`There is No Likelihood of Confusion with the Cited Prior Filed Applications
`The First Word “Welding” Creates a Different Commercial Impression in the Subject Mark from the Cited Applications

`In determining similarity or dissimilarity, the marks must be compared in their entireties. The Board has stated that when comparing
`marks, "[t]he proper test is not a side-by-side comparison of the marks, but instead 'whether the marks are sufficiently similar in terms of their
`commercial impression' such that persons who encounter the marks would be likely to assume a connection between the parties." Coach
`Servs., Inc. v. Triumph Learning LLC, 101 USPQ2d 1713, 1721 (Fed. Cir. 2012); see also Midwestern Pet Foods, Inc. v. Societe des Produits
`Nestle S.A., 685 F.3d 1046, 103 USPQ2d 1435, 1440 (Fed. Cir. 2012); San Fernando Elec. Mfg. Co. v. JFD Elec. Components Corp., 565
`F.2d 683, 196 USPQ 1, 3 (CCPA 1977); Spoons Rests. Inc. v. Morrison Inc., 23 USPQ2d 1735, 1741 (TTAB 1991), aff'd mem., 972 F.2d
`1353 (Fed. Cir. 1992).

`In comparing the parties’ marks, the marks in their entireties, not merely their respective word components must be compared. See,
`e.g., Estate of Beckwith v. Comm’r of Patents , 252 U.S. 538, 545-56, 40 S. Ct. 414 (1920) (“The commercial impression of a trademark is
`derived from it as a whole, not from its elements separated and considered in detail. For this reason, it should be considered in its entirety . .
`..”); Franklin Mint Corp. v. Master Mfg. Co., 667 F.2d 1005, 1007, 212 USPQ 233, 234 (CCPA 1981) (“It is axiomatic that a mark should
`not be dissected and considered piecemeal; rather, it must be considered as a whole in determining likelihood of confusion.”).

`While the cited marks each contain the word CONCIERGE, the inclusion of the first word WELDING to CONCIERGE in the subject
`application results in marks with different sounds, appearances and commercial impressions. Simply because the marks at issue may share a
`word is insufficient to support a finding of likelihood of confusion
`
`The Fed. Circuit and the TTAB recognize that the first word of a mark frequently bears a greater significance than subsequent words.
`See Citigroup, Inc. v. Capital City Bank Group, Inc., 94 USPQ2d 1645 (2010), 2010 WL 595586, at *21 (TTAB 2010) (Finding that the term
`“Capital City” is the dominant element in creating the commercial impression engendered by applicant’s marks is supported by its location as
`the beginning of applicant’s marks); see also Presto Products, Inc. v. Nice-Pak Products, Inc., 9 USPQ2d 1895, 1897 (TTAB 1988) (“it is
`often the first part of a mark which is most likely to be impressed upon the mind of a purchaser and remembered”); Palm Bay Imports, Inc. v.
`Veuve Clicquot Ponsardin, 396 F.3d 1369, 73 USPQ2d 1689, 1692 (Fed. Cir. 2005) (“Veuve” is the most prominent part of the mark VEUVE
`CLICQUOT because “veuve” is the first word in the mark and the first word to appear on the label); Century 21 Real Estate Corp. v. Century
`Life of America, 23 USPQ2d at 1700 (Fed. Cir. 1992) (upon encountering the marks, consumers must first notice the identical lead word).
`Accordingly, “WELDING” is the first word that consumers see when encountering the mark WELDING CONCIERGE and it forms a more
`prominent commercial impression.
`
`According the Merriam Webster Dictionary, “Concierge” means “a usually multilingual hotel staff member who handles luggage and
`mail, makes reservations, and arranges tours. (See Exhibit A). Thus Welding Concierge, is a distinct mark when applied to the subject goods
`and services. A concierge has nothing to do with “welding” and “welding” has nothing to do with a “concierge”.
` Thus the mark creates a
`separate and distinct commercial impression from the cited applications for the word Concierge on its own.
`
`Applicant believes that the foregoing sufficiently addresses the concerns raised in the Office Action surrounding potential likelihood
`of confusion with the cited pending applications. Applicant submits that its Application is now in condition to proceed to publication.
