`The applicant’s mark is AUDIO CENTER for “Downloadable application software for audio apparatus for controlling music reproduction,”
`with a disclaimer of “audio.”
`
`Registration is refused because the applied-for mark merely describes a characteristic, feature or purpose of applicant’s goods.Trademark Act
`Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.
`
`In addition to being merely descriptive, the applied-for mark appears to be generic in connection with the identified goods and, therefore,
`incapable of functioning as a source-identifier for applicant’s goods.  In re Gould Paper Corp., 834 F.2d 1017, 5 USPQ2d 1110 (Fed. Cir. 1987);
`In re Empire Tech. Dev. LLC, 123 USPQ2d 1544 (TTAB 2017); see TMEP §§1209.01(c) et seq., 1209.02(a).  Under these circumstances,
`neither an amendment to proceed under Trademark Act Section 2(f) nor an amendment to the Supplemental Register can be recommended.  See
`TMEP §1209.01(c).
`
`A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose, or use of an applicant’s goods
`and/or services.  TMEP §1209.01(b); see, e.g., In re TriVita, Inc., 783 F.3d 872, 874, 114 USPQ2d 1574, 1575 (Fed. Cir. 2015) (quoting In re
`Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); In re Steelbuilding.com, 415 F.3d 1293, 1297, 75

`USPQ2d 1420, 1421 (Fed. Cir. 2005) (citing Estate of P.D. Beckwith, Inc. v. Comm’r of Patents , 252 U.S. 538, 543 (1920)).  
`
`“Whether consumers could guess what the product [or service] is from consideration of the mark alone is not the test.”   In re Am. Greetings
`Corp., 226 USPQ 365, 366 (TTAB 1985).  The question is not whether someone presented only with the mark could guess what the goods
`and/or services are, but “whether someone who knows what the goods and[/or] services are will understand the mark to convey information
`about them.”   DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1254, 103 USPQ2d 1753, 1757 (Fed. Cir. 2012) (quoting
`In re Tower Tech, Inc., 64 USPQ2d 1314, 1316-17 (TTAB 2002)); In re Mueller Sports. Med., Inc., 126 USPQ2d 1584, 1587 (TTAB 2018).
`
`An AUDIO CENTER appears to be a central location that provides tools for controlling an audio function of particular goods.  For example, the
`applicant’s software provides a centralized location for controlling music reproduction using an audio apparatus.   The attached evidence
`collected from various third party websites shows that other electronics companies use the terminology “audio center” to refer to the same such
`centralized locations for programming or controlling audio functions of the goods.  For example, the ALO Audio Center software application, “is
`a reliable application that offers you professional tools for editing audio files and copying them onto discs. The application supports several audio
`file formats and can even extract the sound stream from video clips. Moreover, the software can process the input files in a short time and allows
`you to customize them in many aspects.” See https://www.softpedia.com/get/Multimedia/Audio/Audio-Editors-Recorders/ALO-Audio-
`
`Center.shtml.   
`
`Two major reasons for not protecting descriptive marks are (1) to prevent the owner of a descriptive mark from inhibiting competition in the
`marketplace and (2) to avoid the possibility of costly infringement suits brought by the trademark or service mark owner.  In re Abcor Dev.
`Corp., 588 F.2d 811, 813, 200 USPQ 215, 217 (C.C.P.A. 1978); TMEP §1209.  Businesses and competitors should be free to use descriptive
`language when describing their own goods and/or services to the public in advertising and marketing materials.  See In re Styleclick.com Inc., 58
`USPQ2d 1523, 1527 (TTAB 2001).
`
`In conclusion, registration is denied because the mark merely describes the applicant’s goods.
`
`Although applicant’s mark has been refused registration, applicant may respond to the refusal by submitting evidence and arguments in support

`Due to the descriptive nature of the applied-for mark, applicant must provide the following information and documentation regarding the goods

`Fact sheets, instruction manuals, brochures, advertisements and pertinent screenshots of applicant’s website as it relates to the
`goods and/or services in the application, including any materials using the terms in the applied-for mark.  Merely stating that

`information about the goods and/or services is available on applicant’s website is insufficient to make the information of record.;

`If these materials are unavailable, applicant should submit similar documentation for goods and services of the same type,
`explaining how its own product or services will differ.  If the goods and/or services feature new technology and information
`regarding competing goods and/or services is not available, applicant must provide a detailed factual description of the goods
`and/or services.  Factual information about the goods must make clear how they operate, salient features, and prospective
`customers and channels of trade.  For services, the factual information must make clear what the services are and how they are
`rendered, salient features, and prospective customers and channels of trade.  Conclusory statements will not satisfy this
`requirement.; and
