`The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to

`The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no similar registered
`marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d). However, marks in prior-filed
`pending applications may present a bar to registration of applicant’s mark.
`
`Prior-Filed Pending Applications
`
`The filing dates of pending U.S. Application Serial Nos. 86906606, 87131367, and 87728632 precede applicant’s filing date. See attached
`referenced applications. If one or more of the marks in the referenced applications register, applicant’s mark may be refused registration under
`Trademark Act Section 2(d) because of a likelihood of confusion with the registered mark(s). See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP
`§§1208 et seq. Therefore, upon receipt of applicant’s response to this Office action, action on this application may be suspended pending final
`disposition of the earlier-filed referenced applications.
`
`In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict
`between applicant’s mark and the marks in the referenced applications. Applicant’s election not to submit arguments at this time in no way
`limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
`
`Identification of Goods and Services
`

`Applicant must clarify much of the wording in the identification of goods and services because it is indefinite and too broad. See 37 C.F.R.
`§2.32(a)(6); TMEP §§1402.01, 1402.03. This wording is indefinite because it does not make clear what the goods and services are. Please see
`below for further guidance.
`
`Furthermore, the activities identified as “retail or wholesale services” in International Class 35 are indefinite and must be clarified because these
`services could include a wide array of retail and wholesale support services – from accounting to advertising and marketing services. See 37
`
`C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.11.
`
`If applicant’s retail services involve retail stores or outlets (online or brick-and-mortar), or distributorships, applicant should amend the
`identification to specify (1) the nature of the retail activity provided (e.g., retail stores, retail distributorships, online retail outlets), and (2) the
`field or type of goods offered through those retail services. See TMEP §§1301.01(a)(ii), 1402.11. Applicant must also amend the identification
`to specify the nature of the wholesale activity that applicant provides (e.g., wholesale distributorships, wholesale services by direct solicitation by
`sales agents, or wholesale store services). If the services are in the nature of wholesale stores, direct solicitation, or distributorships, the
`
`identification should also indicate the field or type of goods offered through the wholesale services. See TMEP §§1301.01(a)(ii), 1402.11.
`
`Finally, applicant has included the term “ or” in the identification of goods and services. However, this term is generally not accepted in
`identifications when (1) it is unclear whether applicant is using the mark, or intends to use the mark, on all the identified goods or services; (2)
`the nature of the goods and services is unclear; or (3) classification cannot be determined from such wording. See TMEP §1402.03(a). An
`application must specify, in an explicit manner, the particular goods or services on or in connection with which the applicant uses, or has a bona
`fide intention to use, the mark in commerce. See 15 U.S.C. §1051(a)(2), (b)(2); 37 C.F.R. §2.32(a)(6); TMEP §1402.01. Therefore, applicant
`should replace “ or” with “ and” in the identification of goods or services, if appropriate, or rewrite the identification with the “ or” deleted and
`
`the goods or services specified using definite and unambiguous language.
`Applicant may substitute the following wording, if accurate:
`
`“ Metalworking machines and tools, namely, {indicate particular tools in this Class, e.g., saws and cutters}; metalworking machine
`using lasers; industrial robots for metalworking using laser; laser welding machines for metalworking; laser cutting machines for
`metalworking” in International Class 7; and/or
`
`“Electronic machines, apparatus and their parts, namely, {indicate particular machines in this Class, e.g., weighing machines}; distance
`measuring apparatus; measuring and testing machines and instruments, namely, {indicate particular machines and instruments in this
`Class, e.g., coordinate measuring machines, metal strength testing machines}” in International Class 9; and/or
`
`“ Advertising and publicity services; business management analysis and business consultancy; marketing research and analysis;
`providing information concerning commercial sales; publicity material rental; providing information on newspaper articles, namely,
`{indicate particular information in this Class, e.g., information about newspaper subscriptions}; retail store services and wholesale
`store services featuring metalworking machines and tools; retail store services and wholesale store services featuring distance
`measuring apparatus; retail store services and wholesale store services featuring electronic machines; retail store services and
`wholesale store services featuring electrical machinery and apparatus” in International Class 35; and/or
`
`“Providing information on newspaper articles, namely, {indicate particular information in this Class, e.g., information about
`newspaper delivery}” in International Class 39; and/or
`
`“Providing information on newspaper articles, namely, {indicate particular information in this Class, e.g., information about
`newspaper publishing}” in International Class 41.

`Applicant may amend the identification to clarify or limit the goods and services, but not to broaden or expand the goods and services beyond
`those in the original application or as acceptably amended. See 37 C.F.R. §2.71(a); TMEP §1402.06. Generally, any deleted goods and services
`may not later be reinserted. See TMEP §1402.07(e).

`The application identifies goods and services in more than one international class; therefore, applicant must satisfy all the requirements below for
`each international class based on Trademark Act Section 1(b):

`numbered class.

`Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule).

`
`Applicant must disclaim the wording “WELDING” because it merely describes an ingredient, quality, characteristic, function, feature, purpose,
`or use of applicant’s goods and services, and thus is an unregistrable component of the mark. See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS
`Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson
`
`LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); TMEP §§1213, 1213.03(a).

`Applicant’s goods encompass numerous metalworking tools and machines, including welding machines. Thus, the wording WELDING merely
`describes a feature or purpose of applicant’s goods and must be disclaimed.
`
`An applicant may not claim exclusive rights to terms that others may need to use to describe their goods and/or services in the marketplace. See
`Dena Corp. v. Belvedere Int’l, Inc., 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825
`(TTAB 1983). A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove
`the disclaimed matter from the mark. See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP
