Fed. Cir. 2000) (“[E]ven if the goods in question are different from, and thus not related to, one another in kind, the same goods can be related
`
`in the mind of the consuming public as to the origin of the goods.”); TMEP §1207.01(a)(i). (cid:160)(cid:160)
`
`The respective goods or services need only be “related in some manner and/or if the circumstances surrounding their marketing [be] such that
`they could give rise to the mistaken belief that [the goods and/or services] emanate from the same source.” (cid:160) Coach Servs., Inc. v. Triumph
`Learning LLC, 668 F.3d 1356, 1369, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d 1715, 1724
`(TTAB 2007)); TMEP §1207.01(a)(i).
`
`(cid:160)I
`
`n this case, applicant has identified its goods or services as “end-to-end solution including network connectivity for purchase and support of
`mobility platform turnkey.” (cid:160) Registrant’s goods and services include “computer software featuring office management applications, namely,
`word processing, spread sheets and electronic mail, interactive multimedia disc players, software for interactive multimedia disc players which
`allows the contents of multimedia discs to be transmitted across global communications networks;” “children's educational software, compiler
`software for music and visual images, and computer graphic software;” “recording software exclusively used for network cameras; “computer
`software for classifying, managing, browsing and editing documents and images; computer software for industrial equipment control;” “full-text
`search engine software; newspaper distribution systems, namely, computer hardware and software systems for use in the transmission of data and
`information; data broadcast and electric program guide systems, namely, computer hardware and software systems for use in the transmission of
`data and information;” “providing non-downloadable computer software for use in digital image processing; providing non-downloadable
`computer software for browsing information on the Internet.”
`
`(cid:160)B
`
`ecause the precise function of applicant’s software is unclear, the software could be identical or closely related to the software identified in the
`registered marks.
`
`(cid:160)S
`
`ince the marks are similar and the goods and services related, there is a likelihood of confusion as to the source of applicant’s goods or
`services.(cid:160) Therefore, applicant’s mark is not entitled to registration.
`
`(cid:160)R
`
`ESPONSE GUIDELINES
`
`(cid:160)A
`
`lthough applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support
`of registration.
`
`(cid:160)P
`
`RIOR PENDING APPLICATIONS
`
`(cid:160)T
`
`he filing dates of pending U.S. Application Serial Nos. 86508286, 79187613 and 79195545 precede applicant’s filing date.(cid:160) See attached
`referenced applications.(cid:160) If one or more of the marks in the referenced applications register, applicant’s mark may be refused registration under
`Trademark Act Section 2(d) because of a likelihood of confusion with the registered mark(s).(cid:160) See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP
`§§1208 et seq.(cid:160) Therefore, upon receipt of applicant’s response to this Office action, action on this application may be suspended pending final
`disposition of the earlier-filed referenced applications.
`
`(cid:160)I
`
`n response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict
`between applicant’s mark and the marks in the referenced applications.(cid:160) Applicant’s election not to submit arguments at this time in no way
`limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
`
`(cid:160)O
`
`WNERSHIP OF CITED REGISTRATIONS OR APPLICATIONS
`
`(cid:160)I
`
`f the marks in the cited registrations and the potentially conflicting prior-filed applications have been assigned to applicant, applicant

`
`(cid:160)I
`
`DENTIFICATION AND CLASSIFICATION OF GOODS OR SERVICES
`
`(cid:160)T
`
`he identification of goods or services is indefinite and must be clarified because it is not clear if by “solutions” applicant is referring to
`“software” and, if so, whether it is being offered as Class 9 goods or Class 42 services (or both). (cid:160) See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.(cid:160)
`
`Applicant may adopt the following identification, if accurate:(cid:160)(cid:160)
`“Computer software for connecting remotely to computer networks and for [specify the function of the software as it relates to
`“purchase and support of mobility platform turnkey” ],” in International Class 9.
`
`“Software as a service (SAAS) services featuring software for connecting remotely to computer networks and for [specify the function
`of the software as it relates to “purchase and support of mobility platform turnkey” ],” in International Class 9.
`
`(cid:160)A
`
`pplicant’s goods and/or services may be clarified or limited, but may not be expanded beyond those originally itemized in the application or as
`acceptably amended.(cid:160) See 37 C.F.R. §2.71(a); TMEP §1402.06.(cid:160) Applicant may clarify or limit the identification by inserting qualifying
`language or deleting items to result in a more specific identification; however, applicant may not substitute different goods and/or services or
`add goods and/or services not found or encompassed by those in the original application or as acceptably amended.(cid:160) See TMEP §1402.06(a)-(b).(cid:160)
`The scope of the goods and/or services sets the outer limit for any changes to the identification and is generally determined by the ordinary
`meaning of the wording in the identification.(cid:160) TMEP §§1402.06(b), 1402.07(a)-(b).(cid:160) Any acceptable changes to the goods and/or services will
`further limit scope, and once goods and/or services are deleted, they are not permitted to be reinserted.(cid:160) TMEP §1402.07(e).

`
`ULTIPLE CLASS APPLICATION REQUIREMENTS
`
`(cid:160)T
`
`he application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below
`for each international class based on Trademark Act Section 1(b):
`
`(1)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)(cid:160)

`numbered class.
`
`Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule at
`http://www.uspto.gov/trademarks/tm_fee_info.jsp).(cid:160) The application identifies goods and/or services that could be classified in at
`least two classes; however, applicant submitted a fee sufficient for only one class.(cid:160) Applicant must either submit the filing fees for the
`classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
